tenements and hereditaments within this ftate, and to have and to hold the fame, to him, his heirs and affigns, to the use of him, the faid Antoine Renè Charles De la Foreft, his heirs and affigns forever; as fully, and to all intents and purposes, as any natural born citizen may or can do, any law, ufage, or custom to the contrary notwithstanding.

III. And be it further enacted by the authority aforefaid, That John Maunfell, and John Foxcroft, be, and they are refpectively enabled to purchase lands, tenements and hereditaments, within this ftate, not exceeding in va lue, four thousand pounds; and to hold the fame, to them refpectively, their respective heirs and affigns forever, as fully and to all intents and purposes as any natural born citizen may or can do.

IV. And whereas John C. Rothery, an alien, hath fome time fince purchafed a real estate lying in Queen's county on Long-Ifland, from James Hicks, of the faid county; and hath prayed that he may be authorised to convey the fame, in like manner as if at the time of fuch purchase he had been a citizen of this state. Therefore,

Be it further enacted by the authority aforefaid, That all deeds and conveyances made or to be made by the faid John C. Rothery, of fuch real ef tate fo purchased of the faid James Hicks, fhall be as valid and effectual in the law, to veft fuch eftate in the purchaser or purchasers thereof, as they would have been had the faid John C. Rothery been a citizen of this ftate at the time fuch conveyance was fo made to him as aforefaid.

CHA P. XLIV.

An ACT to improve the Navigation of Hudfon's-River.

Paffed 2d April, 1790.

E it enacted by the people of the ftate of New-York, reprefented in fenate

it fhall and may be lawful for the proprietors of the iflands, commonly called Mills's-Ifland, and the ifland called Papfkni, and the proprietors of the foil on the main land adjacent to the faid iflands refpectively, or any of them, to obftruct the paffage of the water paffing between the faid iflands and the main land, by placing caufeways or other obftructions as to them fhall feem proper, or for any other perfon or perfons, by and with the confent of fuch owner or owners, to make fuch obftructions as aforefaid. Provided always, That fuch obftructions fhall be erected at the expence of fuch owner or owners of the foil, as fhall agree thereto, or at the expence of fuch perfon or perfons as fhall obtain licence from fuch owner or owners, for the purpofe of erecting fuch obstructions, and on fuch terms and conditions as the contracting parties may agree upon.

An ACT to encourage the deftroying of Wolves and Panthers.

Pafled 3d April, 1790.

1. BE it enacted by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the fame, That from and after the paffing of this act, every perfon who fhall actually take and kill a wolf or wolves, panther or panthers, in any of the counties within this state, except the counties of Clinton or Ontario, fhall have and

do

receive the following rewards; that is to fay, For every grown wolf or panther, killed in the counties of Montgomery or Washington, twenty fhillings, and for every wolf or panther, under the age of one year, killed in the faid counties of Montgomery or Washington, ten fhillings, and for every grown wolf or panther killed in any other county of this state, except the counties of Ontario or Clinton, the fum of three pounds, and forevery wolf or panther under the age of one year, thirty fhillings; the faid rewards to be paid by the county treafurers refpectively, as fhall be directed by this act. II. And be it further enacted by the authority aforefaid, That before any perfon or perfons fhall be entitled to any of the rewards allowed by this act, he or they fhall carry the head or heads of fuch wolf or wolves, panther or panthers, with the entire fkin thereon, to any juftice of the peace or any fupervifor dwelling in the county in which fuch wolf or wolves, panther or panthers (hall have been killed and taken, and the faid juftice or fupervisor fhall be and is hereby empowered, directed and required, to adininifter to every fuch perfon an oath in the words following, viz. "You fwear that the wolf or panther, the head whereof you now produce to me, was taken and killed within the county of ;" and after the taking of fuch oath, the faid juftice or fupervifor fhall, and is hereby empowered and required to give a certificate thereof to fuch perfon or perfons as have fo fworn as aforefaid; and fuch juftice or fupervifor for adminiftring fuch oath and giving a certificate thereof, fhall receive no fee or reward, and the faid juftice or fupervisor, in giving fuch certificate, shall therein mention the name or names of fuch perfon or perfons as have fo fworn, that he or they had actually taken and killed fuch wolf or wolves, panther or panthers, within the county where the fame fhall, by the oath aforefaid, appear to have been taken and killed, and to diftinguish whether the fame were full grown; and fuch juftice or fupervifor fhall cut off and deftroy the ears of every fuch wolf or panther for which fuch certificate fhall be granted; and fuch certificate being produced to the fupervifors of the faid county, the faid fupervisors fhall allow to fuch petion as fhall produce such certificate, all fuch fum or fums of money as fhall appear to be allowed to him by this act; and the faid reward fhall be a county charge, and fhall be affeffed, raised and levied together with the other neceiiary and contingent charges of the county.

