CHAPTER 117

An Act to Incorporate The Trustees of St. James'
Evangelical Lutheran Church at

Branch La Have.

(Passed the 19th day of March, A. D. 1926)

Be it enacted by the Governor, Council, and Assembly, as follows:

I. The Reverend Stanley W. Gartung, Pas- Incorporation. tor of the Midville Parish of the Nova Scotia Synod of the United Lutheran Church of America; Albert Wentzell, of New Canada; William Veinot of New Canada and Allan Crouse of Branch LaHave, Deacons, and their respective successors in office, to be elected and chosen according to the Constitution and By-Laws of the St. James' Evangelical Lutheran Church at Branch LaHave, are hereby constituted and declared a body corporate under the name of "The Trustees of St. James' Evangelical Lutheran Church at Branch LaHave" and by that name shall have perpetual succession, shall have power to take, hold, receive, possess and enjoy real and personal property, and shall be able and capable in law to sue and be sued in the Province and elsewhere and have a common seal.

2. sign, release, mortgage, lease, convey or otherwise dispose of such lands, or any part thereof, for such uses and purposes, or any of them, in the manner herein provided.

4. All deeds, leases, mortgages, releases and other conveyances of the property of the Corporation shall be under the Corporate Seal and signed by at least two-thirds of the Trustees.

5. The Trustees may borrow moneys on deeds of trust, mortgage, or mortgages of the lands of the Corporation, for the purpose of erecting, finishing, enlarging or repairing any Church, Chapel, School or Clergyman's residence erected or to be erected, or to pay off any debt incurred by the Corporation, or for which the Corporation may become liable, provided that any such person from whom such moneys are borrowed on any such security shall not be liable to see to the application of such moneys or any part thereof.

Except for the purposes mentioned in secand Synod re- tion 5 the Trustees shall only have power to lease, mortgage, or sell the lands of the Corporation upon being authorized by a meeting of the Congregation specially called for that purpose and with the approval of the Nova Scotia Synod of the United Lutheran Church of America.

7. No Grant, deed or gift to or from, and no devise or bequest to the Corporation, whether made before or after the passing of this Act, is or shall be held void in whole or in part on account of any error in the name of the Corporation so long as the intention of the Grantor or the Testator is beyond reasonable doubt.

8. The powers and privileges of the said Corporation shall be held and exercised under and subject to the Constitution, By-Laws and Ordinances, which the congregation of St. James' Evangelical Lutheran Church at Branch LaHave which shall be known as "St. James' Evangelical Lutheran Church at Branch LaHave may and are hereby author

ized to make or adopt in accordance with the polity, usages, principles and doctrines of the United Lutheran Church of America as especially set forth in the Unaltered Augsburg Confession, in Luther's Small Catechism, and the Fundamental Principles of Faith as adopted by the Nova Scotia Synod of the United Lutheran Church of America and not inconsistent with the laws of the Province of Nova Scotia.

CHAPTER 118

"An Act to Incorporate the Trustees of Salem Church
and to Incorporate the Trustees of St. George's
Congregation, both of River John
in the County of Pictou."

(Passed the 19th day of March, A D. 1926.)

WHEREAS an action was brought in the Su- Preamble. preme Court of Nova Scotia, to set aside a vote of the congregation at River John in the County of Pictou in connection with The Presbyterian Church in Canada, taken under the provisions of Chapter 100, Statutes of Canada, 1924, the Act incorporating The United Church of Canada, and all the parties thereto have agreed to settle the action and to compose their differences under the following terms:

That Salem Church should be a congregation in connection with The United Church of Canada and should have the title to the lands of said Church and to the funds now held for it, and the Glebe Lot herein after described, and that the Continuing Presbyterians should have the title to St. George's Church and Manse; and in order to carry out the settlement, the property should be vested in Trustees for the respective congregations;

Be it enacted by the Governor, Council and Assembly as follows:

Powers of respective Boards;

I. D. K. McLean, D. A. Murray, M. D.; H. M. Tattrie, D. C. Forbes, C. M. Langille, James Fitzpatrick, Robt. Sutherland, William McGregor, Arthur McCunn, Hope W. Langille and James Perrin are hereby incorporated under the name of "Trustees of Salem Church" at River John in connection with The United Church of Canada, and shall be known as "Trustees of Salem Church," and the property known as Salem Church and all the assets now in the hands of the Trustees or any of them, and the Glebe Lot, so-called, described in a deed from William Matheson to the Trustees of Bellevue Church at River John (now Salem Church) dated the 13th of July, 1847, recorded in Book 43, page 656, in the Registry of Deeds at Pictou, are vested in the said Trustees of Salem Church for the use of said congregation.

2. E. R. Langille, M. G. McLeod, Matthias Gratto, Alex. McInnes, John R. Sutherland, John Mitchell, H. D. McKay, Albert Elliott, John J. McLeod and John Stramberg, are hereby constituted a body corporate under the name of "Trustees of St. George's Congregation" at River John, in connection with the non-concurring Presbyterian Church in Canada, and shall be known as "Trustees of St. George's Church." The property heretofore known as St. George's Church and the Manse connected therewith are vested in the said Trustees of St. George's Church for the use of the said congregation.

3. Each respective Board of Trustees shall have Officers: Annnal power to purchase, take, hold, and enjoy real and Meeting. personal property, and may sell, convey, mortgage, lease or otherwise dispose of the same. The Trustees respectively shall appoint one of their Board as Chairman and one as Secretary and the above named Boards respectively shall have power to act until their successors are appointed. An annual meeting of the respective congregations shall be held in each and every year, and the first meeting shall fix the number of Trustees to be thereafter elcted to constitute the respective Boards of Trustees.
