CHAPTER 21.

AN ACT for the benefit of the sheriff of Simpson county, and his sureties. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for W. G. Wade, sheriff of Simpson county, and his sureties, to replevy the several judgments in favor of this Commonwealth, obtained against them in the Franklin circuit court, for the balance of the public revenue due by said sheriff for the year 1860, and the damages thereon, for the period of six months from the time this act takes effect: Provided, The said sheriff and his sureties shall enter into replevin bonds, with good personal security, to be approved by the officer taking said bonds, undertaking that they will faithfully pay off said bonds when the same shall fall due.

§2. If the replevin bonds provided for in the first section of this act shall not be paid at maturity, it shall and may be lawful for execution to issue thereon, and which shall have the same force and effect as if issued upon replevin bonds executed under the laws now in force.

3. The said sheriff and his sureties shall be, and they are hereby, released from the payment of the judgment for damages in the Franklin circuit court, for failing to pay the revenue due by him for the year 1860, only upon the condition that they will, at the maturity of the replevin bond for the balance of the revenue unpaid, pay the same into the public treasury.

§ 4. Further time until the first day of March next is hereby allowed the said sheriff to return his delinquent list in the collection of the revenue for 1860; and for the amount of which, together with his commissions, the Auditor of Public Accounts shall allow him a credit upon the judgment for the revenue aforesaid, if the same has not already been entered to his credit.

§ 5. This act shall take effect from and after its passage.

CHAPTER 22.

AN ACT for the benefit of R. T. Vories, sheriff of Carroll county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That R. T. Vories, sheriff of Carroll county, be, and he is hereby, allowed until the first day of April, 1862, to report his list of delinquents in the collection of the revenue for the year 1861, and until that time to pay in said revenue; and also be allowed the same time to report his delinquents in the collection of the county levy for the same year, and to settle with the county court and pay over said county levy.

§2. This act to take effect from and after its passage. Approved September 18, 161.

CHAPTER 23.

AN ACT to amend the act incorporating the town of Shelbyville.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for the trustees of May appoint the town of Shelbyville, annually, to appoint some other tax collector. person than the marshal of said town to collect the taxes and revenue of said town; and such person, before he shall proceed to discharge the duties of collector, shall enter into bond, with sufficient security, to be approved by the trustees, conditioned for a faithful performance of his duties as such; and he shall have power, within the county of for perform'nee Shelby, to collect the taxes of said town, in the same manner that sheriffs have to collect the county levy and State

revenue.

§ 2. This act shall take effect from its passage.

CHAPTER 25.

AN ACT to change the time of holding the police court of the town of Hart

ford.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the time of holding the police court of the town of Hartford, for the trial of civil causes, be changed to the second Mondays of January, April, July, and October, instead of the months now authorized by law.

§ 2. This act to take effect from its passage.

CHAPTER 26.

AN ACT to authorize J. H. Gatewood to change the Lexington and Nashvill road.

Be it enacted by the General Assembly of the Commonwealth o Kentucky:

That J. H. Gatewood, of Barren county, be, and he is hereby, authorized to change the old Lexington and Nashviile State road near his house: Provided, The said change shall not operate to the inconvenience of the traveling community.

CHAPTER 27.

AN ACT for the benefit of the Maysville and Blue Run turnpike road company, in Mason county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Maysville and Blue Run turnpike road company, in the county of Mason, be, and they are hereby, authorized to erect a toll-gate upon so much of their road as may have been completed, and collect tolls there at: Provided, however, That no greater rate of toll shall be charged at said gate than is now allowed by law for the distance traveled.

§ 2. This act shall take effect from and after its passage. Approved September 18, 1861.

CHAPTER 28.

AN ACT for the benefit of the sureties of John G. Pickens, deceased, late sheriff of Clinton county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sureties of of John G. Pickens, deceased, late sheriff of Clinton county, in his official bond for the collection of the public revenue for the county of Clinton, for the years 1859 and 1860, be, and they are hereby, allowed to replevy the respective judgments rendered against them in the Franklin circuit for the amount of the revenue due by the said sheriff for said county, for the years 1859 and 1860, upon their executing replevin bonds therefor, with good personal security, to be approved by the officer taking said bonds, undertaking to pay the amount of said judgments, with the interest and cost thereon, in the following manner, viz: One third of said judgments in six months, and the remainder in twelve months

from the time this act takes effect; which bonds shall in all respects have the same force and effect as replevin bonds executed under the laws now in force upon that subject.

§2. That the said sureties shall be released from the payment of the several judgments for damages against them in the Franklin circuit court for the defalcations of said sheriff, only upon condition that they will pay into the public treasury of this Commonwealth the amount of the judgments referred to in the first section of this act, at the maturity of the replevin bonds provided for by said section; and if said sums are not promptly paid at the maturity of said bonds, the judgments for damages shall remain in full force and the Auditor of Public Accounts shall proceed to collect the same by execution.

§ 3. This act shall take effect from and after its passage. Approved September 20, 1861.

CHAPTER 29.

AN ACT for the benefit of C. T. Dillingham, late constable of Adair county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for the said Dillingham to execute and return all precepts and process of every kind in his hands at the expiration of his term of office, and may have any or all executions remaining in his hands unsatisfied renewed, and may replevy or collect all executions and fee bills that remain in his hands in the same manner, and to the same extent, as other constables are now permitted and required to do by law, and be allowed the same fees and compensation therefor.

§2. That the said Dillingham shall be liable to all the penalties imposed by law for a violation of his official acts, and shall, before this act takes effect, either procure the sureties on his official bond to enter their consent in the Adair county court to the provisions of this act, and their agreement to be bound as in their original bond, or the said Dillingham shall execute a new bond, with good and approved surety, in said county court.

§3. This act to be in force from its passage, and until the first day of July, 1862.

CHAPTER 30.

AN ACT for the benefit of James Trimble, clerk of the Floyd circuit and county courts.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the further time of two years be allowed James Trimble, clerk of the Floyd circuit and county courts, to list and collect his unlisted fee bills, subject to all the laws now in force against the issuing of illegal fee bills.

§ 2. This act to take effect from and after its passage. Approved September 20, 161.

CHAPTER 31.

AN ACT to amend the charter of the town of Carlisle.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the charter of the town of Carlisle be, and the same is hereby, so amended as to authorize the trustees of said town, by ordinance, to regulate the going at large of hogs in the streets of said town, and they may wholly prohibit the same; and for any violation of such ordinance as they may establish, they may ordain a sale of all such. §2. This act to take effect from and after its passage. Approved September 20, 1861.

CHAPTER 32.

AN ACT for the benefit of Robert English, late sheriff of Hardin county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Robert English, late sheriff of Hardin county, be, and he is hereby, allowed the further time of two years to settle up all unfinished business in his hands, to collect all taxes and fee bills due him for services rendered, or placed in his hands for collection; and that he may distrain for the same, or place them in the hands of other officers for collection; but said English is to be responsible as sheriffs generally for any illegal proceedings.
