Sinking fund and interest.

CHAPTER 75.

An Act Relating to the Town of Dartmouth.

(Passed the 19th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. The Town of Dartmouth is authorized to borrow or raise by way of loan on the credit of the town the following:

(a) A sum of money not exceeding Fifty Thousand Dollars ($50,000.00) to be used for the purpose of paving the streets in the town;

(b) A sum of money not to exceed Five Thousand Dollars ($5,000.00) for the extension and supply of water within the town;

(c) A sum of money not to exceed Forty-five Thousand Dollars ($45,000.00) for the purpose of applying the amount raised towards retiring debentures for water and sewerage of Fifty-Four Thousand Dollars ($54,000.00) due on the 1st day of October, 1926, issued under Chapter 75 of the Acts of 1906.

Where any money is borrowed or raised by the issue and sale of debentures of the town under this Act, and the Municipal Debentures Act, the Council of the town shall provide for a sinking fund with respect to such debentures. The amount to be paid annually into the sinking fund shall not be less than three per centum of the aggregate amount of said. debentures and shall not be more than the council deems sufficient to provide for the payment of the debentures when the same are payable, and the first payment into such sinking fund shall be made within one year from the date of the debentures.

3. No money shall be borrowed under Sections Ratepayers to 1 (a) and 1 (b) of this Act until a resolution approving of such borrowing has been submitted to and adopted by a public meeting of the ratepayers, to be called by advertisement for ten days previous thereto, to be discussed at such meeting, and to be voted upon by the ratepayers assessed on real estate, and the council shall obtain the approval of the majority of such ratepayers voting thereon. The provisions of Sections 191 to 194 inclusive of Chapter 56 of the Acts of 1902 shall mutatis mutandis apply.

A certificate under the hand of the Mayor Certificate. and of the Town Clerk and under the corporate seal of the town, of the holding of the meeting mentioned in Section 3 of this Act and of the resolution and the vote thereon shall be conclusive evidence of the required approval of such borrowing.

8. The payment of One Hundred and Fifty Dollars by Ferry Com- ($150.00) by the Dartmouth Ferry Commission to the Natal Day Committee of the Town of Dartmouth is hereby declared to have been legally and validly made for the celebration of Natal Day in the year 1925.

9. Sub-section (5) of Section 205, sections 206 to 209 inclusive of Chapter 56 of the Acts of 1902 as enacted by section 13 of Chapter 93 of the Acts of 1921 are repealed.

10. The Dartmouth Ferry Commission may pay Natal Day fund annually to the Natal Day Committee of the town a sum not exceeding Four Hundred and Fifty Dollars ($450.00) to be used solely for the purpose of assisting in the proper celebration of Natal Day.

II. The Dartmouth Ferry Commission may enter into agreements with its permanent employees for the joint purchase of the insurance and its proper distribution. All payments heretofore made by the said Ferry to the employees when they were unable to work through sickness are hereby declared to have been legally and validly made.

The Maritime Fish Corporation, Limited, shall, subject to Sections 15 to 20 inclusive hereof,

during the period of twenty years commencing from the first day of May, 1926, on or before the first day of January in each and every year of said period pay to the Town of Dartmouth a fixed Tax of Five Hundred Dollars ($500) without any deduction or abatement therefrom on any account whatsoever. The said tax shall apply to the Gilroy lands so called to be purchased by the said corporation and all buildings, save as hereinafter provided, erected thereon. The said tax shall constitute a lien on the said property and be enforceable in the same manner as taxes and rates are collectable under the provisions of the Acts relating to the Town of Dartmouth and the Towns' Incorporation Act.

13. The said corporation shall be exempt from Exemption all taxes and rates except as to the Five Hundred Dollars ($500.00) in the next preceding section mentioned for the period of twenty years as aforesaid on its fish supply, curing, freezing and cold storage plant, the wharves shall be or are erected, and all fish and all fish and fish products and accessories used in connection therewith that shall be handled in, at or on the said plant and wharves during said period of twenty years; but if the same corporation shall acquire or erect buildings, boarding houses, stores or other buildings anywhere on said site or in said town for any purpose other than the handling, supply, curing, freezing, packing, storage and shipping of fish and fish products or if it should trade or deal in any merchandise or goods except fish and fish products, then the said corporation shall be assessed and taxed for said dwellings, boarding houses, stores and other buildings and sites upon which they stand and the land used in connection therewith and also for said merchandise and goods in the same manner as others are assessed and taxed for similar real estate and personal property respectively in the said town.

other appurtenances used in connection with the said corporation on the said property in the town within two years from the passing of this Act.

15. The corporation shall employ at their works in the town at least sixty persons for ten months and shall have access to the books of the company for purpose of ascertaining the number of men employed each month during the year.

16. The Town shall, subject to any cause beyond its control, permit the corporation the use free of cost for the purpose of effective working of its plant in the Town an amount of water from the water supply of the Town not exceeding forty thousand gallons each day, and the Town shall be entitled to enter the plant of the corporation and install and inspect a meter from time to time, the corporation paying the Town the regular town water rates on the water which it takes from the Town exceeding the said amount of forty thousand gallons each day.

17. The Town shall have the privilege of leasing to the corporation the water frontage known as the public dock which lies at the foot of Lyle Street and between the Gilroy water lots in the harbour of Halifax at a nominal rental, the Town, however, to have the privilege of entering the premises of the corporation for the purpose of laying and repairing any sewer which may pass at the foot of Lyle Street into the said harbour.

18. Sections 12 and 17 inclusive shall not become 96, R. S. 1923, effective until the Council of the Town submits not applicable. the question of granting the aforementioned concessions to the said corporation in accordance, as nearly as possible, with the procedure prescribed in sections 189 to 194 inclusive of Chapter 56 of the Acts of 1902. Chapter 96 of the Revised Statutes, 1923, shall not apply.
