ACT 3667.

To provide for the future management of Napa State Asylum for the Insane. [Stats. 1875-76, p. 133.]

Amended 1883, p. 281; 1887, p. 177; 1889, p. 351. Superseded by the Lunacy Commission Act, 1897, p. 311. This act was probably superseded by §§ 2136-2199 of the Political Code. See note to Act 3685, post. The powers and duties of the directors of the Napa Insane Asylum and of the State Commission in Lunacy have been vested in the Department of Institutions. See Clary, In re, 149 Cal. 732, 87 Pac. 580.

ACT 3670.

An act authorizing the board of managers of the Napa State Hospital to grant a right of way to San Francisco, Napa and Calistoga Railway over land owned by the state of California, for the consideration herein expressed. [Approved May 15, 1919. Stats. 1919, p. 621.

An act to provide for the establishment of a state hospital for the insane and providing for commitment thereto and management thereof, and making an appropriation therefor. [Approved June 7, 1913. Stats. 1913, p. 884.]

This act provided for the establishment of a hospital in Southern California. It appropriated two hundred and fifty thousand dollars for the purchase of a site and the erection of a building.

ACT 3672.

To provide for the erection and management of a state hospital for the insane to be located in Southern California. [Stats. 1889, p. 120.]

Amended 1891. p. 481; 1895, p. 207. Superseded by the Lunacy Commission Act, 1897, p. 311. This act was probably superseded by §§ 2136-2199 of the Political Code. See the note to Act 3685, post, The powers and duties of the directors of the Southern California State Hospital and of the State Commission in Lunacy have been transferred to the Department of Institutions: See Pol. Code, § 366c.

ACT 3673.

Appropriation for supplying water, light, and fuel for the state insane asylum at Stockton. [Stats. 1889, p. 106.]

ACT 3674.

An act to provide for marking off and setting apart a portion of the Stockton State Hospital grounds for a site upon which to construct an armory; to provide for the conveyance and transfer of the lands comprising said proposed site by said corporation through its proper officers, board of managers or their successors as trustees of such property, to the state of California; to provide for the control and management thereof; to provide for the construction and erection of an armory and drill hall thereon, and appropriating money therefor. [Approved May 17, 1915. Stats. 1915, p. 493.]

The purpose of the act sufficiently appears from the title.

ACT 3675.

An act providing for the removal of bodies from the cemetery at the Stockton State Hospital and the disposition thereof, and making an appropriation therefor. [Approved June 1, 1917. Stats. 1917, p. 1661. In effect July 31, 1917.]

To authorize the board of managers of the Southern California State Hospital to sell a strip of land. [Stats. 1901, p. 563.]

ACT 3678.

An act to authorize and empower the board of managers of the Southern California State Hospital for the Insane, near the city of San Bernardino, San Bernardino County, to sell and convey a strip or parcel of land situate in San Bernardino County, in the state of California, and belonging to said state, to the San Bernardino Valley Traction Company for the purposes of a right of way for an electric railroad thereon. [Approved March 23, 1907. Stats. 1907, p. 911.]

ACT 3682.

In relation to the superintendent of the state insane asylum. [Stats.

This act required the superintendent to attend the annual meetings of the Superintendents of American Institutions for the Insane: See the act of 1877-78, p. 767.

ACT 3683.

To provide for the future management of the state asylums for the insane. [Stats. 1885, p. 32.]

"Modified, if not repealed, by 1889, p. 329, c. CCXX, and both modified, if not repealed, by the Lunacy Commission Act, 1897, p. 311."Code Commissioners' Note.

ACT 3684.

To provide for the maintenance, support, and discharge in certain cases of insane persons confined in the state asylum for the insane, and for the control and management of a resulting contingent fund. [Stats. 1889, p. 329.]

Probably superseded by the Lunacy Act, 1897, p. 311.

This act provided for an inquiry into the ability of inmates to support themselves, and for the payment for their support by inmates found capable.

ACT 3685.

