An Act to establish a Toll or Turnpike, for improving and repairing the [25th March, 1805.] WHEREAS a Road from the City of Montreal to La Chine through the Wood, for the convenience of the mercantile tranfport to and from the Province of Upper Canada in particular, and in general, that of the inhabitants refiding beyond the first mentioned place, has been made at a heavy expence, the greater part whereof was defrayed by a voluntary fubfcription; and experience having fhewn, that the means already provided by Law, are either infufficient for the further improvement and repairs of the faid Road, or if exacted, would in many cafes be oppreffive, and that the fame cannot be effected without permanent pecuniary funds, for the fupply of which, nothing can be fo equitable and proper, as a Toll upon the Carriages and Horfes which may pass through that great thourough fare. May it therefore please Your Majefty that it may be it enacted, and be enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legisla tive Council and Affembly, of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an A&t paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A&t paffed in the fourteenth year of His Majesty's Reign, intituled, " An A&t for making more effectual provifion for the Government of the Province of Quebec in North America," and to "make further provifion for the government of the faid Province;" and it is hereby enacted by the authority of the fame, that it fhall and may be lawful to and for the Governor, Lieutenant Governor, or Person adminiftering the Government of this Province, for the time being, to nominate and appoint nine persons, who, with every person who has contributed or who fhall contribute Ten Pounds current money of this Province, or upwards towards, improving and repairing the faid Road, shall be and are hereby appointed and conftituted Trustees, for improving, ordering and keeping in repair the faid Road. 66 66 II. And be it further enacted that upon the death or refignation of any one or powered to ap- more of the nine perfons who fhall be appointed, as aforefaid, to act as Trustees, point other Trus- it fhall and may be lawful to and for the Governor, Lieutenant Governor, or Perof thofe that die fon administering the Government, to nominate and appoint in the room of the or refign their Trustee, or Trustees fo deceased or refigning, fome other fit and proper person or perfons to be joined with the furviving Trustees, in the execution of all and every the powers and Trufts in them and the other Trustees, appointed, in Virtue of their faid contributions by this A&t vested and reposed; and all and every Person or Persons so appointed, in the Room of a Trustee or Trustees fo deceased, or re. ATTENDU qu'un Chemin entre la Cité de Montréal et La Chine, à travers le Bois, pour faciliter le Tranfport des Marchandifes, particulièrement celles qui font dans la Province du Haut-Canada, ou qui en defcendent, et pour la commodité en général des Habitans qui résident au delà de la première place mentionée, a été fait à de gros frais dont la plus grande partie a été défrayée par une foufcription volontaire ; et comme l'expérience a démontré que les moyens déjà pourvus par la Loi sont, ou insuffisans pour faire de nouvelles améliorations et réparations au dit Chemin, ou qu'en les exigeant, elles feroient oppreffives en bien des rencontres, et qu'on ne peut les effectuer fans un fonds pécuniare permanent pour fubvenir, auquel rien ne fauroit être fi équitable et fi convenable qu'un péage fur les Voitures et Chevaux qui peuvent paffer par cette grande route de communication: Qu'il plaife donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la Très Excellente Majefte du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte du Parlement de la Grande-Bretagne, intitulé," A&e "qui rappelle certaines parties d'un Acte paflé dans la quatorzième Année du "Règne de Sa Majefté, intitulé, "Ate qui pourvoit plus efficacement pour le Gouver "nement de la Province de Québec dans l'Amérique Septentrionale; et qui pourvoit "plus an.plement pour le Gouvernement de la dite Province;" Et il eft par le présent ftatué par l'autorité fufdite, Qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'administration du Gouver nement de cette Province pour le tems d'alors, de nommer et appointer neuf perfonnes qui, avec chaque perfonne qui a contribué ou qui contribuera dix Livres, Argent courant de cette Province ou audeffus, pour améliorer et réparer le dit Chemin, feront comme elles font par le préfent nommées et conftituées Syndics pour l'amélioration, conduite et entretien du dit Chemin. And be it further enacted, that the faid Trustees or Survivors