1. Appeals, How Governed-An appeal from a judgment in a criminal action may be taken in the manner and in the cases prescribed in this article (5989 R. L. 1910).

2. State May Appeal-Appeals to the Criminal Court of Appeals may be taken by the State in the following cases and no other:

First. Upon judgment for the defendant on quashing or setting aside an indictment or information.

Second. Upon an order of the court arresting the judgment.

Third. Upon a question reserved by the State. (5990 R. L. 1910.)

State may appeal on any question of law. State v. Clifton, 2 Okla. Cr. 189, 100 Pac. 1124; State v. Brown, 8 Okla. Cr. 40, 126 Pac. 245.

State cannot appeal from an order granting new trial. State v. Curley, 13 Okla. Cr. 25, 161 Pac. 831; State v. Weathers, 13 Okla. Cr. 92, 162 Pac. 239.

On motion to dismiss appeal, and defendant makes no reply, it is too late, after case is decided, to correct record on motion for rehearing. Vian v. State, 8 Okla. Cr. 588, 128 Pac. 1103, 129 Pac. 450.

Municipality cannot appeal. Oklahoma City v. Tucker, 11 Okla. Cr. 266. 145 Pac. 757.

3. Appeal by State Not to Suspend Judgment-An appeal taken by the State in no case stays or affects the operation of the judgment in favor of the defendant, until the judgment is reversed. (5993 R. L. 1910)

4. Duty of Clerk When State Appeals-In case of an appeal from a question reserved on the part of the State it shall not be necessary for the clerk of the court below to certify in the transcript any part of the proceedings and record except the bill of exceptions or case-made and the judgment of acquittal. When the question reserved is defectively stated the criminal court of appeals may direct any other part of the proceedings and record to be certified to them. (6000 R. L. 1910)

5. Right of Appeal-An appeal to the criminal court of appeals may be taken by the defendant, as a matter of right, from any judgment against him; and upon the appeal, any decision of the court, or intermediate order made in the progress of the case may be reviewed. (5988 R. L. 1910)

Appeal will be dismissed unless record shows defendant admitted to bail or committed. Drake v. State, 2 Okla. Cr. 643, 103 Pac. 878.

Appeal will be dismissed if defendant fails to comply with rules of Criminal Court of Appeals. Yandell v. Terr., 3 Okla. Cr. 188, 104 Pac. 923. Defendant cannot appeal before judgment is rendered against him. Dansby v. State, 7 Okla. Cr. 496, 124 Pac. 328.

Right of defendant to appeal as pauper or otherwise. Clarady v. State, 9 Okla. Cr. 552, 132 Pac. 691; Wainwright v. State, 11 Okla. Cr. 547. 6. Defendants May Appeal Jointly or Severally-When several defendants are tried jointly, any one or more of them may take an appeal, but those who do not join in the appeal shall not be affected thereby. (6002 R. L. 1910.)

7. Time Within Which Appeal Must Be Taken-In misdemeanor cases the appeal must be taken within sixty days after the judgment is rendered: Provided, however, that the trial court or judge may, for good cause shown, extend the time in which such appeal may be taken not exceeding sixty days. In felony cases the appeal must be taken within six months after the judgment is rendered, and a transcript in both felony and misdemeanor cases must be filed as hereinafter directed. (5991 R. 8. How Appeal Is Taken-An appeal is taken by the service of a notice upon the clerk of the court where the judgment was entered, stating that the appellant appeals from the judgment. If taken by the defendant, a similar notice must be served upon the prosecuting attorney. If taken by the State, a similar notice must be served upon the defendant, if he can be found in the county; if not there, by posting up a notice three weeks in the office of the clerk of the district court. Appeal is taken when this section is complied with. Summons not necessary. If record fails to show proof of service of notice, appeal will be dismissed. Assignments of error on variance between pleading and proof does not go to jurisdiction of court. Thomas v. State, 14 Okla. Cr. 468, 171 Pac. 747. A motion to set aside judgment is a part of record proper. State v. Bell, 13 Okla. Cr. 664, 166 Pac. 451.

9. Appeal Bond-If the crime of which the defendant is convicted be a bailable one, the court shall at the time of entering judgment notify the defendant of his right to appeal and fix the amount of his appeal bond and the time within which the bond shall be given in order to stay the execution of the judgment pending the filing of the appeal in the appellate court, and if the bond be given in the time fixed by the court, execution of the judgment shall be stayed during the time fixed for the settling of the case-made. If the casemade be settled in time and the appeal filed in the appellate court as required by law, then the bond shall stay execution of the sentence during the pendency of the appeal, subject to the power of the court to require a new or additional bond, when the same is by the court deemed necessary. Habeas corpus will not lie to determine action of clerk in refusing to approve bond. Trial court should pass on such questions. Ex parte Tyler, 2 Okla. Cr. 455, 102 Pac. 716.

If defendant fails to give notice of his intention to appeal, he waives right to have execution stayed pending appeal. Section construed. Ex parte Tyler, 2 Okla. Cr. 455, 102 Pac. 716.

10. Conditions of Bond-If an appeal is taken and the appeal bond given as provided in the preceding section, said bond shall be conditioned that the defendant will appear, submit to and perform any judgment rendered by the criminal
