§ 1. Irrigation district may provide for drainage. Any irrigation district heretofore organized or hereafter to be organized under the laws relating to such districts may provide for any and all drainage made necessary by the irrigation provided for by such laws; and the officers, agents and employees of such districts shall have the same powers, duties and liabilities respecting such drainage, and the construction, repair, maintenance, management and control thereof as they now have or may hereafter have respecting such irrigation, and all laws respecting such irrigation or such irrigation districts shall be so construed, applied and enforced as to apply to such drainage as well as such irrigation.

§ 2. Duty of board of directors. Whenever it appears necessary, or proper, or beneficial to the lands affected thereby, to drain such lands or any portion thereof on account of the irrigation which has been done, or which is intended to be done under such laws, whether for the purpose of more beneficially carrying on such irrigation, or to protect such districts from liability by reason of such irrigation, whether the irrigation works have already been constructed or not, it shall be the duty of the board of directors to provide for such drainage, and said board and its officers, agents and employees shall do all necessary and proper acts for the construction, repair, maintenance and management of drainage work for such purpose.

§ 3. In effect when. This act shall take effect immediately.

An act validating the formation and organization of Los Angeles County Drainage District Improvement No. 1 under the provisions of an act of the legislature of the state of California, approved March 21, 1903, as amended May 7, 1915, and entitled as amended "An act to promote the drainage of wet, swamp and overflowed lands, and to promote the public health in the communities in which they lie, providing for the issuance of bonds and levying of assessments on lands benefited, to pay the costs and expenses thereof." EGGS.

ACT 2215.

An act to regulate the sale of eggs that have been shipped or imported into the state of California from any point or place outside of the United States, requiring the marking thereof by all persons selling or offering the same for sale, and fixing penalties for the violation of the same or of any of the provisions thereof.

§ 1. "Person," "firm," "company," etc., mean wholesalers, retailers, jobbers, etc. For the purposes of this act the words "person, firm, company or corporation" shall include wholesalers, retailers, jobbers, and every place where eggs that have been shipped or imported into the state of California, from any point or place outside of the United States, are sold or offered for sale.

§ 2. Imported eggs to be branded. Every person, firm, company or corporation who sells, offers for sale, or has in his, or their, possession for sale, or consigns, ships or presents to any dealer, commission merchant, consumer, or other person, any egg or eggs that have been shipped or imported into the state of California, from any point or place outside of the United States, shall before so doing, cause to be stamped, marked or branded upon one end thereof, in black-faced letters not less than one-eighth of an inch in height, the word "imported."

§ 3. Sign displayed in salesroom. Every person, firm, company, or corporation, selling or offering for sale any eggs that have been shipped or imported into the state of California, from any point or place outside of the United States, shall display in a conspicuous place in his or their public salesroom, a sign, which shall be not less than one foot in height and six feet in length, bearing the words "imported eggs sold here" in black-faced letters not less than six inches in height and one inch in width upon a white ground.

§ 4. Report to state board of health. Every person, firm, company, or corporation who receives eggs that have been produced in any foreign country and shipped or imported into this state shall immediately thereafter make a report to the state board of health, giving the number of eggs received, the date when received and the place where such eggs were produced.

§ 5. Penalty for violation of act. Every person, firm, company or corporation who shall fail to comply with any of the provisions of this act is guilty of a misdemeanor, and, upon conviction thereof, shall be punished by imprisonment in the county jail for not more than six months; or by a fine of not more than two hundred dollars, or by both such fine and imprisonment, in the discretion of the court. It shall be the duty of the state board of health to enforce the provisions of this act.

An act to provide for the inspection and certification of foreign eggs, foreign powdered eggs, and foreign egg products imported into the state of California for purposes of human consumption; to prescribe certain powers and duties of the state board of health with respect

thereto, and to provide penalties for violations of the provisions of this act.

§ 1. Inspection of foreign eggs. All eggs, powdered eggs and egg products, imported into the state of California from foreign countries shall be sold subject to inspection as hereinafter provided.

§ 2. Permit authorizing sale. No person, firm or corporation shall sell or offer for sale for human consumption in the state of California any eggs, powdered eggs or egg products imported into the state of California from foreign countries until after the same shall have been first inspected by the state board of health, found to be fit for human consumption and a permit authorizing such sale by the state board of health issued. The state board of health shall cause an inspection of all such eggs, powdered eggs or egg products to be made and if the same are found, upon such inspection, to be in fit condition for human consumption, the board shall issue to the importer or consignee a permit authorizing the sale thereof for such purpose, together with certificates of inspection equal in number to the number of the containers in which said eggs, powdered eggs or egg products are packed or otherwise contained. Such certificates of inspection shall be in such form as the board may deem appropriate and shall have printed upon a white background in plain black letters, not less than one inch high, "foreign eggs," or, as the case may be, "foreign powdered eggs," or "foreign egg produets," "inspected" (inserting the date) "by California state board of health." Such certificates shall be printed upon gummed, adhesive labels, and it shall be the duty of the importer or consignee to affix or cause to be affixed one such certificate to each of such containers in such manner that the inspection certificate shall be plainly visible to the buyer. All such foreign eggs, foreign powdered eggs, and foreign egg products shall be sold only from the original containers. No certificate of inspection shall be removed from the container or defaced, and no container upon which such inspection certificate has been affixed shall be used as a receptacle for any foreign eggs, foreign powdered eggs or foreign egg products which have not been so inspected and pronounced fit for human consumption by the state board of health.

