NAYS-Mr. Rawlins.

Absent at the two previous votes, Messrs. Deguire, sick; Montgomery and Noland.

Messrs. Danforth, Monroe and Penn, were appointed a committee under the resolution aforesaid.

The Senate resolved itself into a committee of the whole house,
Mr. Jones of Pike in the Chair,

After some time spent therein the committee rose, and the chairman made the following report:

Mr. President,

The committee of the whole, have had under consideration, a bill to establish a second branch bank of the bank of the State of Missouri, and have made some progress therein, but have not had time to consider the whole bill and have instructed me to report progress.

The Senate met pursuant to adjournment.

Mr. Darby offered the following:

Resolved, That the Committee on the Judiciary be instructed to report a bill fixing the time of holding the Supreme Court,

Which was adopted.

Mr. Darby offered the following:

Resolved, That the committee on Internal Improvement, be discharged from the further consideration of so much of the Governor's message, as relates to constructing a rail road from the City of St. Louis to the Iron Mountain.

2nd, Resolved that so much of the Governor's message as relates to the construction of a Rail Road from the City of St. Louis to the Iron Mountain, be referred to a select committee with instructions to report thereon, as soon as may be by bill or otherwise,

The following message was received from the House of Representatives by Mr. Williams:

Mr. President,

I am instructed by the House of Representatives to inform the Senate, That there have been introduced into the House of Representatives, bills of the following titles to wit:

"A Bill to incorporate the Washington Fire Company,

"A Bill for surveying and marking out a State Road from Palmyra in Marion county to Plattsburg in Chariton county.

"A Bill for the relief of George Hudspeth."

"And also they passed bills of the following titles to wit:

"A Bill to continue a State road from Massie's, Iron works in Crawford county to the City of Jefferson,"

"And also,"

"A Bill respecting a change in the State road in Franklin county," Which are herewith submitted for the concurrence of the Senate.

Mr. President laid before the Senate sealed proposals of Calvin Gunn, for printing Journals of the present Session, which

Were laid on the table.

Mr. Turner submitted the following:

Resolved by the Senate, (the House of Representatives concurring therein) that the select committee of the two Houses, to enquire into the conduct of the Missouri Volunteers in the Florida War, &c. &c., be instructed to send for witnesses residing more than fifty miles from this place, unless the same facts cannot be proven by two witnesses residing within that distance.

Mr. McDaniel moved

That the resolution be indfinitely postponed.

Mr. Montgomery appeared and took his seat.

Mr. Campbell asked and obtained leave to introduce "a bill, entitled an act to amend an act to incorporate the Curators of St. Charles College," which Was read a first time and

Ordered to a second reading.

On motion of Mr. Sterigere,

The Senate proceeded to the election of a Sergeant at Arms for the Senate for the present session.

Messrs.--John Minnis, William R. Dawson, and George W. White, were severally nominated to fill said office.

The vote being taken there appeared

For Mr. Minnis,-Messrs. Ashby, Danforth, Gilliam, Hunter, McDaniel, Monroe, Noland, Penn and Turner.-9.

For Mr. Dawson,-Messrs. Byrd, Campbell and Sterigere.-3.

For Mr. White,-Messrs. Conger, Darby, Gentry, Glascock, Gorham, Grimsley, Hyatt, Jones of Cooper, Jones of Pike, Maupin, McIlvain, Miller, Morin, Pratt, Rawlins, Scott, Thompson and Watts.--18.

Absent.-Messrs. Deguire, sick and Montgomery.

Mr. White having received a majority of the votes given was declared duly elected Sergeant-at-Arms for the Senate, for the present session.

THURSDAY, DECEMBER 6th, 1838.

The Senate met pursuant to adjournment.

Mr. Glascock presented,

The petition of Mariah Dodd, praying the partition of certain lands therein described, among the heirs of Stephen Dodd.

Which was read, and

On motion of Mr. Sterigere,

Referred to the committee on the Judiciary.

