An ACT direing the Treasurer of this State, to fubfcribe to the Bank of the United States.

I.

BE

Paffed 24th March, 1791.

Eit enalled by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the fame, That it fhall be lawful for the treasurer of this flate for the time being, and he is hereby directed, as foon as conveniently may be, to fubfcribe in 、 his own name, as treasurer of this ftate, one hundred and ninety fhares, to the bank of the United States, and to pay fuch fum as may be neceflary to be paid in specie, on fuch fubfcription, out of any money which now is, or hereafter may be in the treafury, not otherwife appropriated, and to pay fuch part of the faid fubfcription, as is to be paid in ftock of the United States, bearing an interett of fix per cent. out of the flock he shall receive, by virtue of the act, entitled, An act for the relief of the creditors of this flate.

II. And be it further enacted by the authority aforejaid, That the treafurer of this flate for the time being, fhall, from time to time, vote for directors of the faid bank, and manage, do, and tranfact all matters and things in respect to the faid fhares, in the fame manner, as any other ftockholders in the faid bank may do by law; And fhall alfo, from time to time, receive all dividends on the faid fhares, for the ufe of this ftate.

An ACT concerning Roads and Inland Navigation, and for other Purposes. Paffed 24th March, 1791.

I.

BE E it enacted by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the Jame, That it fall and may be lawful, for the commiffioners of the land-office to con- the land-office, to agree, or contract, with fuch perfon or road from the welt perfons as they fhall judge proper, for exploring, laying out, branch of Delaware, and opening a road, to begin on any part of the weft branch to Paghkataghcan; of the Delaware, at or about Walton, to extend cafteriy, to Paghkataghcan, with fuch variation, and in iuch direction, as the faid commiflioners fhall judge moft eligible and conducive to the intereft of the state. II. And be it further enacted by the authority ajorefaid, And to draw from That it fhall and may be lawful for the faid commiflioners purpose of makingfaid from time to time, to draw from the treafury, by warrant from his excellency the governor, for the purpose of defraying the expences of exploring, laying out, and opening faid road, fuch fums of money as they fhall judge neceflary, not exceeding the fum of four hundred pounds; and that all fuch furplus money, as fhall remain in the hands of the commiflioners, of the monies heretofore granted, for laying out the road, beginning on the road, that leads from Kington to Peen Pack, and extending weftward, as far, and in fuch direction, as the faid commiffioners fhould judge moft conducive to the intereft of the flate, fhall be applied by them in improving the road from Paghkataghcan to Great Shandaken.

An ACT concerning the Collection and Commutation of Quit-Rents, and for other Purposes.

That all arrears of quit-rents which fhall be due and unpaid Arrears of quit-rent at any time after the first day of May next, and before the of May, 1791, how to first day of May which will be in the year one thoufand feven hundred and ninety-three, and which were heretofore receivable in certificates iffued by the treasurer or auditor of this ftate, or by the auditors appointed to liquidate and fettle the depreciation of the pay of the line of the troops of this flate, in the fervice of the United States, fhall, after the first day of May next, be receivable in any flock created under the authority of the United States. And after the time laft above mentioned, all arrears which fhall become due, fhall be only receivable in gold or filver, or bills of credit emitted in pursuance of the laws of this ftate.

II. And be it further enaded by the authority aforefaid, Commutation for That ail perfons from whom quit-rents may be due after the paffing of this act, fhall be at liberty to commute for the fame, by paying at the rate of fourteen fhillings for every fhilling which fhall annually become due, for fuch quit-rent, and every fuch payment fhall be confidered as a discharge of the quit-rent arifing from the land for which it fhall be paid, and within the times herein before limited, for mal.ing the arrears of quit-rents receivable in flock created under the authority of the United States, the faid commutation fhall be receivable in the faid flock, but after the faid time, herein before limited, the faid commutation fhall be paid in gold or filver only, or the bills of credit emitted by the laws of this flate. Provided nevertheless, That this act fhall not extend to any perion or perfons not being citizens of this fate, or of any of the United States.

