His Majefty's Court of General Quarter Seffions of the Peace, in and for the faid Diftrict of Montreal, be afcertained to be impaffable or unfafe, and notice thereof to him or them, by the faid Court given, to cause the same to be rebuilt or repaired and made fafe and commodious, for the paffage of Travellers, Cattle and Carriages; Penalty if not and if within the time laft mentioned, the faid Bridge be not fo repaired or rebuilt, as completed. the cafe may require, then the said Bridge, or fuch part or parts thereof, as shall be remaining, fhall be, and be taken and confidered to be the property of His Majefty; and after fuch default to repair or rebuild the faid Bridge, the faid Thomas Porteous, his heirs, executors, curators or affigns, fhall ceafe to have any right, title or claim of, in, to, or out of the faid Bridge, or the remaining parts thereof, and the Tolls hereby granted, and his and their right in the premifes, fhall be wholly and for ever de. termined. Provided always, that before the faid default is incurred, and during the interval hereby allowed for the repairing or rebuilding of the faid Bridge, it shall and may be lawful for the faid Thomas Porteous, his heirs, executors, curators or affigns, and he and they is, and are hereby authorised and obliged to provide proper and convenient Ferry Boats or Scows, for the paffage of Travellers, Cattle and Carriages over the faid River, as near to the faid Bridge as conveniently as may be, and to demand, collect and receive, for the paffage of fuch Travellers, Cattle and And to take the Carriages over the faid River, in the faid Ferry Boats or Scows, before they relpec tively fhall be permitted to pass, the like Tolis as are hereby authorised to be taken, for paffing over the faid Bridges, any thing herein before contained to the contrary notwithstanding.

X. And be it further enacted by the authority aforefaid, that the penalties hereby inflicted, fhall, upon proof of the offences refpe&tively, before any or more of the Juftices of the Peace, for the District of Montreal, either by confeffion of the of fender, or by the oath of one or more credible witnefs or witneffes, (which oath fuch Justice is hereby empowered and required to adminifter,) be levied by diftrefs and fale of the goods and chattels of fuch offender, by warrant, figned by fuch Juftice or Juftices; and the overplus, after fuch penalties and the charges of fuch diftress and fale are deducted, thall be returned, upon demand, to the owners of fuch goods and chattels, one half of which penalties, refpectively, when paid or levied, fhall belong to His Majefty, and the other half to the perfon fuing for the fame.

XI. And be it further enacted by the authority aforefaid, that the money to be levied by virtue of this Act, and not herein before granted to the faid Thomas Por. teous, his heirs and affigns, and the feveral fines and penalties hereby infl.cted, fhil be, and the fame are hereby granted and referved to His Majefty, his Heirs, and Succeffors, for the public ufes of this Provinces, and the Government thereof, in manner herein before fet forth and contained; and the due application of fuch mo• ney, fines and penalties, fhall be accounted for to His Majefty, his Heirs and Suc ceffors, in fuch manner and form, as he or thev fhall direct, through the Lords Commiffioners of His Majefty's Treasury; for the time being..

XI. AN ACT more effectually to provide for the making, altering and repairing the Highways and Bridges, within the Inferior Diftrict of Gaspé, and to repeal fo much of an Act, paffed in the thirty-fixth year of His Majefty's Reign, intituled, " An Act for making, repairing and altering "the Highways and Bridges within this Province, and for other purpofes as regards the faid Inferior District.

