and in all cafes of fales of wheat in the faid city, by the bufhel, if the fame fhall exceed the flandard weight, the buyer, fhall pay a proportionably greater price; and if the fame fhall be less than the faid ftandard, the buyer shall pay a proportionably lefs price. Provided, That this regulation fhall not extend to any special contracts refpecting the fales of wheat, whatever may be the weight thereof. VII. And be it further enacted by the authority aforefaid, All kinds of hard That every baker of any of the kinds of hard bread, com with the baker's name monly called fhip, middling, water, butter or milk biscuit, And the casks con- intended for fale, fhall caufe the initial letter of his christian, be alf) marked, with his furname at full length, to be impreffed on each bifcuit fo baked; and that upon the head of every cafk or keg in which any fuch bifcuit are packed for exportation, fhall be marked with a marking-iron, the tare of fuch catk or keg; and that the initial letter of the baker's chriftian name, with his furname at full length, fhall be branded thereon, with words expreffing the kind of bread or bifcuit contained in the fame, and the name of the city or county where fuch bread or bifcuit was baked; and fuch bifcuit as is commonly fold in fmall kegs, fhall contain either feven or fourteen pounds of the faid bread. And if any perfon or perfons fhall fell or fhip for exportation, any kind of hard bread, not marked and branded as herein before directed, he, fhe or they, fhall forfeit for each hundred weight fo fhipped or fold, the fun of five fhillings; and fo in proportion for a greater or lefs quantity.

IX. And be it further enacted by the authority aforesaid, Allowance to mea. That the feveral meaturers appointed, or to be appointed furers for meafuring fax-feed, wheat, rye, within this ftate, fhall be entitled to receive and take for falt, &c. measuring flax-feed, falt, wheat, rye, corn, buckwheat, or any other article commonly fold by the bufhel, one half penny, per bushel, and no more; and for all coal measured, at and after the rate of two fhillings for every chaldron, and no more; the one half to be paid by the buyer, and the other half by the feller; unless a particular contract is made to the contrary.

X. And be it further exacled by the authority aforefaid, That this act shall be in force from and after the firil day of July next; and that all forfeitures mentioned in the fame, fhall and may be recovered in any court having cognizance thereof, with cofts of fuit, by any perfon or perfons who fhall fue for them refpectively, by action of debt, bill, plaint or information; the one half thereof to be for his, her or their own ufe, and the other half for the use of the people of this flate.

CHA P. LXI.

An ACT making fuch Alterations in the Al for incorporating Religious
Societies, as to render the fame more convenient to the Reformed Proteflant
Dutch Congregations.
Pafled 7th March, 1788.

by the appellation of the Reformed Proteftant Dutch Churches, or congregations, the minifter or minifters, and elders and deacons for the time being, have the management of the temporalities of the refpective congregations; and the faid congregations cannot therefore avail themselves of the

7th feff. ch. 18. benefit intended by the act, entitled, ‡ An act to enable all the religious denominations in this ftate, to appoint trustees, who shall be a body corporate, for the purpose of taking care of the temporalities of their respective congregations, and for other purpofes therein mentioned; pafied the 6th day of April, 1784; without departing from fuch ufage which hath long been established, and hath always been approved of by the members of the faid congregations. And whereas feveral of the faid congregations have, by their petitions to the legiflature, prayed that they might be accommodated in this refpect, and that the requifite alterations might be made in the faid act; Therefore,

I. Be it enacled by the people of the state of New-York, reprefented in fenate and assembly, and it is hereby enacted by the authority of the fame, That the elders and deacons for the time being, and if there fhall be a minifter or minifters, then the minifter or minifters, and elders and deacons for the time being (during the time there fhall fo be a minifter or minifters) of every reformed protestant Dutch church or congregation, eftablished or formed, or hereafter to be established or formed in this ftate, fhall be trustees for their respective churches or congregations, and be refpectively bodies corporate, to the fame intents and purposes, and with the like powers and authorities, and capacities, and fubject to the fame duties as are in and by the faid act declared and enacted, with refpect to truftees elected agreeable to the mode therein prefcribed. That the faid truflees fo to be refpective bodies corporate in virtue of this act, fhall be refpectively elected agreeable to the rules and ufages of the reformed proteftant Dutch churches within this flate. That it fhall be lawful for the elders and deacons, and where there fhall be a minister or ministers, then for the minifter or minifters, and elders and deacons, of every reformed proteftant Dutch church or congregation already formed or established, or hereafter to be formed or established within this . ftate, to affemble together as foon as they fhall respectively deem it convenient; and to execute under their hands and feals, a certificate, certifying the name, ftyle or title, by which they the faid trustees of fuch church or congregation, and their fucceffors forever, fhall, as a body corporate by virtue of this act, be called, distinguished or known: And which certificate fhall be proved or acknowledged and recorded, in like manner as is directed in and by the faid act. And further, That it fhall be lawful for the trustees of any fuch church or congregation elected in virtue of the faid act, by writing under their hands and feals (to be proved or acknowledged, and recorded as aforefaid) to declare their will not to continue longer a body corporate; and from and immediately after the recording of fuch writing, fuch body corporate fhall ceafe; and all the eftate, real or perfonal, held by them, fhall pass to and be vefted in the trustees of fuch church or congregation made a body corporate by virtue of this act.

