II. And be it further enacted by the authority aforesaid, that it shall be the duty of the Inspector at Chateauguay for the time being, to collect and receive the a Infpector to take bove faid Rates; and previous to entering upon fuch collection and receival, the faid Inspector fhall take and fubfcribe, before one of His Majefty's Justices of the Court of King's Bench. for the District of Montreal, an Oath, in the words following, and which Oath any of the Justices is hereby authorised to adminifter, videlicet. permanent fund for the improvement of the Inland Navigation of the River Saint "Lawrence," So help me God;" which Oath fhall be filed in the Office of the Prothonotary of the faid Court, and a Certificate there of, by him delivered to the faid Inspector, for which the faid Prothonotary fhall be intitled to demand and receive, two Shillings and fix Pence, current money of this Province, and no more.

III. And be it further enacted by the authority aforefaid, that the faid Inspector, at Chateauguay, fhall keep, in a Book to be by him provided for the purpose, an accurate account of all the monies from time to time, by him collected, for the rates by this Act impofed, with the refpective dates of receipt thereof; and on the first days of July, October and December, in every year, shall make out an account of all the monies fo collected by him during the period preceding fuch dates refpec tively, and fucceeding the date of the laft former account, and within one Month after the fift days of the faid Months, refpectively, shall make Oath to the truth of fuch account, before one of His Majefty's Juftices of the Peace, for the District, who is hereby authorised and required to adminifter the fame, and to certify the administration thereof upon the account to him produced; and fuch account, wh.n fo fworn to and certified, fhall, by the faid Inspector, be tranfmitted to the Secre tary of the Governor, Lieutenant Governor or perfon adminiftering the Government; and the laid Infpector fhall moreover, within one Month as aboveíard, pay over to the Receiver General of this Province, all the monies fo by him collected, fworn to and certified, excepting twelve Pence in the Pound of the amount thereof, which he is hereby authorited to retain for his pains and trouble in the collection of the fame.

IV. Provided always and it is hereby enacted, that it fhall and may be lawful for paid over to the the Governor, Lieutenant Governor, or perion adminift ring the Government of this Province, at any time or times when he fhall fee fit, to order and direct, tht the faid Infpector fhall pay over the monies by hum collected as abovefaid, (fifte taining his poundage thereon,) to the faid Commiffioners for the improvement Inland Navigation, inftead of the laid Receiver General, to be by them employ-d for the purpoíes of this Act.

B. Jure folemnellement, que fidèlement, vraiment et impartialement, "Je recueillerai les Taux impofés par un Acte de la Légiflature, intitulé, " Acte qui pourvoit à un Fonds permanent pour l'amélioration de la Navigation intérieure. "du fleuve Saint Laurent,," Ainfi Dieu me foit en aide." Le quel ferment fera enfilé dans le Bureau du Prothonotaire de la dite Cour, qui en délivrera un certificat au dit Inspecteur, pour le quel le dit Prothonotaire aura droit de demander et recevoir deux chellins et fix deniers, argent courant de cette Province, et pas plus.

III. Et qu'il foit de plus ftatué par l'autorité fus dite, que le dit Inspecteur à Chateauguay, tiendra, dans un livre, dont il fe pourvoira à cet effet, un compte exact de tous les argents par lui recueillis de tems à autre, pour les Taux impofés par cet Acte, avec les dates refpectives, et la recette d'iceux, et dreffera aux premiers jours de Juillet, Octobre et Décembre, dans chaque année, un compte de tous les argents ainfi par lui recueillis durant le tems précédent telle date refpectivement, et fuccedant la date du dernier compte, et dans un mois après les premiers jours des dits mois refpe&tivement, il fera ferment fur la vérité de tel compte devant un des Juges de Paix de fa Majefté pour le District, le quel eft par le préfent autorisé et requis de l'adminiftrer, et d'en donner un certificat fur le compte à lui produit; Et tel compte, lorsqu'ainfi affirmé et certifié, fera tranfmis par le dit Infpecteur au Sécrétaire du Gouverneur, Lieutenant Gouverneur ou de la Perfonne ayant l'adminiftration du Gouvernement; Et de plus, le dit Infpecteur payera fous un mois, comme fus-dit, au Receveur Général de cette Province, tous les argents ainfi par lui recueillis dont il aura fait ferment, et qui feront certifies, à l'exception de douze deniers par livre du montant d'iceux, qu'il eft par le prefent autorifé de retenir pour fes peines et foins dans la collection d'iceux.