HEREAS that part of an Act, made and paffed in the Legislature of this Province, in the thirty-fixth year of His prefent Majefly's Reign, intituled, 36 Geo.III, Cap. An Act for making, repairing and altering the Highways and Bridges within this "Province, and for other purpofes," which provides for the Highways and Bridge in the Inferior District of Gafpé, has, from experience, been found insufficient; it order therefore to facilitate the making, repairing and altering of the faid Highways and Bridges within the faid Inferior Diftrict: Be it enacted by the King's Moft Excellent Majefly, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an Act, paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act, paffed in the four"teenth year of His Majefty's Reign, intituled, " An Act for making more effectual "provifion for the Government of the Province of Quebec, in North America ;" and "to make further provifion for the Government of the faid Province;" And it is hereby enacted by the laid authority, that fo much of the aforefaid Act, of the thirty-fixth of His prefent Majefty, as is contained in the thirty-fifth clause thereof, and which authorifes the Judge of the Provincial Court of Gaspé, with three Jus tices of the Peace and the Grand Voyer for the faid Inferior Diftrict of Gaspé, to make and conclude, in their difcretion, Bye Laws and Regulations for laying out, making and repairing Highways and Bridges within the fame, and which directs, that no perfon fhall be obliged to contribute more than twelve days labour, in any year, towards the making and repairing of Highways and Bridges, which fhall be neceffary to be made by joint labour; and every matter and thing in the faid Claufe contained be and the fame are hereby repealed, and that, from and after the paffing of this Act, all and every the regulations and provifions in and by the faid in part

recited A&t made for the making, repairing and altering the Highways and Bridges in the several Country Parishes, Seigniories and Townships within this Province, and the powers and duties thereby given and prescribed to and for the Grand Voyer, or his Deputy, and also, the nomination, powers and duties of Surveyors and Overfeers of Roads and Bridges, be, and the fame are hereby extended to the several Parishes, Seigniories and Townships within the faid Inferior District of Gaspé, in in as full and ample a manner, as if the faid inferior Diftrict had been therein fpe. cially named and expreffed, and under the fame pains, penalties and forfeitures imposed by the faid Act, to be fued for, recovered and applied, as by the faid A&t is directed, in fo far as the fame may not be herein after particularly expreffed and declared.

II. And be it further enacted by the authority aforefaid, that the ratification of all Procès Verbaux to be hereafter drawn up and made by the Grand Voyer of the faid inferior Diftrict of Gafpé or his Deputy, fhall be profecuted by the faid Grand Voyer or his Deputy, before the Juftices in their General Seffions of the Peace held in and for the faid Inferior District of Gafpé, at the feveral places, and in the manner herein after mentioned; that is to fay; at Carleton, in the Bay of Chaleurs, where the Procès Verbal may concern any Highway or Bridge within that part of the faid Inferior Diftrict, to the Weftward of the great River Calcapedia; at Bonaventure, in the Bay of Chaleurs; where the Procès Verbal may concern any Highway or Bridge within that part of the faid Inferior Diftrict, extending from the Eaft fide of the faid Great River Cafcapedia, as far down in the faid Bay of Chaleurs as the Weft fide of Point Mackarel; and at Percé, where the fame may concern any Highway or Bridge within that part of the faid Inferior District, to the Eastward and North. ward of Point Mackarel aforefaid; and on the Coaft of the River Saint Lawrence, as far as the faid inferior Diftrict extends; and all offences committed againft the aforefaid Act of the thirty-fixth of His prefent Majefty, within the faid Inferior Diftrict, fhall be profecuted and fued for in the relpective limits aforefaid, in which the offender or offenders may refide, and not elsewhere, and the faid General Selfions of the peace, for the faid inferior Diftrict, fhall have the fame jurifdiction, powers and authority as in and by the faid Act are given and granted to the Courts of General Quarter Seffions of the Peace, in the other Districts of this Province, re lative to the country parishes..

III. And be it further enacted by the authority aforefaid, that the Grand Voyer or his Deputy for the faid inferior Diftrict of Gafpé, fhall make his annual circuit, through the highways within the fame, in the manner and for the purposes prefcribed and declared by the faid Act of the thirty fixth of His prefent Majefty, to and for the Grand Voyers of the feveral Diftricts of this Province, the faid circuit to be made at the times and in the manner following; that is to fay; between the twentieth day of May and the twenty fifth day of July, he fhall travel over and vifit the