To establish a state lunacy commission, to provide a uniform government and management of the state hospitals for the insane, and provide for the care, custody, and apprehension of persons believed to be insane, and the commitment of insane persons, and providing for the transfer of unexpended appropriations of moneys and properties. [Stats. 1897, p. 311.]

Amended 1899, p. 160. Section 19 repealed 1900, p. 22. Entirely repealed in 1921 (Stats. 1921, p. 1071).

"Unconstitutional as to method of commitment. (Matter of Lambert, 134 Cal. 626.) Probably superseded by §§ 2136-2199, Political Code, as adopted in 1903, and amended in 1905. See, also, In the Matter of Clary, 149 Cal. 732."-Code Commissioners' Note.

This act did not repeal § 1373 of the Penal Code, making counties liable for the support of insane prisoners: Napa State Hospital v. Yuba County, 138 Cal. 378.

Article II, § 5, unconstitutional: Sponogle v. Curnow, 136 Cal. 580, 69 Pac. 255. On similar point, see Smith v. Brown, 59 Cal. 672; People v. Edwards, 95 Cal. 153, 28 Pac. 831.

The powers and duties of the State Lunacy Commission are transferred to the Department of Institutions: See Pol. Code, § 366c.

ACT 3686.

An act to provide for restoration to capacity of persons adjudged to be insane, who have no guardians and who are not confined at state hospitals for the insane. [Approved March 23, 1901. Stats. 1901, p. 639.]

ACT 3687.

An act to authorize and empower the board of managers of the Agnews State Hospital to sell and convey a portion of real property situate

in Santa Clara County, in the state of California, and belonging to said state, to the Western Distilleries. [Approved April 20, 1909.

ACT 3688.

An act to authorize and empower the board of managers of the Agnews State Hospital to grant, under the conditions herein provided, to the Southern Pacific Railroad Company, a corporation, a right of way and easement for the purpose of constructing, maintaining and operating an industrial spur-track over, along and upon a strip of land situate in the county of Santa Clara and belonging to the state of California. [Approved May 5, 1917. Stats. 1917, p. 251. In effect July 27, 1917.]

ACT 3689.

An act confirming the sale and conveyance by the board of managers of the Agnews State Hospital to Western Industries Company of a portion of real property situate in the county of Santa Clara, state of California, and belonging to the state of California. [Approved May 21, 1919. Stats. 1919, p. 780.]

ACT 3690.

An act to establish an institution for the care, confinement and instruction of feeble-minded and epileptic persons; to provide for the government and maintenance thereof, and for the study of mental deficiency and related problems; to provide for admission and commitment to such institution, and to prescribe penalties for unlawfully or improperly contriving to have persons adjudged feeble-minded under this act; to provide for the sterilization of inmates of such institutions; to prescribe penalties for procuring the escape, or aiding or advising in the escape, of inmates, or concealing inmates thereof; to provide a contingent fund for the use of such institution and to make an appropriation therefor.

The title of this act was amended in 1921 to read as follows (Stats. 1921, p. 811):

"An act to be known as the 'Pacific colony act' to establish an institution for the care, confinement and instruction of feeble-minded and epileptic persons, to provide for government and maintenance thereof, and for the study of mental deficiency and related problems, to provide for admission and commitment to such institution and to prescribe penalty for unlawfully or improperly contriving to have persons adjudged feeble-minded under this act, to provide for the sterilization of inmates of such institution, to prescribe penalties for procuring the escape or aiding or advising in the escape of inmates, or concealing inmates thereof, to provide a contingent fund for the use of such institution and to make an appropriation therefor, as approved June 1, 1917."

§ 1. Pacific colony act. This act shall be known as the "Pacific colony act." There is hereby created an institution to be known as the "Pacific colony" and which is hereby declared to be a corporation. [Amendment approved May 28, 1921; Stats. 1921, p. 812.]

§ 2. Board of trustees. The said institution shall be under the control of a board of three trustees, to be appointed by the governor, one for one year, one for two years, and one for three years, and thereafter for terms of four years each, to hold office until their successors are respectively appointed and qualified. The governor shall fill vacancies occurring from any cause in the membership of such board, ard the first board shall be appointed within thirty days after this act takes effect.