of them or any three or more of them, at the firft General meeting of the Trustees aforesaid, to be held at the City of Montreal, on the first Monday in May, One Thousand eight Hundred and Five, or at any of their other meetings as herein after authorised, fhall and may erect or caufe to be erected, a Gate or Turnpike, on or across the faid Highway or Road, and may alfo erect or build, or leafe or otherwise agree for a Toll Houfe, at fuch place as fhall be fixed by the faid Trustees, or any three or more of them, at a general meeting, and may cause the faid Turnpike or the faid Toll House to be, from time to time, if need be, taken down, removed or altered as they or any three or more of them, at fuch meeting, fhall judge proper, and may demand, take and receive the Tolls and Rates following, before any faddle Horse, Mare or Gelding, or any Waggon, Wain Cart or other fuch Carriage or any Coach, Chariot, Landau, Chaise, Phaeton, Gig, Calafh, Chair or other fuch wheel Carriage be permitted, (as after mentioned) to pafs through the faid Gate or Turnpike, that is to fay: For every Horfe, Mare or Gelding with a Rider, the fum of Four pence currency. For every Waggon, Wain Cart or other fuch wheel Carriage, (unless the fame be exempted in manner after mentioned) drawn by one or two Horfes, Oxen or other Beast of draught, if the fame be loaded in wholeor in part, and ifthe wheels thereof fhall have fellies of the breadth of five inches English measure, (taken from the outfide to the outfide, of the iron or irons furrounding or fhoeing the faid fellies, or if not fhoed, then to be measured across fuch part of the said fellies as shall be on a line or flat furface,) the fum of Eight Pence currency, or if the fellies fhall be of a leffer breadth, when fo measured, the fum of Twelve Pence currency: and further for any additional number of Horfes or Beasts of draught by which they are drawn, Four Pence currency, each. For every Coach Chariot, Landau, Chaife, Phaeton, Gig, Calafh, Chair, or other fuch wheel Carriage drawn by two Horfes, Mares or Geldings, the fum of Twelve Pence currency, and further, for any additional number by which they are drawn, Four Pence currency, each. For every wheel Carriage of any fuch laft-mentioned defcription, drawn by one Horfe, Mare or Gelding, the fum of Eight Pence currency. And fuch Tolls and Rates, printed or written, fhall be pofted up at each Toll Gate, in fuch fituation and manner as to be diftinct and visible to perfons paffing the fame. Exemption in certain cafes, IV. Provided always, and it is further enacted, that no Cart or other wheel Carriage of any defcription, going to market on any Tuesday, Thurfday or Friday, along any part of the faid Road, with the produce of the farm or ground of the perfon to whom fuch Cart or Carriage belongs, nor in returning from market on any of auront réligné, auront le même pouvoir et la même autorité que s'ils euffent été originairement nommés Syndic ou Syndics pour mettre cet Acte en exécution. Et qu'il foit de plus ftatué par l'autorité fufdite, que les dits Syndics ou leurs Survivans, ou trois ou plus d'entr'eux, à la première affemblée générale des Syndics fufdits qui fera tenue dans la Cité de Montréal le premier Lundi de Mai, Mil huit cent cinq, ou à quelqu'autres de leurs affemblées, tel que ci-après autorifé, pourront ériger ou faire ériger une Barrière ou Tourniquet fur ou à travers le dit Chemin, et pourront auffi ériger et bâtir ou affermer, ou autrement entrer en marché pour une Maifon de Péage en tel lieu qui fera fixé par les dits Syndics, ou trois ou plus d'entr'eux, à une Affemblée générale, et pourront, de tems à autre, fi befoin eft, faire abattre, enlever ou changer la dite Barrière ou Tourniquet, ou la dite Maifon de Péage, ainfi qu'eux ou trois ou plus d'entr'eux le jugeront convenable dans telle Affemblée, et pourront demander et recevoir les Péages et Taux fuivans avant qu'aucun Cheval de Selle, Jument ou autre Cheval ou aucun Chariot, Charette ou autre femblable voiture, ou aucun Caroffe, Char, Landau, Chaise, Phaeton, Cabriolet, Calèche ou toute autre femblable voiture roulante, comme ci-après mentioné, ait permiffion de paffer par la dite Barrière ou Tourniquet, c'eft-à-dire : Pour chaque Cheval ou Jument avec un Cavalier, la Somme de quatre deniers courant. Pour chaque Chariot, Charette ou autre femblable voiture roulante, à moins qu'elle n'en foit exempte en la manière ci-après mentionnée, tiré par un ou deux Chevaux, Boeufs ou autres Bêtes de Somme, fi elle eft chargée en tout ou partie, et fi les Roues ont les jantes de la largeur de cinq pouces mesure Angloife (à prendre de dehors en dehors du bandage en fer des dites jantes, ou