XXIV. XXV. And be it further enaded by the authority aforefaid, Common council of That it fhall and may be lawful, to and for the mayor, and Hudfon, yearly to aldermen and commonalty of the cities of Albany and fhall be raifed to fup. XXVI. And be it further enacted by the authority aforefaid Duty of the overfeers That when, and as often as any poor perfon belonging to applies for relief. any city or town within this ftate, fhall apply for relief, to any overfeer or overfeers of the poor of fuch city or town, the faid over feer or overfeers of the poor fhall make application to a juftice of the peace of fuch city, or of the county in which fuch town fhall lie; which faid juftice and overfeer or overfeers of the poor, fhall enquire into the ftate and circum. flances of the perfon fo applying as aforefaid; and if it fhall appear to the faid juftice and overfeer or overfeers of the poor, that fuch person is in fuch indigent circumftances as to require relief, then the faid justice shall give an order in writing, to the faid overfeer or overfeers of the poor, to make fuch allowance weekly or otherwife, to every fuch poor perfon, as they in their difcretion fhall think his or her neceffities fhall or may require: And the faid overfeer or overfeers of the poor, fhall make no other or further allowance to fuch poor perfon than what by the faid order fhall be directed; which faid order fhall be a fufficient voucher for the payment of fo much money by the faid overfeer or overfeers of the poor, and shall be allowed in adjusting his or their accounts.

tered in a book, with town within this ftate, fhall procure at the public charge, a zance, the allowance book of good paper and well bound, wherein the names ordered and the of all poor perfons applying for relief and being ordered to be relieved as aforefaid, thall be registered, with the day and year when they were firit adimitted to have relief, the weekly or other fum or fums of money allowed by the order for their relief, and the cause of fuch neceffity; and that no perfon fhail be entered into the poorbooks, or receive relief from the overfeers of the poor, or any of them, with out fuch order procured as aforefaid: And in cafe any overfeer or overfeers Overfeers toenter in of the poor fhall enter into the poor-books, and relieve any the poor books all fuch poor perfon or perfons, without fuch order, he or they aid out for the use of fhall forfeit and lofe all fuch money and goods paid and the poor, and all inat diftributed to fuch poor perfon or perfons; nor fhall any allowance be made to him or them for the fame, in paffing his or their account or accounts; and the faid overfeers of the poor, are hereby directed and required to enter, or to caufe to be entered in the faid poor-books, all monies received, laid out and difburfed by them refpectively for the use of the poor, and also all matters and things which fhall be tranf acted by them relating to their faid office. And the overfeers of the poor for the cities of Albany and Hudfon, refpectively, fhall yearly, once in every year, lay fuch books of accounts before the common council of the faid cities refpectively, at fuch times as the faid refpective common councils shall direct. And the overfeers of the poor of every town, fhall yearly and every year, on the laft Tuesday in March, lay their faid books of accounts before the town clerk and supervisor of fuch town, and fuch juftice or juftices of the peace as may refide in fuch town, or the major part of them, for their examination, who fhall examine and audit the fame, and make report thereof to the freeholders and inhabitants of their respective towns, at their next annual town-meeting, that fuch further provifion for the maintenance and fupport of the poor may be made, as may be found neceffary. XXVIII. of the cities of Albany and Hudson, by and with the poor modation of the poor, confent of the common council of the fame cities respec tively, and for the overfeers of the poor of any town within this state, and any two or more juftices of the peace of the county in which fuch town fhall lie, with the confent and approbation of the major part of the freeholders and inhabitants of fuch town, to be fignified at fuch annual town-meeting as aforefaid, and at the proper charge of fuch city or town, to be ascertained, affeffed and levied as aforefaid, to build, purchase or hire, fome fit and convenient dwelling houfe or houses in fuch city or town, for the lodging and accommodation of the poor thereof; and also to purchase neceffary materials for fetting fuch poor perfons to work, and there to keep, maintain and employ all and every fuch poor perfon, and to take the benefit of the work, labour and fervices of any fuch poor perfon who shall be kept and maintained in any fuch houfe, for the better maintenance and relief of fuch poor perfons, who fhall be there kept and maintained, and thereof to appoint fuch perfon or perfons as keeper or keepers, from time to time, as they fhall think proper; and in cafe any poor perfon, claiming relief of any city or town within this ftate, where fuch houfe or houses fhall be fo built, purchafed or hired, fhall refufe to be lodged, kept to work and maintained, in fuch houfe or houses, fuch poor perfon or perfons fo refufing, fhall be put out of the book in which the names of the poor are by this act directed to be registered, and shall not be entitled to ask or receive any relief from the overfeers of the poor of any fuch city or town. And further, That where any town may be too finall to build, purchase or hire fuch house or houfes as aforefaid, it shall be lawful for the overseers of the poor and justices of the peace, with the confent and approbation of the major part of the freeholders and inhabitants of two or more towns within any county in this ftate, to be fignified at fuch annual town-meetings as aforefaid, to join together and unite in building, purchafing or hiring fuch houfe or houses, for the lodging, keeping and maintaining of the poor of fuch towns, fo joining together, and uniting; and alfo to purchase neceflary materials for fetting fuch poor perfons to work, and there to keep, maintain and employ all and every fuch poor perfon, and to take the benefit of the work, labour and fervices of any fuch poor perfon, who shall be kept and maintained in any fuch house for the better maintenance and relief of the poor there to be kept, maintained and employed; and thereof to appoint fuch perfon or perfons as keeper or keepers from time to time, as they fhall think proper; and in cafe any poor perfon or perfons claiming relief of any fuch united towns as aforefaid, fhall refufe to be lodged, kept to work, and maintained in the house or houfes fo to be built, purchased or hired for fuch united towns as aforefaid, fuch poor perfon or perfons fo refufing shall be put out of the book in which the names of the poor are, by this act, directed to be registered as aforefaid, and fhall not be entitled to afk or receive any relief from the overfeers of the poor of any fuch town. And further, That it fhall and may be lawful for the overfeers of the poor and juftices of any town within this ftate, with the confent and approbation of the major part of the freeholders and inhabitants of fuch town where fuch houfe or houses, fhall be built, purchased or hired for the purposes aforefaid, to be fignified at fuch annual town-meeting as aforefaid, to contract with the overfeers of the poor and juftices of any other town, for the lodging, maintaining and employing of any poor perfon or perfons belonging to fuch other town, as to them thall feem meet. And in cafe any fuch poor perfon or perfons belong

