XXIX. And be it further enacted by the authority aforefaid, that the Act passA&t 28 Geo. III. ed in the twenty eighth year of his Majefty's Reign, intituled, "An Ordinance for the regulating the pilotage in the river St. Lawrence and for preventing abufes "in the Port of Quebec," and alfo, another A&t paffed in the thirtieth year of his Majesty's Reign, intituled, " An Act or Ordinance to amend the Ordinance, intituled, A&t 30 Geo. 111. "An Ordinance for the regulating the pilotage in the river Saint Lawrence and for preventing abufes in the Port of Quebec," And alfo, another Act paffed in the thirty feventh year of his Majefty's Reign, intituled," An Act for amending the Laws "now in force, and for making more effectual provifion for the pilotage of the river A&t 37 Geo. III: "Saint Lawrence, between the bafon of Quebec and the Ifland of Bic, and for improv"ing the navigation thereof unto the City of Montreal," fhall be and each of the faid Acts or Ordinances, and every part and parts thereof, is and are hereby repealed. HEREAS the prefent common Goals of the Districts of Quebec and Montreal, are not fufficiently fpacious, nor in other refpects well adapted for the reception and fafe cuftody of prifoners, fo that a new common Gaol for the District of Quebec, and new common Gaol for the District of Montreal, are indifpenfably neceffary. And whereas your Majefty in your paternal regard, for the welfare of your loyal fubjects, hath been graciously pleafed to give your Royal attention, to the reprefentations which have been made relative to the faid common Gaols, and to appropriate in the City of Quebec, a lot of land belonging to your Majefty, for the fcite of the faid common Gaol for the District of Quebec : and in the City of Montreal, a certain other lot of Land, belonging alfo to your Majefty, for the fcite of the laid common Gaol for the said District of Montreal, May it therefore pleafe Your Majefty that it may be enacted, and be it enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower Canada, constituted and affembled by virtue of and under the authority of an A&t paffed in the Parlia ment of Great Britain, intituled, "An Act to repeal certain parts of an Act paffed "in the fourteenth year of his Majefty's Reign, intituled, " An Act for making "more effectual provifion for the Government of the Province of Quebec, in North "America," and to make further provifion for the Government of the faid Pro"vince;" And it is hereby enacted by the authority aforefaid, that it fhall and may be lawful, to and for the Governor, Lieutenant Governor or the Perfon adminif tering the Government of this Province for the time being, by an Inftrument under his Hand and Seal at arms, to appoint, in each of the faid Diftricts of Quebec and Montreal, respectively, three perfons, to be Commiffioners for erecting the common Gaols to be erected in purfuance of this Act, in each of the faid Districts, respectively; and a person, to act as Treasurer and Clerk to the faid Commiffioners in each of the faid Diftricts, refpectively, with a fixed falary, to remove from time to time, the faid Commiffioners, Treasurer, and Secretary, or any of them, and to appoint others, in the place and ftead of fuch as fhall be removed, or fhall die, or refign their trust.

ATTENDU que les Prifons communes actuelles des Districts de Québec et

de Montréal ne font point affez fpacieuses, et ne font point à d'autres égards bien adaptées pour recevoir et détenir en fûreté les Prifoniers, de manière qu'une nouvelle Prifon commune pour le Diftrict de Québec, et une nouvelle Prifon commune pour le Diftri de Montréal font indifpenfablement néceffaires; Et attendu qu'il a plu gracieufement à Votre Majefté, par Votre égard Paternel pour le Bien-être de vos Loyaux Sujets, de donner Votre attention Royale aux Repréfentations qui ont été faites concernant les dites Prifons, et d'approprier un terrein dans la Cité de Québec appartenant à Votre Majefté, pour la place de la dite Prifon commune du Diftrict de Québec, et un certain autre Terrein dans la Cité de Montréal appartenant auffi à Votre Majefté, pour y placer la dite Prifon com. mune du dit District de Montréal: Qu'il plaife donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du BasCanada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, “ Acté qui rappelle certaines parties d'un Acte paffé dans la quatorzième Année du Règne de Sa préfente Majefté," inti"tulé, "Acte "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province "de Québec dans l'Amérique Septentrionale;" et qui pourvoit plus amplement pour "le Gouvernement de la dite Province;" Et il eft par le préfent ftatué par l'au torité fufdite, qu'il fera loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'administration du Gouvernement de cette Province, pour le tems d'alors, d'appointer par Commiffion fous fon Seing et le Sceau de fes Armes, dans chacun des dits Districts de Québec et Montréal refpectivement, trois perfonnes comme Commiffaires pour ériger les Prifons communes qui doivent être érigées en conféquence de cet Acte, dans chacun des dits Districts refpe&ivement, et une perfonne pour agir comme Tréforier et Greffier des dites Commiffions dans chacun des dits Diftricts refpectivement, avec un Salaire fixe, de démettre, de tems à autre, les dits Commiffaires, Tréforier et Greffier, ou quelqu'un d'eux, et d'en nommer d'autres en la place de ceux qui feront démis, ou qui décèderont ou qui réfigneront leur charge.

Provided always, that the fum to be expended by virtue of this Act, in and about the building of a common Gaol ia tbe faid Diftrict of Quebec, fhall not exceed Nine Thousand Pounds Current money of this Province; and that the fum to be expended by virtue of this Act, in and about the building of a common Gaol in the faid District of Montreal, shall Not to exceed not exceed Nine Thousand Pounds Current money, aforefaid, to which said sums, the faid Commiffioners in each of the faid Diftricts refpectively, are hereby expressly limited and restrained.

III And be it further enacted by the authority aforefaid, that before the building of the faid common Gaols fhall be commenced, the faid Commiffioners or any two of them in each of the said Districts, respectively, shall and they are hereby direc ted, to cause a plan of the faid Gaols refpectively, with an estimate of the expence of erecting the fame to be made, which plan and Eftimate fhall by the faid Commiffioners or any two of them, in each of the faid Diftricts refpectively, be laid before and approved of by the Governor, Lieutenant Governor or perfon adminis tering the Government of the Province for the time being and after fuch approbation, it fhall and may be lawful for the faid Commiffioners or any two of them in each of the faid Diftricts refpectively, from time to time, to agree by contract or contracts, in writing, or otherwife in their difcretion, with any person or perfons, as well for conducting and infpecting the works, as for providing materials and hiring workmen, and labourers and for the building of the faid common Gaols in each of the faid Diftricts refpectively, or for the building of fuch part or parts of fuch common Gaols as, and for which they the said Commiffioners, or any two of them, in each of the faid Diftricts refpectively, fhall think expedient, to connotice being first tract or agree. Provided always, that previous to making any contract or contracts in writing, fourteen days notice at least shall be given in one or more of the public News Papers, printed within the said Districts refpectively, expreffing the object and intention of fuch contracts, and the time and place for receiving proposals for the fame.

IV. And be it further enacted by the authority aforefaid, that the faid ComGovernor for the miffioners, in each of the faid Diftricts refpectively, from time to time, when expenditure of thereunto required, fhall account to the Governor, Lieutenant Governor or perthe money advan- fon adminiftering the Government of this Province for the time being, for the application and expenditure of all and every the fum or fums of money to be advanced to them, and diftributed by them, in the erection and finishing the faid Gaols, in fuch manner and form, as the Governor, Lieutenant Governor, or the person adminiftering the Government of this Province for the time being, fhall appoint and direct.
