CHAPTER 38.

An Act to Amend Chapter 86, Revised Statutes of
Nova Scotia, 1923, "The Assessment Act".

(Passed the 15th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. Section 132 of Chapter 86, Revised Statutes of Nova Scotia, 1923, as amended by Section 5 of Chapter 55 of the Acts of 1925, is amended by inserting between the word "be" and the word "the" in the tenth line thereof, the words "not later than".

CHAPTER 39.

An Act to Amend Chapter 86, Revised Statutes of
Nova Scotia, 1923, "The Assessment Act".

(Passed the 19th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. Section 80 of Chapter 86, Revised Statutes of Nova Scotia, 1923, is amended by adding thereto the following sub-section:

(2) The Council may, at the same time, establish and fix a rate of discount on rates and taxes paid on or before a date fixed by the council, and any person, firm, association or corporation paying to the collector or treasurer his or their rates and taxes on or before the date so fixed by the council shall be entitled to such discount therefrom as the council has established and fixed.

CHAPTER 40.

An Act to Amend Chapter 111, Revised Statutes. 1923, "Of the Supply of Cattle Feed and Seed Grain to Polling Districts".

(Passed the 19th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. Section 3 of Chapter 111 of the Revised Statutes 8. 3 amended. of Nova Scotia, 1923, as amended by Chapter 59

of the Acts of 1925, is amended by striking out the word "four" in the fourth line thereof and substituting therefor the word "five".

CHAPTER 41.

An Act to Amend Chapter 112, Revised Statutes of
Nova Scotia, 1923, "The Barristers and
Solicitors' Act".

(Passed the 19th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. Section 69 of Chapter 112 of the Revised Subsection addStatutes of Nova Scotia, 1923, is amended by adding thereto the following sub-section:

(2) Any articled clerk may, on behalf of a barrister Articled Clerk or solicitor to whom he is articled, appear as counsel proceedings. in any police, stipendiary magistrate or justice's court, either in criminal or civil proceedings, but no fee, charge or reward shall be collected for such appearance by such articled clerk from any client, except by the barrister or solicitor on whose behalf such articled clerk is appearing.

CHAPTER 42.

An Act to Amend Chapter 122, Revised Statutes of
Nova Scotia, 1923, "Of Insurance Agents".

(Passed the 15th day of March, A. D. 1926.)

Be it enacted by the Governor, Council, and Assembly as follows:

1. Section 1 of Chapter 122, the Revised Statutes is amended by adding thereto the following subsection:

Certificate may (2) The Provincial Secretary may in his dismisconduct or cretion, for misconduct or for violation of any of the provisions of this Chapter, or of the Insurance Act of the Dominion of Canada, or of the Life Insurance Act, or of the Fire Insurance Policies Act, by any person, firm, company or corporation, refuse to issue a certificate of authority as in this section provided, to any such person, firm, company or corporation.

S. 11 repealed; substituted.

2. Section 6 of said Chapter 122 is amended by striking out the word "January" in the third line thereof and substituting therefor the word "October."

3. Section 11 of said Chapter 122 is repealed and the following substituted therefor:

11. The list of all agents in the Province of Nova Royal Gazette. Scotia to whom certificates of authority have been issued and which are in force may be printed from time to time in the Royal Gazette.

CHAPTER 43.

An Act to Amend Chapter 128 of the Revised Statutes of 1923, "The Public Utilities Act".

(Passed the 19th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

1. Section 52 of Chapter 128 of the Revised Subsection addStatutes, 1923, "The Public Utilities Act", is amended by adding to Section 52 of said Act the following Sub-section:

(11) The preceding Sub-sections of this Section Preceding subshall not apply and shall be deemed not to have applicable. applied to a public utility that is a city, an incorporated town, or a municipality.

CHAPTER 44.

An Act to Amend Chapter 130 of the Revised Statutes of 1923, entitled "The Power Commission

Act".

(Passed the 15th day of March, A. D. 1926.)

Be it enacted by the Governor, Council and Assembly as follows:

Chapter 130 of the Revised Statutes of 1923, entitled "The Power Commission Act," is amended as follows:

1. Section 9, Sub-sections (a) and (b) are repealed, 8.9) and and the following substituted therefor:

9 (a) Total amount of receipts and expenditures in respect to each of the undertakings conducted by it, for the year ending the 30th day of September last preceding;

(b) repealed; substituted.

S. 38 amended.

8. 42, 88. (2) repealed; substituted.

Net profit to reduce cost of supply.

9 (b) The actual condition as to the amount and character of the assets and liabilities of each of the undertakings conducted by it as on the 30th day of September last preceding.

2. Section 37, Sub-section (b) is repealed, and the following substituted therefor:

37 (b) For the purpose of providing and maintaining a sinking fund an annual amount which shall within such period of time as the Commission may determine be sufficient to provide for and return to the Commission a sum equal to the amount of capital provided for and invested by the Commission in such undertaking under and by virtue of such contract.

3. Section 38 is amended by deleting after the word "may" in the first line, the following words in the first, second and third lines: "From time to time during the first three years after any Municipality shall first begin to take power from the Commission, and the following is substituted therefor: "At its discretion at any time".

4. Section 42, Sub-section (2) is repealed, and the following substituted therefor:

42 (2) Any net profit made by the Commission in supplying electrical power and energy under the next preceding Sub-section, after making provision for the cost of supplying such electrical power and energy in the manner same as provided in Section 37 for adjusting and fixing such cost, and after retaining and setting apart such sums as may in the opinion of the Commission, be sufficient for the purposes mentioned in Section 11 in respect to any contract or contracts as in the next preceding Sub-section provided, may, at the discretion of the Commission, be applied to reduce the cost of supplying electrical power and energy to any or all of the undertakings of the Commission as in this Chapter provided, or otherwise.