An ACT for the better Settlement and Relief of the Poor.

Paffed 7th March, 1788.

WHEREAS the laws of this flate for the fettlement and relief of the

poor, and for the removal of diforderly perfons, have by experience,

been found infufficient: For remedy whereof,

1. Be it enacted by the people of the ftate of New-York, reprefented in female and affembly, and it is hereby enacted by the authority of the fame, That every city and town shall fupport and maintain their own poor.

II. And be it further enucled by the authority aforesaid, By what means any That every perfon who fhall have come to inhabit in any legal fettlement in city or town within this ftate, and fhall actually and bona fide have rented and occupied a tenement of the yearly value of twelve pounds or upwards, for two years, and actually paid fuch rent; and every perfon who fhall have come to inhabit in any city or town, within this flate, and shall for himself, or on his own account, have executed any public annual office or charge in fuch city or town, during one whole year; or who fhall have been charged with and paid his or her share towards the public taxes of fuch city or town, for the space of two years; and every perfon who fhall have been bound an apprentice or fervant by indenture, or by any deed, contract or writing not indented, and fhall, in confequence of fuch binding, have ferved a term not less than two years, in fuch city or town, fhall be deemed and adjudged to have obtained a legal settlement in fuch city or town; and that all mariners coming into this flate, and having no fettlement in this flate, or in any other of the United States of America; and every other healthy able-bodied perfon, coming directly from fome foreign port or place, into this ftate, fhall be deemed and adjudged to be legally fettled in the city or town in which he or she shall have first refided for the space of one year.

III. And be it further enalled by the authority aforefaid, That every bastard child, fhall be deemed and adjudged to be fettled in the city or town of the laft legal fettlement of his or her mother.

IV. And be it further enacted by the authority aforefaid, Parclife of any ef. That no perfon or perfons fhall be deemed, adjudged or deration than gol. not taken to acquire or gain a fettlement in any city or town to gain a fettlement. Within this ftate, for or by virtue of any purchase of any eftate or intereft in fuch city or town, whereof the confideration for fuch purchase shall not amount to the fum of thirty pounds, bona fide paid, for any longer or further time than fuch perfon or perfons fhall inhabit in fuch eftate; and fhall then be liable to be removed to the city or town where fuch perfon or perfons were laft legally fettled before the faid purchase and inhabitancy therein.

V. And be it further enailed by the authority aforefaid, Any ftranger coming That if any perfon or perfons, other than thofe herein begive notice thereof to fore mentioned, coming into any city or town within this the poor, within forty ftate, fhall, within forty days after his, her or their coming into fuch city or town, deliver a notice in writing, to any two overfeers of the poor of fuch city or town into which he, fhe or they shall fo come to refide, of the house or place of his, her or their abode, and the number and names of his, her or their family (if he, fhe or they fhall have any) which notice, fuch overfeers of the poor are hereby required to regifter, or to caufe to be registered within forty-eight hours after the receipt thereof, in the book kept in fuch city or town for the accounts of the poor; and in cafe the overfeers of the poor of fuch city or town, fhall not, within twelve months after fuch notice, caufe fuch perfon or perfons to be removed out of fuch city or town, in the manner herein after mentioned; that then, and in fuch cafe, the perfon or perfons fo giving notice as aforefaid, fhall be deemed and adjudged to be legally fettled in fuch city or town, to all intents and purpoles whatfoever.

VI. And be it further enacted by the authority aforefaid, That if any overfeer or overfeers of the poor, fhall refufe or neglect to regifter, or to caufe to be registered, fuch notice in writing as aforefaid, in fuch time and manner as aforefaid, he or they fhall, for every fuch refufal or neglect, forfeit the fum of forty fhillings, to the ufe of the party aggrieved; to be recovered with cofts of fuit, in any court having cognizance thereof.

