STATE TAX.

Resolved, That a tax of one and a half cents on the dollar, be levied upon the grand list of 1848, as returned to the Comptroller's Office, March, 1849, to be collected according to law, and paid into the State Treasury, on or before the 20th day of February next.

AUTHORIZING THE TREASURER TO BORROW MONEY.

Resolved by this Assembly, That the Treasurer of this State be, and he is hereby authorized and empowered to borrow a sum not exceeding twenty-five thousand dollars, to meet such deficiency in the treasury as may occur, and so as to enable him to meet the demands upon the treasury during the current fiscal year.

AUTHORIZING THE PURCHASE OF A SWORD TO BE PRESENTED TO COL. THOMAS H. SEYMOUR.

Resolved, That three hundred dollars be, and the same is hereby appropriated, for the purpose of purchasing a sword, to be presented to Col. Thomas H. Seymour, as a testimonial of the esteem entertained by his fellow citizens, for gallant and meritorious service performed upon the battle fields of Mexico, upholding the honor of our national name, and adding another bright laurel to the chaplet of Connecticut.

Resolved, That his Excellency the Governor of the State, William J. Hamersley, Henry C. Deming, Addison H. Fitch and James T. Pratt, be a committee to procure the

sword voted to Col. T. H. Seymour, and that the committee make a public presentation at such time and place as they judge proper.

AUTHORIZING THE PURCHASE OF A SWORD, TO BE PRESENTED TO MAJOR HENRY W. WESSELS:

Resolved, That the sum of three hundred dollars be, and the same is hereby appropriated for the purchase of a sword, to be presented to Major Henry W. Wessels of the 2d Regiment of Infantry, U. S. Army, as a slight testimonial of respect for the valor and good conduct of that officer, who by rising from the grade of a first lieutenant, to that of a field officer, for his bravery and soldier-like conduct at the bombardment of Vera Cruz, the storming of Cerro Gordo, and the battle of Cherubusco, has reflected high honor as well upon the service to which he is attached as to this State, of which he is a native and a citizen.

Resolved, That his Excellency the Governor, General Francis Bacon, Colonel George C. Woodruff, Colonel Henry D. Smith and Major A. C. Goodman, be a committee to procure the sword voted to Major Henry W. Wessels, and that the committee make a public presentation of it, at such time and place as they may think proper.

AGAINST EXTENDING THE BOUNDARIES OF TEXAS.

Whereas by the joint resolutions for the annexation of Texas to the United States, it was provided, that all questions of boundary then existing between Texas and other countries, should be settled by the Government of the United States; and whereas it is just and necessary,

that Texas should be confined to its original and proper boundaries; and whereas the extension of the jurisdiction. of Texas beyond its original and proper boundaries would authorize slavery where it would not otherwise be permitted; and whereas it is the duty of Congress to guard against any and every encroachment of Texas on the free territory acquired from Mexico:-Now therefore,

Resolved by this Assembly, That our Senators in Congress be instructed, and that our Representatives in Congress be requested to vote against any bill extending the boundaries of Texas westward or northward to any point beyond the original limits of what was the Mexican state or department of Texas, and to vote for such measures as will exclude the jurisdiction of Texas from encroaching on the old departments of Tamaulipas, Chihuahua, Coahuila, and New Mexico.

AMENDING THE CHARTER OF TRINITY COLLEGE.

Whereas, The Trustees of Trinity College, at a special meeting held on the 20th day of September, 1848, passed a vote appointing a committee to procure an alteration in the charter of said college, so that the bishop of the protestant episcopal church in the diocese of Connecticut, for the time being, shall be ex-officio chancellor of said college and chairman or president of the board of trustees therefore,

Resolved by this Assembly, That the fourth section of the charter of said college be so altered and amended as to read as follows:

IV. Resolved, That the President of the College shall always be, ex-officio, a member of the Board of Trustees, and that the Bishop of the Protestant Episcopal Church

in the diocese of Connecticut, for the time being, shall always be ex-officio Chancellor of the College and President of the Board of Trustees, and that a secretary of the Board shall be elected by the Trustees, to hold his office during their pleasure.

DISCONTINUING A PART OF THE NEW

LONDON AND WINDHAM

COUNTY TURNPIKE ROAD, AND ESTABLISHING LOCATION OF A TOLL GATE.

Upon the petition of the New London and Windham county

turnpike society, vs. the town of Lisbon, shewing to this Assembly, that the petitioners were constituted a body corporate and politic, by this Assembly, more than fifty years ago, with powers to construct a turnpike road from the city of Norwich, through the towns of Norwich, Lisbon, Preston, (now Griswold,) Plainfield and Sterling, to the east line of this state, and erect their toll gates for the collection of toll, all which was accomplished; and that said turnpike road, where the same was located within the town of Lisbon, passed over the top of Bundy Hill, so called, which, when wrought, proved an inconvenient and bad location, not satisfactory to the public, nor convenient for public travel; that afterwards, to wit, in 1835, in pursuance of an act of this General Assembly, passed at their session in 1833, the directors of said turnpike company, with the consent of the owners of the adjoining lands, and with the approbation of the commissioners of said turnpike road, did make an alteration thereof, within the town of Lisbon aforesaid, in such manner as to pass around at the base of said Bundy Hill instead of running over the top of the same, all which, at the time was deemed advisable, to place said road on better ground than it was when originally laid out; and

an accurate survey thereof having been made and completed, the alteration was worked and completed, to the acceptance of the commissioners on said road, for the year 1835, when the same was completed, which acceptance was drawn up in due form of law and signed by the commissioners, the owners of the land and the directors of said company, together with said survey, and was delivered to Luther Spalding, Esq., for the purpose of being lodged with the Secretary of this State to be recorded, according to the provisions of said act:-further shewing, that soon after, the said Luther Spalding died, and that from that cause, or some other cause unknown to the petitioners, the said survey was never so returned nor recorded, without fault of the petitioners, but by accident the same was lost, and still remains incomplete; and that since the year 1835, the public have used and enjoyed the said alterations as a turnpike road, and the commissioners have, from year to year, inspected and approved the same as part of said turnpike road, and during the whole of that period the said corporation have ceased to keep in repair or use said old part, over Bundy Hill, which alteration cost over two thousand dollars, and the said alteration, as then surveyed, was recorded in the office of the clerk of the county court for New London county, instead of the office of the Secretary of State, was and is in the words and figures following, to wit: Commencing at a stake and stones standing in the wall in the town of Lisbon, on the south side of said highway a few rods easterly from the foot of the eastern declivity of Bundy Hill, so called, thence extending three rods wide 62 degrees 30 minutes west, 29 rods, 20 links; thence south, 47 degrees 15 minutes W., 26 rods, 5 links; thence S. 29 degrees 45 minutes W., 13 rods, 5 links; thence S. 16 degrees W., 18 rods, 13 links; thence S. 11 degrees 45 minutes W., 16 rods, 15 links; thence S. 3 degrees 30 minutes W., 8 rods, 10 links; thence S. 18 degrees 45 minutes W., 17 rods, 17 links; thence S. 30
