18. And be it further enacted, That the sum of fifty dollars be N Paul paid to the Rev. Nathaniel Paul, by the treasurer, and that the comptroller issue his warrant for that sum.

19. And be it further enacted, That there be paid upon the W Popham warrant of the comptroller, to William Popham, clerk of the court of exchequer, six hundred and twenty-five dollars for the salary allowed him by law, and the further sum of five dollars, not allowed him by mistake, for his last years salary.

20. And be it further enacted, That the treasurer pay on the Revisors warrant of the comptroller, to the revisors of the laws, the sum of five hundred dollars each, in part payment of the amount allowed to them for the act entitled "an act for revising and publishing the laws of this state," passed April 21, 1825.

21. And be it further enacted, That there shall be allowed and IL Weaver paid to Isaiah L. Weaver by the treasurer, on the warrant of the comptroller, one dollar and fifty cents, for each days attendance by him on the court for the trial of impeachments and the correction of errors, to be certified by the president of the senate.

22. And be it further enacted, That the treasurer pay on the Surveyor gen warrant of the comptroller, the sum of one hundred and fifty dollars hire to the surveyor-general, for additional clerk hire, to take effect on the first of January last.

23. And be it further enacted, That the treasurer shall pay, on Mrs Goode!! the warrant of the comptroller, to the widow of Richard Goodell, late keeper of the state prison at Auburn, the sum of three hundred dollars, the proportionable part of the salary of the said Richard Goodell, from the time of his death to the time when his first year would have been completed as keeper of the said prison.

24. And be it further enacted, That the treasurer on the warrant of the comptroller, shall pay to Abraham Oake, clerk in the treasurer's office, the sum of two hundred dollars, in addition to the compensation now allowed by law for his services in the said office for the current year.

AN ACT to amend the act, entitled "An Act to incorporate the
Hector and Catharine Turnpike Road and Bridge Company,"

1. BE it enacted by the People of the State of New-York, rep- Draw bridge resented in Senate and Assembly, That it shall be the duty of the president and directors of the said company to keep and maintain a draw in the bridge across the Catharine Inlet, of sufficient size and dimensions to admit of the free passage of boats, rafts and other water craft under and through the same, and that it shall be the duty of the said president and directors, either by themselves or their agent or toll gatherer, upon the request of the master, agent or owner of any boat, raft or water craft, navigating the said inlet, to raise

or cause to be raised the draw in said bridge so as to admit of the passage of any such boat, raft or water craft, without any unreasonable delay, and free of toll.

2. And be it further enacted, That the master boatman or persons navigating any boat, raft or water craft, who shall raise or attempt to raise the draw of said bridge without first calling upon the agent or toll gatherer of the said company, or shall wilfully commit any trespass or injury to the said bridge, or to the said draw, shall be liable to the said company for double the amount of damages done to said bridge, or to the said draw, to be recovered in an action of debt, with costs of suit, before any court having cognizance of the same: And further, on conviction thereof, shall be deemed guilty of a misdemeanor, and shall be punished by fines or imprisonment, or both, at the discretion of the court before which such conviction shall be had: Provided, That such imprisonment shall not be for a longer term than six months, and such fines shall not exceed two hundred dollars; and in case the damages aforesaid cannot be collected of the master, boatmen or persons navigating any boat, raft or water craft, by whom any trespass shall be committed or damage done as aforesaid, then and in that case the owner of the said boat, raft or water craft, shall be liable for double the amount of damages as aforesaid, to be sued for and recovered in manner aforesaid.

3. And be it further enacted, That in case the said company shall fail to maintain and keep the said bridge and the draw so to be constructed therein, in the manner directed in and by this act, it shall not be lawful for the said company to demand or receive any toll for passing over the said bridge, and the legislature may at any time hereafter alter, amend or repeal this act.

CHAP. 320.

AN ACT to give effect to Letters Patent where the same were issued after the death of the Patentee.

Passed April 18, 1826.

1. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That the title to all lands heretofore granted by letters patent to any person or persons who died previous to the granting or issuing such patents, shall be, and is hereby declared to have been vested in such patentee or patentees at the time of their deaths respectively: Provided, That nothing herein contained shall be so construed as to affect the title or interest of any person or persons acquired by, from or under any bona fide purchase of any of the said lands, or under or by virtue of any contract, agreement or conveyance bona fide on the part of the grantee in such contract, agreement or conveyance, by whomsoever the same may have been made and executed.

2. And be it further enacted, That the second section of the act, entitled " an act concerning lands in the mili.ary tract," passed April 8th, 1813, shall apply to all lands which may be taken or holden in virtue of this act.

AN ACT to to provide for auditing and paying the contingent
Expenses of the Senate and Assembly, and for other purposes.

1. BE it enacted by the People of the State of New-York, repre- Accounts sented in Senate and Assembly, That from and after the passing of audited this act, it shall be the duty of the comptroller, in auditing accounts for the contingent expenses of the senate and assembly, to require satisfactory evidence that the services charged have been performed, and that the charge therefor is reasonable, and also require the like evidence that articles charged in such account have been furnished, and that the price charged therefor is reasonable.

2. And be it further enacted, That in the second section of the Section act, entitled "an act relative to the sale of lands belonging to the people of this state, and to prevent trespasses on public lands," passed 14th April, 1826, the words "Eighth section"* shall be taken as referring to the "Eighteenth section" of the act, entitled " concerning the commissioners of the land-office and the sale of un appropriated lands."
