ACT 4161.

An act authorizing the United States government to lower the water levels of any or all of the following lakes: Lower or Little Klamath Lake, Tule or Rhett Lake, Goose Lake, and Clear Lake, situated in Siskiyou and Modoc counties and to use any part or all of the beds of said lakes for the storage of water in connection with the irrigation and reclamation operations conducted by the Reclamation Service of the United States; also ceding to the United States all right, title, interest or claim of the state of California to any lands uncovered by the lowering of the water levels of any or all of said lakes not already disposed of by the state. § 1. Grand larceny. Every person who shall convert any manner of real estate of the value of fifty dollars and upwards into personal property, by severing the same from the realty of another, with felonious intent to and shall so steal, take, and carry away the same, shall be deemed guilty of grand larceny, and upon conviction thereof shall be punishable by imprisonment in the state prison for any term not less than one year nor more than fourteen years.

§ 2. Petit larceny. Every person who shall convert any manner of real estate of the value of under fifty dollars into personal property, by severing the same from the realty of another, with felonious

intent to and shall so steal, take, and carry away the same, shall be deemed guilty of petit larceny, and upon conviction thereof shall be punishable by imprisonment in the county jail for a period not more than one year, or by fine not exceeding one thousand dollars, or by both such fine and imprisonment.

Every person who shall feloniously steal, take, and carry away, or attempt to take, steal, and carry from any mining claim, tunnel, sluice, undercurrent, riffle-box, or sulphurate [sulphuret-] machine any gold-dust, amalgam, or quicksilver, the property of another, shall be deemed guilty of grand larceny, and upon conviction thereof shall be punished by imprisonment in the state prison for any term of not less than one year nor more than fourteen years.

§ 2. Act takes effect when. This act shall be in force from and after its passage.

§ 1. Appropriation: Survey of Lassen national volcanic park. Out of any money in the state treasury, not otherwise appropriated, there is hereby appropriated the sum of eight thousand dollars which shall be used and expended for the purpose of making a preliminary survey of the territory embracing Mount Lassen, and territory contiguous thereto, known as the Lassen national volcanic park.

§ 2. Co-operation with U. S. The state department of public works is hereby authorized and empowered to co-operate with the national park service of the United States government in the survey of said land; provided, however, that the money herein appropriated shall not become available until there shall have been deposited in the state treasury for this purpose, the sum of three thousand dollars by the United States government; said money hereby appropriated to be expended in accordance with the directions of the authorities of the United States government.

LEASES.

ACT 4238.

An act concerning confirming and ratifying leases and other contracts made by any officer or boards of officers of this state. [Approved March 23, 1901. Stats. 1901, p. 601.]

This act ratified the lease of China Basin in San Francisco to the San Francisco and San Joaquin Valley Railway Companies.

This act being general in its terms, applicable to all leases of tidelands made by a certain class of cities, is not invalid as special legislation: San Pedro etc. Co. v. Hamilton, 161 Cal. 610, 37 L. R. A. (N. S.) 686, 119 Pac. 1073.

§ 1. Legal tender notes to be received at par. All legal tender notes heretofore issued, or which may hereafter be issued, by the government of the United States of America, as legal-tender notes, shall be received at par in payment for all taxes due or to become due to this state, or to any county or municipal corporation thereof, and such notes shall be a legal tender for all debts, dues, and demands between citizens of this state.

§ 2. Repeal of conflicting acts. All acts, and the provisions of any act or parts of acts, conflicting with this act are hereby repealed.

§3. Time of taking effect of act. This act shall take effect and be in force from and after its passage.