Overfeers, when they

VII. And be it further enacted by the authority aforefaid, That if any overfeer or overfeers of the poor of any city fafpect any firanger will become a charge or town, fhall have reason to believe that any firanger who to their town, to ap fhall have come to refide in fuch city or town, and who ply to two justices of the peace. fhall not have obtained a legal fettlement in fuch city or town, according to the true intent and meaning of this act, is likely to become chargeable to fuch city or town; fuch overfeer or overfeers of the poor, fhall and may apply to any two juftices of the peace of fuch city, or of the county in which fuch town fhall lie, and inform them thereof; and the faid juftices being fo or otherwife in formed, or feeing fuch franger and fufpecting him or her to be of infufficient abilities, or likely to become a charge to fuch city or town, are hereby authorized and required to iffue their warrant to a conftable of fuch city or town, thereby commanding him to bring fuch ftranger before them the faid juftices, at fuch time and place as they, in their faid warrant fhall for that purpose appoint; and they the faid juftices fhall examine every firanger fo brought before them, and any other perfon or perfons, whom they may think neceffary, upon oath, relat ing to the abilities and laft place of legal fettlement of such stranger; and if upon fuch examination the faid juflices fhall find fuch ftranger likely to become a charge to fuch city or town, they fhall order and direct fuch ftranger, by a certain day by them to be prefixed, to remove to the place of his, her or their former fettlement; and on neglect or refufal to comply with the faid order, the faid juftices fhall iffue a warrant under their hands and feals, directed to any constable of fuch city or town (who is hereby required and commanded to execute fuch warrant) thereby commanding him to convey or transport fuch ftranger to the conftable of the next city or town, through which fuch ftranger fhall have been fuffered to wander and ftroll unapprehended; and fo from conftable to conftable, or in fuch other manner, by the nearest and most convenient rout, as the faid juftices fhall think fit to direct, to the place of legal fettlement of fuch ftranger, if the fame fhall be within this ftate. And further, If fuch ftranger hath no place of legal settlement within this state, or if the faid juftices fhall not be able to discover where the last place of legal fettlement of fuch ftranger was, then the faid juftices fhall, in their faid warrant, direct that he or the be conveyed and tranfported to the city or town from whence he or she lait came; and the conftable fo conveying fuch ftranger fhall deliver him or her, together with his warrant aforefaid, to or at the house of fome conflable of fuch city or town; which conftable is hereby required to receive fuch flranger, and convey him or her to the next conflable; and fo from conftable to constable, or otherwife, as fuch justices fhall direct as aforefaid, until fuch ftranger fhall be transported into fome city or town within this ftate, where he or she fhall have come from or be legally fettled in, or out of this flate into the ftate from whence he or she came into this ftate, as the cafe may require.

VIII. And be it further enacted by the authority aforefaid, Any houfeholder en- That if any houfeholder or inhabitant of this ftate, fhail tertaining a stranger for fifteen days, with- take into, receive or entertain, in his, her or their dwelling

out giving notice, to house, out-house or family, for the space of fifteen days, any person who hath not gained a fettlement in fome city or town within this ftate, and shall not, within the time aforefaid, give notice in writing to one of the overfeers of the poor of such city or town, of the name, quality, condition and circumftances of the person fo entertained, according to the best knowledge of fuch householder or inhabitant; every fuch householder or inhabitant, fo entertaining as aforefaid, fhall, for every fuch offence, forfeit the fum of forty fhillings; to be recovered with coils of fuit, before any court having cognizance thereof, by any perfon or perfons who fhall fue and profecute for the fame to effect; one half of which forfeiture, when recovered, to be paid to the overfeers of the poor of fuch city or town; and the other half to the perfon or perfons who fhall fue for the fame as aforefaid. And further, If the perfon fo entertained as aforesaid, fhall have remained in any city or town longer than the term of forty days, then, and in fuch cafe, it shall and may be lawful for any two juftices of the peace of fuch city, or of the county in which fuch town fhall lie, to caufe fuch and fo many of the householders or inhabitants of fuch city or town, who fhall have fo entertained fuch stranger during the term of fifteen days, without giving information thereof as aforefaid, to be brought before them the faid juftices; and fuch householders or inhabitants fhall enter into bond to the overfeers of the poor of fuch city or town for the time being, and their fucceflors, in the fum of one hundred pounds; conditioned, That fuch stranger shall not become a charge to fuch city or town. And in case any of the faid perfons, who fhall have entertained fuch ftranger as aforefaid, being in the opinion of fuch juftices of the peace, of fufficient ability, fhall refule to become bound as aforefaid, it fhall and may be lawful for the faid justices of the peace, by warrant under their hands and feals, directed to any conftable of fuch city or town, to caufe fuch perfon or perfons fo refufing, to be committed to the common gaol of fuch city, or of the county in which fuch town fhall lie; there to remain until he, fhe or they refpectively fhall confent and become bound as aforefaid; and fuch bond fhall not be avoided by plea of durefs. But if the perfon or perfons fo entertaining fuch ftrangers, fhall not, in the opinion of the faid juftices of the peace, be of fufficient abilities to become bound as aforefaid; or if the faid juftices fhall not think fit to take fuch bond as aforefaid, then they fhall caufe fuch franger to be conveyed from conflable to constable, in manner aforefaid, until he or fhe fhall be tranfported to the place of his or her laft fettlement, if within this ftate, or into any other of the United States, if from thence he or she

came.

IX. And be it further enacted by the authority aforefaid, That every conftable transporting any ftranger or ftrangers, fhall receive fo much money for his or their fervices, as the fupervifors of the city or county fhall judge he reasonably deserved to have. And further, That the charges of every transportation shall be borne by the respective city or county, and be raised, levied, collected and paid in the fame manner as other monies for the contingent charges of fuch city or county are raised, levied, collected and paid in fuch refpective city or county.

X. And be it further enacted by the authority aforefaid, That if any perfon fo removed or tranfported as aforefaid, fhall return into this ftate, or from the place of his or her legal fettlement, to the city or town from whence he or he was fo removed or tranfported as aforefaid, fo as to be likely to become a burthen to fuch city or town aforefaid, fuch perfon fo returning,