fi elles ne font point férées, alors à mesurer à travers telle partie des dites jantes qui fera fur une ligne ou furface plate) la Somme de huit.deniers courant, ou fi les jantes ont moins de largeur lorfqu'elles feront ainfi mefurées, la Somme de douze deniers courant, et de plus pour tout nombre additionel de Chevaux ou bêtes de fomme par lequels elles feront tirées, quatre niers courant chaque. Pour chaque Caroffe, Char, Landau, Chaife, Phaëton, Cabriolet, Calèche ou autre voiture femblable roulante tiré par deux Chevaux, Juments ou autres Chevaux, la fomme de douze deniers courant, et de plus pour tout nombre additionel par lesquels ils feront tirés, quatre deniers courant chaque; Pour chaque voiture roulante d'une description femblable à la dernière mentionée, tirée par un Cheval ou Jument, la Somme de huit deniers courant ; Et tels Péages et Taux imprimés ou écrits feront affichés à chaque Barrière de péage er tel endroit et de telle manière qu'ils puiffent être vus diftinctement des perfonnes qui y pafferont. de Les Syndice pourront ériger une Barrière ou tir une Mailon de péage, et exiger et recevoir des Taux et Péages pour tout Cheval de felle qui paffera par telle Barrière. Les Taux. certains cas, IV. Pourvu toujours, et qu'il foit de plus ftatué par l'autorité fufdite, qu'au- Exemptions dans cune Charette ou autre voiture roulante de quelque defcription qu'elle foit, allant au Marché un Mardı, Jeudi ou Vendredi, le long d'aucune partie du dit Chemin, avec le produit de la Ferme ou Terre de la perfonne à qui telle Charette ou Voiture appartient, of the faid days, with any thing for his or her own proper or family use, shall be chargeable with the faid Toll or Rate, nor fhall any firewood nor any stone, gravel or other materials for repairing of the faid Road, nor any dung or other manure for land in whatever carriage the fame may be, nor any Horfe or Carriage employed in conveying a mail or letters, under the authority of his Majefty's Poft Office, nor for the Horfes or neceflary Carriages attending Officers and Soldiers of his Majefty's Forces, whilft upon their march or upon duty, nor Carriages fent with Prisoners of any description, be chargeable, with any Toll or Rate, whatfo ever, Trustees may erect more than one Gate or Turn pike. Perfons not fub ject to thro' all the G than is chargea ble for paffing one Gate, V. And be it further enacted, that in cafe the Trustees or any three or more of them, at a general meeting, fhall, after twelve months experience, think it likely to benefit the Tolls and Rates, (the charges of collection confidered,) that more than one Gate or Turnpike should be erected, then and in such case they are hereby authorised to erect the fame in the fituation or fituations that they shall think moft fit. Provided always, that no perfon fhall thereby be subjected to the payment of a greater Toll or Rate in the whole between Montreal and La Chine, if going through all the Gates in one day, than by this A&t is chargeable, if there fhall be but one Gate, and the Regulations in other refpects regarding one Gate as hereby established, fhall, in like manner, extend to the whole, but the whole Toll shall be payable at the Gate firft paffed through, and no abatement or return of Tolls fhall be made by reasons of not proceeding through more than one Gate. Money raised and the Gates, &c. vefted in the Trustees, Trustees may tor and Treasurer and Overfeer. VI. And be it further enacted, that the money fo to be raised and collected as aforesaid, together with the faid Gates or Turnpikes, and the Toll Houses, thall be and are hereby vefted in the faid Trustees, and the faid money, and every part thereof, fhall be paid and applied to and for the ufes and purposes by this Act directed, and it shall and may be lawful to and for the faid Trustees, or fuch perfon or perfons as they or any three or more of them, fhall, from time to time, nominate and appoint, to demand and take the Tolls and Rates hereby granted and made payable. VII. And be it further enacted, that it shall and may be lawful to and for the appoint a Collec- faid Trustees, or any three or more of them, at a general meeting affembled, to Clerk, Surveyor choose and appoint a fit perfon or perfons to be, Collector or Collectors, and fome other fit perfon to be Treasurer and Clerk to the faid Trustees, for receiving the Tolls and Rates granted and made payable by this Act, and alfo, if need be, a fit perfon, to be Surveyor and Overseer of the faid Road, and from time, to time, to remove the perfons fo appointed, or any of them, and appoint new ones in cafe of death or luch removal: and all and every perfon or perfons, who is or are or fhall |