III. And be it further enafied by the authority aforesaid, That the fupervifors of the respective counties in which any wolf or panther fhall be killed, fhall, and are hereby empowered, required and directed, to order the aforefaid fum or fums of money, by this act to become due, to be paid to the county treasurer; and the fame county treasurer shall pay the fame, as shall be ordered by the faid fupervifors, to fuch perfon or perfons, his or their affigns, as fhall have taken and killed fuch wolf or wolves, panther or panthers.

IV. And be it further enacted by the authority aforefaid, That every free Indian, free negro, or mulatto, or flave, who fhall have actually taken and killed any wolf or wolves, panther or panthers, within any of the counties of this ftate, except in the counties of Clinton and Ontario, and shall carry the head or heads thereof, with the entire skin thereon, to any of the juftices or fupervifors of the county wherein fuch wolf or wolves, panther or panthers, fhall be taken and killed, and bring evidence, or give fuch reafons as fhall be fatisfactory to the faid juftice or fupervifor, that fuch wolf or wolves, or panther or panthers, was or were taken and killed within the faid county, where fuch juftice or fupervifor was appointed or chofen; then and in fuch

cafe, fuch juftice or fupervisor is hereby empowered, required and directed, to give a certificate to the mafter or mistress of fuch flave, or to fuch free Indian, free negro, or mulatto, in the fame manner and form as is herein before directed to be given: And fuch master or miftrefs, or free Indian, free negro For mulatto, fhall be entitled to, and receive the fame reward or rewards, as by this act is given in fuch cafes as aforefaid.

CHA P. XLVII.

An ACT for the Lafpection of Sle Leather, in the City of Albany.
Pafled 34 April, 1790.

I. E it ended by the people of the fate of New-York, represented in fenate and affembly, and it is hereby enacted by the authority of the jame, That the mayor, aldermen and commonalty of the city of Albany, in common council convened, thall be, and hereby are authorised and directed to appoint, from time to time, and as ofien as vacancies, by death, refignation of office or otherwife, fall happen, one fit perfon, to infpect and weigh all fole leather, that shall be manufactured within the faid city of Albany, or imported or brought into the said city, from any place whatsoever, after the pafling of this act, other than fuch as fhall have been infpefted in the city of NewYork, which faid inspector fhall take and fubfcribe the following oath, before the mayor or recorder of the city of Albany, before he fhall be deemed qualified for, or proceed to the execution of the duties enjoined upon him by virtue of this act. I, do folemnly fwear, that I will well, faithfully and impartially, according to the beft of my fkill and underftanding, execute, do and perform the office and duty of an infpector and examiner of fole leather, and will not, directly or indirectly, by myself, or any perfon or perfons under me, or for my benefit or advantage, buy or fell any fole leather, during the time that I fhall continue an inspector of the fame (except for the ufe of my own family) according to the true intent and meaning of an act, entitled, An act for the infpection of fole leather in the city of Albany. So help me God.

II. And be it further enacted by the authority aforesaid, Ne fole leather to That from and after the palling of this act, no fole leather it has been infpected, whatfoever, other than fuch as fhall have been in pected in

under a penalty of 40s the city of New-York as aforefaid, fhall be fold, dipofed of or used for any purpofe or purpofes whatfoever, within the aid city of Albany, until the fame fhall be infpected, fealed and weighed by the inspector to be for that purpofe appointed by virtue of this act, under the penalty of forty fhillings for every fuch offence, to be fued for and recovered by action of debt, with cofts of fuit, in a fummary way, by any perfon or perfons who will fue and profecute for the fame, before the mayor, recorder, or any alderman of the city of Albany, to be levied by process to be directed to the fheriff or any one of the conftables of the faid city, commanding him or them or either of them to levy the fame by distress and fale of the offender's goods and chattels, one moiety whereof, when fo recovered, to be paid to the chamberlain of the city of Albany, to be applied at the difcretion of the mayor, aldermen and commonalty of the fid city, to the ufe of the poor thereof; and the other moiety to the ufe of fuch perfon or perfons who fhall profecute for the fame.

IH. And be it further enacted by the authority aforesaid, That there shall be paid to the inspector, for inspecting, fealing and weighing of every fide of Vol. II.

IV. And be it further enadled by the authority aforesaid, Infoector to provide That the inspector fhall, and is hereby required to provide marking fole leather, himself with proper feals for the purpose aforefaid, and to imprefs on every fide of fole leather, which fhall be deemed dry, good and merchantable, his own name and the word Albany, at full length, and alfo the weight thereof; and if any perfon or perfons fhall prefume to counterfeit fuch mark or marks to be made by fuch inspector, by making any impreffion or mark on any fole leather, he or they fo offending, fhall forfeit and pay for every fuch offence, the fum of ten pounds, to be fued for, recovered and applied in manner aforefaid. Provided neverthelefs, That all fole leather, which upon infpection as aforefaid, fhall be found not to be dry, good and merchantable, and which as fuch shall not be branded in manner herein before directed, may be used for any other purposes except being worked into fhoes, boots or buckets. And provided further, That all fuch fole leather, which shall not, on fuch inspection as aforefaid, be deemed good and merchantable by the inspector, fhall be by him marked with the word bad, and may then be used for any other purpofe, except being worked into fhoes, boots or buckets; and every fuch infpectoris hereby required and directed to keep proper instruments for the purpofe of marking fuch unmerchantable leather accordingly; and if any perfon or perfons fhall prefume to work up into fhoes, boots or buckets, any fole leather, before the fame fhall be infpected as aforefaid, or any fole leather, which fhall be marked with the word bad as aforefaid, he or they fo offending fhall forfeit and pay for every fuch offence the fum of ten pounds, to be fued for, recovered and applied in the manner before directed.