§ 3. Rules and regulations. The state board of health may make rules and regulations to secure a proper enforcement of the provisions of this act, including rules and regulations with respect to the inspection of the eggs, powdered eggs and egg products mentioned herein and the labeling thereof, and the violation of such rules shall be punished on conviction as provided in section four of this act.

§ 4. Penalties. Any person, firm, or corporation violating any of the provisions of this act or any rules and regulations made pursuant to the provisions of this act by the state board of health shall, upon con

viction, be punished for the first offense by a fine not exceeding five hundred dollars ($500), and for the second offense by a fine not exceeding one thousand dollars ($1,000), or by an imprisonment for not more than ninety (90) days or by both such fine and imprisonment.

§ 5. Repealed. All acts and parts of acts in conflict herewith are hereby repealed.

§ 6. Constitutionality. If any section, subsection, sentence, clause or phrase of this act is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this act. The legislature hereby declares that it would have passed this act, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared unconstitutional.

§ 1. Words defined. For the purpose of this act the words "person, firm, company or corporation" shall include wholesalers, retailers, jobbers, and every person, firm, company or corporation owning, operating or conducting any place of business where eggs are sold or offered for sale.

§ 2. Eggs in transit more than thirty-one days to be marked "storage." Every person, firm, company or corporation who sells, offers for sale, or has in his or their possession for sale, or consigns, ships or presents to any dealer, commission merchant, consumer, or other person, any egg or eggs which said egg or eggs is or were produced at any place requiring thirty-one days or more to transport the eggs to the selling point, shall, before so doing, cause to be stamped, marked or branded upon the container thereof in black-faced letters not less than one-half of an inch in height the word "storage."

§ 3. Display of sign in salesroom. Every person, firm, company or corporation selling or offering for sale any eggs which were produced at any place requiring thirty-one days or more to transport the eggs to the selling point, prior to the date of sale or offering for sale, shall display in a conspicuous place in his or their public salesroom a sign which shall not be less than one foot in height and six feet in length, bearing the words "storage eggs sold here" in black-faced letters not less than six inches in height and one inch in width upon a white ground.

§ 4. Report to state board of health. Every person, firm, company or corporation who receives eggs that have been produced at any place requiring thirty-one days or more to transport the eggs to the selling point,

prior to their sale or offering for sale, shall, immediately thereafter report to the state board of health the number of eggs received, the date when received and the place where such eggs were produced, and the name of the person, firm, company or corporation to whom sold.

§ 5. Enforcement. It shall be the duty of the state board of health to enforce the provisions of this act, and to that end the said board may make necessary rules and regulations.

§ 6. Penalty. Every person, firm, company or corporation who shall fail to comply with any of the provisions of this act is guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the county jail for not more than six months; or by a fine of not more than two hundred dollars, or by both such fine and imprisonment in the discretion of the court.

An act to regulate the sale of food and drink, the ingredients of which are in part composed of eggs shipped or imported into the state of California, from any point or place outside of the United States, requiring the marking of all bills of fare or menu cards placed on tables or counters in establishments preparing, serving or offering for sale any such food or drink, and fixing penalties for the violation of the same or of any of the provisions thereof.

§ 1. "Persons," etc., means hotel, restaurant, etc. For the purposes of this act the words "person, firm, company or corporation" shall include hotels, restaurants, cafeterias, lunch counters, lunch wagons, saloons, soda fountains, bakeries, delicatessens and boarding-houses, and every place where food or drink is prepared and offered for sale.

§ 2. Menu cards to bear "Imported eggs used here." Every person, firm, company, or corporation who prepares or serves, sells or offers for sale, any food or drink, the ingredients of which are in part com. posed of eggs shipped or imported into the state of California, from any point or place outside of the United States, before so doing shall cause to be printed on all bills of fare or menu cards placed on his or their tables or counters, in black-faced letters not less than oneeighth of an inch in height, the words "imported eggs used here."

§ 3. Sign displayed in salesroom. Every person, firm, company or corporation preparing, serving, selling or offering for sale any food or drink, the ingredients of which are in part composed of eggs shipped or imported into the state of California, from any point or place outside of the United States, shall display in a conspicuous place in his or their public salesroom, a sign, which shall be not less than six inches in height and three feet in length, bearing the words "imported eggs used here" in black-faced letters not less than three inches in height and one-quarter of an inch in width, upon a white ground.