V. And be it further enacted by the authority aforefaid, that the prefent Commif fioners appointed for the improvement of the faid Inland Navigation, fhall continue under this Act, to execute and perform all and every the duties to them committed, without any new appointment, and the faid Commiffioners and their fucceffors in Office, appointed as herein after mentioned, fhall have authority to employ a clerk, for keeping their accounts and paying the monies by them received and expended, in purfuance of this Act, (for whofe conduct they fhall be refponfible) and for whose fervices, an allowance fhall be made in their account of Expenditures, not exceed. ing twenty Pounds, current money of this Province, per annum.

VI. Provided always, and it is hereby enacted by the authority aforefaid, that it fhall and may be lawful for the Governor, Lieutenant Governor or person adminiftering the Government of this Province, from time to time, to remove any or all of the prefent Commiffioners, and another, or others, in his or their ftead to nominate and appoint, and every vacancy, in the Office of the faid Commiffioners, to fill up, whether fuch vacancy fhall happen by death, refignation or removal.

VII. And be it further enacted by the authority aforefaid, that all the monies, to be levied by virtue of this Act, are granted to His Majefty, His Heirs and Suc ceffors, (excepting the proportion of forfeitures allowed to Profecutors) and with the monies remaining unexpended of former grants of the Legiflature, for the like purpose, shall be iffued to the faid Commiffioners, when needful, by warrant or warrants, under the hand and feal of the Governor, Lieutenant Governor or person adminiftering the Government, directed to His Majefty's Receiver General of this Province, or by Order, as herein before mentioned, in cafes where the Inspector fhall thereby be directed to pay over the monies by him collected under this Act, -to the faid Commiffioners, and are hereby appropriated and to be applied to the improvement of the Inland Navigation of the River Saint Lawrence, between the City of Montreal and Lake Saint Francis, as well in refpect to clearing and deepening (where practicable) the Channel of the Rapids which is ufed for defcending the faid River, as in refpect to the Channel for Navigation thereof upwards, and for improving the fame by Locks, Cuts, or Towing-paths, or otherwife; as allo for repairing the works already erected or made, or to be erected or made, and the whole in fuch manner, and by fuch means, as the faid Commiffioners, or any two of them, under the controul of the Governor, Lieutenant Governor or person adminiftering the Government, as herein after prescribed, fhall be confidered moft proper and useful for effectuating the purposes abovefaid; and the due application of the faid monies, pursuant to this Act, fhall be accounted for to His Majefty, His Heirs and Succeffors through the Lords Commiffioners of His Majesty's Treasury, in fuch manner and form as His Majefty fhall direct.

V. Et qu'il foit de plus ftatué par l'autorité fufdite, que les préfents Commiffaires nommés pour l'amélioration de la dite navigation intérieure continueront, en vertu de cet Afte, à faire et exécuter tous et chacun des devoirs à eux confiés, fans aucune nouvelle nomination, et les dits Commiffaires et leurs fucceffeurs en office nommés tel que ci-après mentionnés, auront pouvoir d'employer un Commis pour tenir leurs comptes et payer les argents par eux reçus et dépensés en conformité de cet A&te, pour la conduite duquel ils feront refponfables, et pour les fervices duquel il fera fait une allouance, dans leur compte de dépenses, n'excédant point vingt livres, argent courant de cette Province, par année.