Mr. Ashby from the committee on Internal Improvements, made the following report:

"Mr. President,

The committee on Internal Improvements to whom was referred a bill for surveying and marking out a State rond from Plattsburg to Dickson's landing on the Missouri river, have had the same under consideration, and have instructed me to report the bill, and recommend to strike out the ninth section of the bill." The question,

"Shall the report be agreed to?" Was decided affirmatively.

On motion of Mr. Ashby,

The bill to survey and mark out a State road from Plattsburg to Dickson's landing on the Missouri river,

Was taken up and laid on the table.

Mr. Campbell from the committee on the Judiciary,

Reported without amendment a joint resolution from the House of Representatives, resecting the Auditor of public accounts, which

On motion of Mr. Campbell,

Was ordered to a third reading to-morrow.

Mr. Monroe submitted the following,

Resolved by the Senate and House of Representatives of the State of Missouri, That the sum of seventy-eight dollars and fifty-five cents, be and the same is hereby appropriated for the pay of copying the Laws and Journals, Which was read a first time, and

Ordered to a second reading.

Mr. Grimsley submitted the following,

Resolved, That the committee on the Penitentiary, be instructed to take into consideration the act entitled an act to establish a Penitentiary, and also the charter of the City of St. Louis, and report by bill or otherwise, as to the expediency of giving in addition to the powers already granted in said charter to the Mayor and board of Aldermen, the power of establishing a work house or house of correction in or near said City.

Which was adopted.

Mr. Sterigere offered the following,

"Resolved, That a committee be appointed to consider and report the proposals for printing the Laws and Journals, and for the purpose of considering any matter connected with the printing of the Laws and Journals and the distribution thereof,"

Which was adopted. And

Messrs. Sterigere, Hunter and Rawlins were appointed as the committee under the foregoing resolution.

On motion of Mr. Miller,

It was ordered that the committee of the whole House be discharged from the further consideration of a joint resolution, respecting the Auditor of Public Accounts.

Mr. Monroe submitted the following,

Resolved, That the Auditor of Public Accounts lay before the Senate, a statement of the amount due, if any, for copying the Laws and Jornals of last session, and for the payment of which there is no appropriation,

Which was adopted.

On motion of Mr. Sterigere,

It was ordered that all the proposals for printing the Laws and Jaurnals, be referred to the committee on that subject.

Mr. Sterigere moved,

That the committee of the whole be discharged from the further consideration of a bill concerning dower,

Which was agreed to.

A bill to restrain intercourse with the Indians was taken up,

Read a second time, and

On motion of Mr. Darby,

Referred to the committee of the whole House.

An act to amend an act, to incorporate the curators of St. Charles College, was taken up,

Read a second time,

Ordered to be engrossed and read a third time to-morrow.

An engrossed bill from the House of Representatives to regulate the sale of township school lands, in the county of Carroll, &c.

Was taken up and read a third time.

Mr. Campbell offered to amend the bill by way of ryder,

By striking out of the fourth section the word "favours," and insert in lieu thereof, the word "powers,"

Which was read a first time, and also

Read a second time and considered as engrossed.

On motion of Mr. Noland,

The bill together with the ryder,

Was laid on the table.

An engrossed bill from the House entitled an act explanatory of an act, to organize Clark county,

Was taken up,

Read a third time and passed.

A bill to incorporate a steam flouring mill in St. Louis county,

Was taken up and read a third time.

Mr. Monroe offered to amend by way of ryder, by adding

The private property of each stockholder in the said corporation, shall be liable in proportion to the amount of stock owned, for all debts and liabilities of said corporation, any thing in this act that may be otherwise construed to the contrary, notwithstanding,

Which was read a first time, and

No objections being made, was read a second time

And considered as engrossed.

Mr. Penn offered to amend the ryder by striking out all after the word "owned" and inserting the following,

The stock and all the profits arising from said corporation, shall be liable for