CHA P. XLVIII.

An ACT for al ering certain Claufes in the Charter of the Corporation for the Relief of the Widows and Children of Clergymen of the Proteftant Epif copal Church, in the United States of America.

Paffed 5th April, 1790.

WHEREAS it hath been reprefented to the legislature, by the cor

poration for the relief of the widows and children of clergymen of the proteftant epifcopal church in the United States of America, that the good and charitable purpofes for which the faid corporation was inftituted, are in danger of being defeated by reafon of the increafe of its members, and the largenefs of the quorum, being a major part of the whole body authorised to tranfact the bufinefs and affairs of the faid corporation: Therefore,

I. Be it enacted by the people of the state of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the fame, That it fhall and may be lawful for a majority of any twenty or 20 or more members more members of the faid corporation, met at any annual of the corporation, or other meeting duly affembled, to propose any new byeLaws, or the alteration law or regulation, or the repeal, alteration or amendment of any bye-law or regulation now exifting, for the better ordering the affairs of the faid corporation, and to caufe the fame to be publifhed in one or more of the public news-papers in each of the ftates of NewYork, New-Jersey and Pennsylvania; and if at the next meeting of the faid corporation thereafter, to be held at any time not less than fix months after

fuch publication, thirty or more members fhall be duly affembled, and three fifths of the members fo affembled fhall approve and ratify fuch propofed bye-law or regulation, or fuch propofed repeal, alteration or amendment of a former bye-law or regulation, the fame fhall be, and is hereby declared to be as valid and effectual, to all intents and purposes, for carrying on the charitable defigns of the faid corporation, as if the majority of all the members had been met; any thing in the faid charter to the contrary notwithstanding. II. And be it further enacted by the authority aforefaid, That the not meeting of a fufficient number of the faid corporation heretofore at any of the flated days or times of meeting, for that purpose directed by the faid charter, fhall not be, nor fhall be confidered, taken, held or adjudged to be a forfeiture of the faid charter, or a diffolution of the faid corporation; nor fhall the rights and powers of the said corporation be in any wife leffened or impeached thereby; but their faid charter, and every part thereof, not altered by this act, or an act of the legislature of this state, † 1oth feff. ch.34. entitled, † An act to amend the charter of the corporation for the relief of the widows and children of clergymen in the communion of the church of England in America, paffed the 19th of February, 1787, fhall be good and available in all things in the law, according to the true intent and meaning thereof; and fhall be conftrued, reputed and adjudged in all cafes moft favorably on behalf and for the best benefit and behoof of the faid corporation and their fucceffors, fo as moft effectually to answer the good purposes of their inftitution and incorporation.

CHA P. XLIX.

An ACT to appoint Trustees to take and hold certain Lands therein mentioned, and for other Purposes. Paffed 5th April, 1790.

WHEREAS in that part of the town of Renfelaerwyck, in the coun".

ty of Albany, herein after defcribed, a confiderable number of houfes are already erected, and occupied by merchants, mechanics and others, to the advancement of commerce and manufactures in this ftate; and in order to enable them to regulate their internal police, and to fecure the benefits of certain commonable lands lying within the fame, have prayed, that they might be enabled to appoint truflees; Therefore,

I. Be it enacted by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the fame, That John Van Renflelaer, Chriftopher Tillman, Elijah Janes, John Van Renfelaer Aaron Ward, Stephen Goreham, Ezra Hickock and Levifirft trustees of Lan- nus Lanfing, fhall be, and they are hereby declared to be Gngburgh. the first truflees for the freeholders and inhabitants of that part of the town of Renffelaerwyck, commonly called Lanfingburgh, and fhall continue to be trustees until the third Tuefday in May next; and that it fhall and may be lawful to and for the faid freeholders and inhabitants, qualified by law to vote at town meetings, to affemble on the third Tuesday of May next, and annually, on the third Tuesday of May in every year thereafter, at fuch place and at fuch time of the day as the truflees for the time being, or the major part of them, fhall, by public advertisement, appoint, and, under the direction of the faid truftees, or fuch of them as fhall be prefent, who are hereby made inspectors of fuch election, then and there, by a majority of voices, to elect feven difcreet inhabitants, being freeholders, to
