ACT 1081.

An act entitled an act to prevent the sale of short-weight rolls of butter.

[Approved March 11, 1893. Stats. 1893, p. 151.]

Short-weight butter. Any person or persons, firm or corporation, who offers for sale roll-butter not of full weight to each roll, shall be guilty of a misdemeanor.

Act takes effect when. This act shall go into effect sixty days after its passage.

ACT 1082.

An act to regulate the production and sale of certified butter.

[Approved March 17, 1911. Stats. 1911, p. 382.]

2. Penalty for violation.

§1. Certified butter, sale or exchange of. No person shall sell or exchange, or offer or expose for sale or exchange, as and for certified butter any butter which does not conform to the regulations prescribed by, and bear the certification of, a milk commission appointed by a county medical society organized under and chartered by the medical society of the state of California and which has not been pronounced by such authority to be free from antiseptics, added preservatives and pathogenic bacteria. All butter sold as certified butter shall be conspicuously marked with the name of the commission certifying it; provided, that such milk commission shall make all requirements for the production and handling of certified butter uniform and fair, and shall not refuse to certify butter for any applicant for certification who shall comply with the provisions of this act, and the requirements of the milk commission whose certificate is sought.

§2. Penalty for violation. Any person who shall violate any of the provisions of this act shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than twenty-five dollars nor more than two hundred dollars, or by imprisonment in the county jail for not less than ten days nor more than sixty days.

ACT 1083.

An act to regulate the sale of butter that has been shipped or imported into the state of California from any point or place outside of the United States, requiring the marking thereof by all persons selling

or offering same for sale, and fixing penalties for the violation of the same or of any of the provisions thereof.

§ 4. Penalty for noncompliance.

§ 1. Definitions. For the purposes of this act the words "person, firm, company, or corporation," shall include wholesalers, retailers, jobbers, and every place where butter that has been shipped or imported into the state of California from any point or place outside of the United States is sold or offered for sale.

§ 2. Butter from outside U. S. to be marked. Every person, firm, company, or corporation who sells, offers for sale, or has in his, or their, possession for sale, or consigns, ships or presents to any dealer, commission merchant, consumer, or other person any butter that has been shipped or imported into the state of California from any point or place outside of the United States shall, before doing so, cause to be stamped, marked or printed upon the wrapper, or other container thereof in black-face letters not less than one-eighth of an inch in height the word "imported."

§ 3. Sign indicating importation. Every person, firm, company, or corporation selling or offering for sale any butter that has been shipped or imported into the state of California from any point or place outside of the United States, shall display in a conspicuous place in his or their public salesroom a sign, which shall be not less than one foot in height and two feet in length, bearing the words "imported butter sold here" in black-face letters not less than three inches in height and one-half inch in width upon a white ground.

§ 4. Penalty for noncompliance. Every person firm company or corporation who shall fail to comply with any of the provisions of this act, and, upon conviction thereof, shall be punished by imprisonment in the county jail for not more than six months; or by a fine of not more than two hundred and fifty dollars, or by both such fine and imprisonment in the discretion of the court.

An act to establish the California polytechnic school in the county of

The board of trustees of the California Polytechnic School is abolished: See Pol. Code, § 362c.

The powers and duties of the trustees of the California Polytechnic School have been transferred to the Department of Education: See Pol. Code, § 362b.

ACT 1147.

An act to authorize and empower the board of directors of the California Polytechnic School to sell and convey certain real property situated in the county of San Luis Obispo, and belonging to the state. [Approved June 3, 1921. Stats. 1921, p. 1352. In effect August 2, 1921.]

ACT 1157.

CALIFORNIA REDWOOD PARK.

An act providing for the enlargement of the California redwood park, making an appropriation for the purchase of additional land therefor, and granting power to the California redwood park commission

to purchase the same. [Approved May 28, 1917. Stats. 1917, p. 1281. In effect July 27, 1917.]

The act appropriated one hundred and fifty thousand dollars available.in annual installments of fifteen thousand dollars each for the purpose indicated.

Neither the adoption of the amendment to § 34, art. IV, of the constitution, known as the Budget Amendment, nor the enactment by the legislature of the budget bill operated either expressly or by implication to repeal this act in so far as it created a special fund in the state treasury and made specific appropriation out of which the moneys should be drawn to meet and satisfy the purposes for which such appropriation was made: Western Shore Lumber Co. v. Riley, 66 Cal. Dec. 415, 218 Pac. 761.

ACT 1158.

Providing for the creation and management of the California Redwood Park, making an appropriation therefor, and creating a board of five commissioners, with power to make purchases, and to manage said California Redwood Park. [Approved March 16, 1901. Stats. 1901, p. 517.]

§1. California Redwood Park commission, creation of, organization and compensation of. The governor of the state of California shall appoint four commissioners, who with himself, shall constitute the California Redwood Park commission. The term of office of the members of said commission shall be four years from and after the date of their appointment. The commission shall select from its members a president and secretary. The members of the commission shall serve without compensation. They shall be allowed and paid out of the funds available therefor, all reasonable traveling expenses which may be incurred by the members of said commission in the performance of their various duties.

§2. Powers of commission. Warden. The said California Redwood Park commission shall have full power and control over the said park