III. And be it further enacted by the authority aforefaid, That the fifth fection of the act, entitled, An act to amend an act, entitled, † An act for the collection and commutation of quit-rents, paffed the 11th day of April, 1787, fhall be, and the fame is hereby repealed. IV. And be it further enacted by the authority aforefaid, Treafurer to pay a That the treasurer of the ftate fhall, and he is hereby dimyberry trees raifed rected to pay to any perfon, being a citizen of this ftate, who fhall produce to him a certificate, under the hand and feal of the judge of the court of common pleas, of the county where fuch perfon may refide, certifying, that he or fhe has growing on his or her farm fifty white mulberry trees, which trees have been planted three years, and at leaft twenty feet diftant from each other, the fum of fix fhillings; and the like fum for every fifty trees which he or fhe fhall have planted, in manner aforefaid, until the whole number amounts to two hundred.

An ACT to authorife the Treafurer to fubfcribe to the Bank of New-York. Paffed 12th January, 1792. HEREAS by the act, entitled, An act to incorporate the flockholders of the bank of New-York, it is enacted, that this ftate fhall have a right to fubfcribe any number of fhares to the faid bank, not exceeding in the whole the number of one hundred, at any time when they fhall by law authorife any perfon or perfons for that purpofe; and the flate frail have a right to increafe the number of fhares and flock, which the faid corporation may hold, to the amount of the fum to be fubfcribed, if the number of shares therein limited fhall be fubfcribed before fuch fubfcription fhall take place on the part of the ftate: And whereas the number of fhares limited to the faid corporation have been already fubfcribed, and it is conceived proper that this ftate fhould fubfcribe one hundred fhares to the faid bank; Therefore,

An ACT for altering the Times of holding the Courts in the Counties of Renf felter and Saratoga, and for an additional Term in each of the faid Counlies. Paffed 20th January, 1792. THEREAS it hath been reprefented to the legislature, that the times of

peace, in and for the counties of Renflelaer and Saratoga, are inconvenient, and that an additional term is requifite in each of the faid counties :Therefore,

Terms of common holden as follows, that is to fay: The faid courts of pleas and general fef fons, and their con- common pleas, in and for the faid county of Saratoga, fhall be held on the third Tuesday in November, the laft Tuesday in February, and third Tuesday in June, in every year, and may be continued until the feveral Saturdays next following, inclufive; and that the faid courts of general feffions of the peace, in and for the faid county of Saratoga, fhall be held on the third Tuefday of June, and last Tuesday in February, in every year, at the place where the court of common pleas thall be then holden, and may continue to be held until the end of that term of the fame court of common pleas; and the faid court of common pleas, and general feffions of the peace, to be held in and for the faid county of Saratoga, on the third Tuesday in November next, fhall, at the end of the term, be adjourned to the laft Tuesday in February then next.

CHA P. IV.

An ACT to explain an A, entitled, " An all for the more effectual Preven tion of Fires, and to regulate certain Buildings in the City of New-York. Pafled 26th January, 1792.

WHEREAS the act, entitled, " An act for the more effectual preven tion of fires, and to regulate certain buildings in the city of NewYork," was intended to take effect on the firft day of January, in the year of our Lord, one thousand seven hundred and ninety-two, but by a mistake in the faid act, the fame took effect on the twenty fourth day of March, in the year of our Lord, one thousand seven hundred and ninety one, the day of pafling the faid act: Therefore,

Be it enacted by the people of the fate of New-York, represented in fenate and affembly, and it is hereby enacted by the authority of the fame, That all fines, penalties, and forfeitures, for any offence or offences against the faid act committed, done, or fuffered, at any time before the faid first day of January,in the year of our Lord, one thousand feven hundred and ninetytwo, fhall be, and hereby are remitted; and the faid act fhall hereafter be adjudged to have taken effect on the faid first day of January, in the year of our Lord, one thousand feven hundred and ninety-two, and not before.

CHA P. V.

An ACT to remove Doubts concerning Commiffioners of Oyer and Terminar, and Gaol Delivery.

Pafled 26th January, 1792. 7HEREAS, in and by an act, entitled, "An act requiring all perfons, holding offices or places under the government of this itate, to take the oaths therein mentioned, certain officers therein menPreamble, reciting tioned are required to take the oaths therein prefcribed: thatdoubts havearifen And whereas doubts have lately arifen, whether commiffioners of oyer and terminer and gaol delivery are not obliged to take fome or one of the faid oaths, and whether their proceedings are not void, in cafe they neglect to take the fame: And whereas it is conceived, that the commiffioners, in any commiffion of oyer and terminer, not taking any or either of the oaths in the faid aft mentioned, will not invalidate their proceedings: Therefore,
