January 2, 1924. MISS DOROTHY WALKER, District Attorney, Portage, Wisconsin. Columbia county is under the county system for the care of the poor. You ask for an opinion as to whether the county or the local municipality in the county in which an indigent person has his legal settlement is liable for the cost of antitoxin furnished such indigent person by the local board of health. I think the cost is to be borne by the county, and not by such local municipality. Sec. 143.03, subsec. (2), Stats., provides, in part: "Local boards of health ** ** under direction of the state board, shall furnish antitoxin free to indigent persons suffering from communicable disease." This subsection does not provide for the cost of antitoxin so furnished, and neither the local board of health nor the state |