XXX. And be it further enacted by the authority aforesaid, Overfers yearly to That the overfeers of the poor of each refpective city and count of monies re- town in this ftate, fhall, annually, within fifteen days after ceived and expended the termination of their respective offices, exhibit to the who, with the fuper fucceeding overfeers of the poor of fuch city or town, a vifor and juftices, shall xamine and audit paricular, full, juft and true account, of all the monies by fuch accounts. them refpectively received and expended for the ufe of the poor, and from whom, to whom, and in what manner, and for what use or ufes, together with an account of the earnings of the poor perfons by them employed; which accounts the faid overfeers of the poor for the time being, together with the fupervifor or fupervisors of fuch city or town, and juftices of the peace refiding in fuch city or town, or the major part of them, fhall, as foon as conveniently may be, examine and audit; and the faid overfeers of the poor fo going out of office, fhall respectively, on auditing fuch account, pay all fuch balance and fums of money as thall appear to be in his or their hands, or due from him or them to fuch city or town, to their fuccellors in office, to be applied and accounted for by them in the courfe of the next year, in the like manner as is herein before prescribed; and fuch overfeers of the poor fo going out of office, hall, at the fame time of exhibiting their accounts, deliver up to their fucceffors in office, all books of accounts, regitters, and other papers relating to the poor as aforefaid; and if any overfeer or overfeers of the poor fhall refufe or neglect to exhibit fuch account or accounts as aforefaid, and to pay to his or their fucceflors in office, fuch monies as fhall remain in his or their hands as aforefiid, or to deliver up all fuch books of accounts, regifters, and other papers relating to the poor as aforefaid; every fuch overfeer of the poor, fo neglecting or refufing, fhall, for every fuch neglect or refufal, forfeit and pay the fum of one hun dred pounds, over and above the faid balance remaining in his or their hands, to be recovered with cofts of fuit in any court of record within this ftate, by the overfeers of the poor of fuch city or town for the time being, and when recovered to be applied to the ufe of the poor of fuch city or town; and if upon auditing fuch account there fhall appear to be a balance due to fuch overfeers of the poor, fo going out of office as aforefaid, or to either of them, the fame fhall be paid to him or them by their fucceffors in office, out of the first monies which fhall come into their hands as overfeers of the poor of fuch city or town.

XXXI. Cover against their predeceflors in office, and each of them, their executors or adminiftrators, all fuch fums of money as fhall appear, upon fuch audit as aforefaid, to be due from them refpectively, to fuch refpective city or town, in an action for monies had and received to the use of fuch city or town, with cofts of fuit, in any court having cognizance thereof; or to have and maintain an action or actions of account against any former overfeer or overfeers of the poor of fuch city or town, Vol. II

his or their executors or administrators: And no fuch action fhall be abated or difcontinued by the death or expiration of the office of any fuch plaintiff or plaintiffs, but fhall and may be continued and profecuted to effect, by the furvivor or furvivors of them, and their fucceffors in office; and fuch fuit fhall always be brought and profecuted by, and in the name of the overfeers of the poor of fuch city or town for the time being.

XXXII. And further, That if any perfon, fo neglected to be reported to the mayor or recorder of the faid city as aforefaid, fhall be a foreigner, the mafter of fuch fhip, or other veffel, fo neglecting to make report as aforefaid, fhall forfeit the fum of thirty pounds for every foreigner fo neglected to be reported. And further, That if any householder fhall entertain in his or her houfe or family, any fuch foreigner, and not report the fame to the mayor, or in cafe of his abfence or ficknefs, to the recorder of the faid city for the time being, within twenty-four hours after he or she fhall receive fuch foreigner into his or her house or family, he or she fhall forfeit the fum of five pounds; which faid refpective forfeitures, fhall and may be recovered by action of debt, with cofts of fuit, in any court within this fate, having cognizance thereof, by any person or perfons who fhall fue and profecute for the fame to effect; the one half of which forfeitures, when recovered, to be paid to the treasurer or chamberlain of the faid city, for the ufe of the poor thereof, and the other half to the perfon or perfons who fhall fue and profecute for the fame to effect as aforefaid.

XXXIII.
