exceeded or fallen fhort of the faid clear profit of twelve Pounds, per centum; but in no cafe fhall the Tolls or Ferriages fo augmented, exceed the rates of Toll and Ferriage refpectively authorised to be taken by this Act; and the said Corporation or Society, their fucceffors and affigns, fhall not demand or take, or be entitled to receive, after the time aforefaid, any greater or higher rates of Toll or Ferriage than in the faid reduced or augmented proportions, fo fixed by the faid Justices as afore◄ faid; any thing in this Act contained to the contrary notwithstanding.

XXVI. And in order to ascertain from time to time the clear profits arising from the faid Road or Bridges or Ferry over the River Richelieu. Be it further enacted the Road, Bridges by the authority aforelaid, that fo foon as the Road fhall be made and compleated as far as Pike River, and a Bridge built over that River, a true and exa& account, fhall be made out of all the monies which fhall have been expended in making and compleating fuch part of the Road and fuch Bridge, as alfo the Toll Houfe and Turnpike Gate thereunto belonging, and of all expences of management, which to that time, fhall have been incurred on account of the fame; and in which account Thall be charged intereft on fuch monies refpectively, from the time of payment, thereof, to the time of fo making up the account at the rate of fix per centum per annum, which account fo made out fhall be dated, and then certified by at leaft three of the Proprietors, who fhall have been appointed by the Corporation to direct or fuperintend the making of the Road, and by their Clerk, who respectively fhall make oath, before one of His Majefty's Juftices of the Peace for the Distric of Montreal, that fuch account is faithfully extracted from the Books of the Corporation, and to the best of their knowledge and belief is juft and true, (which oath the faid Justice as well as in the cafes aftermentioned, is hereby authorised and required to adminifter to each of them) and when the continuation of the faid Road to the River Richelieu, fhall be compleated and the Ferry over the fame established, a like account of monies expended thereon including the expences of management and coft of Ferry boats, Scows and Canoes, fhall be in like manner made out, dated, certified and fworn to as above, and when a Bridge, over the River Richelieu fhall be built, or when the fame, or the other Bridge fhall be carried away or destroyed, and rebuilt, a like account refpecting the fame, fhall be made out, dated, certified and fworn to as above, and fuch accounts when fo made out, certified and fworn to, Thall refpectively be deposited amongst the Records of the Court of Quarter Seffions for the District of Montreal, and the amount thereof fhall be confidered as the Ca. pital Stock of the faid Corporation, and on which the profits allowed to the fame, are to be estimated as herein before mentioned, and there fhall afterwards, at the end of every year, after the completion of the faid Road and Bridges or establish. ment of faid Ferry over the River Richelieu, be made out a true and exact account of the monies expended in repairing the fame, and the Toll Houses and Gates, with the charges of management, and also, a true and exact account of all the monies collected or received from Tolls and Ferriages by virtue of this Act, which annual account, fhall be dated, certified, sworn to and depofited as above required; and if

XXVI. Et afin de conftater, de tems en tems, les profits nets provenant des dits Manière de confChemins et Ponts ou Paffage fur la Rivière Richelieu : Qu'il foit de plus ftatué par l'autorité fufdite, qu'auffitôt que le chemin fera fait et parfait auffi loin que la rivière au Brochet, et un Pont bâti fur cette rivière, il fera fait un compte fidèle et exact de tous les argents qui auront été dépensés pour faire et complêter telle partie du Chemin et tel Pont, ainfi que la maison de péage et Barrière y -appartenantes, ́et de tous les frais pour conduire les travaux qui auront été encourrus pour cet objet, jufqu'à ce tems, et dans lequel compte fera chargé l'intérêt fur tels argents refpecti vement, du tems du payement d'iceux jufqu'au tems de faire tel compte, à raison de fix par cent par année, lequel compte ainfi fait fera daté, et alors certifié par au moins trois des propriétaires qui auront été nommés par la Corporation, pour conduire ou furveiller à faire faire le chemin, et par leur Greffier, lefquels refpectivement prêteront ferment devant un des Juges de Paix de Sa Majefté pour le District de Montréal, que tel compte eft fidèlement extrait des livres de la Corporation, et au meilleur de leur connoiffance eft jufte et véritable, lequel ferment les dits Juges de Paix (ainfi que dans les cas ci-après mentionnés) font par le présent autorisés et requis d'adminiftrer à chacun d'eux: Et lorfque la continuation du dit Chemin jufqu'à la rivière Richelieu aura été achevée, et le paffage fur icelle établi, il fera fait de la même manière un pareil compte des argents y dépenfés, compris les dépenses de la geftion et les frais des batcaux, bacs et canots, lequel fera daté, certifié et affermenté comme ci-deffus: Et lorfqu'un Pont fur la rivière Richelieu fera bâti, ou lorfque le dit Pont ou tout autre Pont fera emporté ou détruit et rebâti, il fera fait à cet égard un femblable compte qui fera daté, certifié et affermenté comme ci-deffus: Et tels comptes lorfqu'ainfi faits, certifiés et affermentés feront refpective. ment déposés parmi les Archives de la Cour de Seffions de Quartier pour le Diftri& de Montréal, et le montant d'iceux fera confidéré comme le capital ou fonds de la dite Corporation, et fur lequel devront être eftimés les profits qui lui feront alloués comme ci-dessus mentionné: Et il fera fait enfuite, à la fin de chaque année, après que les dits Chemins et Ponts auront été achevés, ou le dit paffage établi fur la rivière Richelieu, un compte fidèle et exacte des argents dépensés à les réparer, ainsi que les maisors de péage et barrieres avec les frais de geftion, et auffi un compte fidèle et exact de tous les argents recueillis ou reçus par les péages et droits de paffage en vertu de cet Acte, lequel compte annuel fera daté, certifié, affermenté et déposé comme ci-dessus requis; et fi tels comptes ne font pas ainfi faits, datés, certifiés, affermentés et dépolés comme fufdit, la dite Corporation encourra et payera la

fuch accounts fhall not be fo made out, dated, certified, fworn to and depofited as abovesaid, the said Corporation fhall forfeit and pay, the fum of fifty Pounds, for every month that the fame fhall be refused or neglected, after being thereunto required by any of His Majefty's Juftices of the Peace for the District abovefaid, to be recovered by action of debt, in any Court competent to decide thereon, and paid to the Perfon who fhall fue for the fame; and if any perfon fworn as abovesaid, who fhall wilfully, or corruptly fwear, falfely, every fuch perfon, being thereof duly convicted, fhall fuffer the punishment inflicted by law for Perjury.

XXVII. And be it further enacted by the authority aforefaid, that this A&t fhall not have effect, nor fhall the faid Road and Bridges, or any part thereof be made, erected or built, until authority fhall be given, by the Governor, Lieutenant Governor or Perfon administering the Government of this Province for the time being, by an inftrument in writing, under his hand and feal at arms, to the Corporation herein before conftituted, and fuch Corporation fhall be held and bound to make, erect and compleat the fame within five years, from the date of fuch authority, fo to be given in the manner herein before prefcribed, under the pains and penalties hereby impofed and laid.

XXVIII. And be it further enacted by the authority aforefaid, that no fuit or action fhall be commenced or brought against any perfon offending against this A&, unless the fame fhall be commenced or brought within three Calendar Months next after the offence committed, and not afterwards.

XXIX. And be it further enacted by the authority aforefaid, that this A&t fhal be deemed a Public Act, and shall be judicially taken notice of as fuch by all Judges, Juftices and other perfons whomfoever, without being specially pleaded.

CAP. XXXIV.

AN ACT for repairing and ameliorating the ancient Castle of Saint
Lewis.

(14th April, 1808.)

WHEREAS the ancient Castle of Saint Lewis, in the City of Quebec, in this

Province, which hath at all times been the refidence of the Governors of this Province, is much decayed; May it therefore please Your Majefty that it may be enacted, and be it enacted by the King's Moft Excellent Majefty, by and with the ad

Et qu'il foit de plus ftatué par l'autorité fufdite, que cet Acte n'aura point effet, et le dit Chemin et les dits Ponts, ou aucune partie d'iceux, ne feront faits, érigés ou bâtis jusqu'à ce qu'il foit donné une autorité par le Gouverneur, Lieutenant Gouverneur, ou la perfonne ayant l'adminiftration du Gouvernement de cette Province pour le tems d'alors, par un inftrument ou écrit, fous fon Seing et le Sceau de fes armes, à la Corporation ci-deffus conftituée, et telle Corporation fera tenue et obligée à ériger et complêter les dits Chemins et Ponts fous cinq années de la date de telle autorité qui fera ainfi donnée en la manière ci-deffus prefcrite, fous les peines et pénalités impofées par le préfent Acte.

XXVIII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucune poursuite ou action ne fera commencée ou intentée contre aucune personne contrevenant à cet Acte, à moins qu'elle ne foit commencée ou intentée dans trois mois de Calendrier après la contravention commise, et non après.

XXIX. Et qu'il foit de plus ftatué par l'autorité fufdite, que cet A&te fera jugé A&te public, être un Acte public, et que, comme tel, il en fera judiciairement pris connoiffance par tous Juge ou Juges de Paix et autres perfonnes quelconqnes, fans qu'il foit ipécialement plaidé.

vice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an A& paffed in the Parliament of Great Britain, intituled, " An A&t to repeal certain 66 parts of an A&t paffed in the fourteenth year of His Majefty's reign," intituled, "An A&t for making more effectual provifion for the Government of the Province of "Quebec in North America; and to make further provifion for the Government £7000 granted of the faid Province; And it is hereby enacted by the authority of the fame, that out of all or any of the Revenues of this Province arifing or to arife, and which have or fhall come to the hands of the Receiver General of this Province, there shall and may be used and applied to the reparation and amelioration of the ancient Caftle of Saint Lewis, in the City of Quebec, in this Province, any sum or sumsof money, not exceeding in the whole, the fum of seven thousand pounds current money of this Province, which faid fum of feven thousand Pounds fhall be paid to fuch perfon or perfons, at fuch time and times, and in fuch proportions, respectively, as the Gouernor, Lieutenant Goeernor or perfon adminiftering the Government of this Province for the time being, by warrant or warrants under his hand, fhall direct, limit and appoint.

And be it further enacted by the authority aföresaid, that, from and after the faid firft of June, any Act or writing whatsoever, bearing date after the faid first day of June, and during the continuance of the Tax hereby impofed, which fhall be executed in this Province, and purport to be a Contract or Deed, whereby any real or immoveable property of any defcription whatsoever,, or the ufufruct or ene