VI. Pourvu toujours, et il eft par le préfent ftatué par l'autorité fufdite, qu'il Tera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la perfonne ayant l'administration du Gouvernement de cette Province, pour le tems d'alors, de deftituer tous ou aucun des Commiffaires actuels, et d'en nommer et prépofer un autre ou d'autres à sa ou leur place, et de remplir toute place vacante dans l'office des dits Commiffaires, foit que telle place vacante arrivè par décès, résignation ou deftitution.

VII. Et qu'il foit de plus ftatué par l'autorité fufdite, que tous les argents qui fe. Tont prélevés en vertu de cet Acte, font accordés à Sa Majefté, fes Héritiers et Succeffeurs (excepté la proportion des famendes allouées aux pourfuivants) et avec les argents reftant non dépensés des dons précédents de la Légiflature pour le même objet, feront avancés aux dits Commiffaires, lorfque befoin fera, par un Warrant ou des Warrants fous le Seing et Sceau du Gouverneur, Lieutenant Gouverneur, ou de la Perfonne ayant l'administration du Gouvernement, addressé au Receveur Général de Sa Majefté, dans cette Province, ou par un ordre tel que ci-devant mentionné, dans les cas où il fera par icelui ordonné à l'Inspecteur de payer aux dits Commiffaires les argents par lui recueillis, et ils font par le préfent appropriés, et ils feront employés à l'amélioration de la navigation intérieure du fleuve Saint Laurent, entre la Cité de Montréal et le Lac Saint François, ainfi que pour nétoyer et creufer (où il eft praticable de le faire) ie chenail des rapides dont on fe fert pour defcendre le dit fleuve, ainsi qu'à l'égard du cheňail pour la navigation d'icelui en montant, et pour l'amé liorer par des éclufes, ou en ouvrant des canaux, ou par des fentiers pour tirer à la cordelle, ou autrement, et auffi pour réparer les ouvrages déjà érigés ou faits, ou qui feront érigés ou faits, et le tout en telle manière et par tels moyens que les dits Comffaires ou deux d'entr'eux, fous le contrôle du Gouverneur, Lieutenant Gouverneur ou de la Perfonne ayant l'adminiftration du Gouvernement, ainfi qu'il eft ci-après prescrit, trouveront les plus convenables et les plus utiles pour effectuer les objets iufdits; et il fera tenu compte de la due application des dits argents en conformité de ce. A&te, à Sa Majefté, fes Héritiers et Succeffeurs, par la voie des Lords Commillaires du Tréfor de Sa Majefté, en telles manière et forme que Sa Majefté l'ordonnera.

VIII. And be it further enacted by the authority aforefaid, that the faid Commiffioners, or any two of them, fhall, annually, before the commencement of their operations, tranfmit to the Governor, Lieutenant Governor or person administering. the Government, a Statement or defcription of the works which fhall, in their opinion, be proper to be executed, the feafon immediately following, with a general Eftimate of the probable expence thereof, and which being by him approved of, they shall proceed to get the fame executed, at fuch times, during fuch feafon, as they may confider most adviseable. Provided always, that in respect to repairs of works, in unforeseen cafes which may arife, and do not conveniently admit of the de lay neceffary for fuch previous approval, then they may proceed without the same, according to the beft of their judgment.

IX. And be it further enacted by the authority aforefaid, that the faid Commiffi. oners, or any two of them, fhall, annually, lay before the Governor, Lieutenant nor and Legifla Governor or Perfon adminiftering the Government of this Province, the Legisla tive Council and the Houfe of Affembly, refpectively, a. ftatement of the expendi ture of the money, by them laid out, during the preceding feason, with their ob servations in respect to the utility of the improvements then effected, and in respect to fuch further general improvements, in the Inland Navigation, as to them fhall. appear expedient and practicable, with their ideas of the probable expence thereof.

CA P. XX.

AN ACT for applying a further fum of money towards the building and compleating of a Common Gaol, for the District of Quebec.

(14th April, 1808.)

HEREAS from unforeseen expences incident to the fituation and circum ftances of the place alloted for the fcite of a Common Goal, for the District of Quebec, the fum already appropriated, by law, for the purpose of erecting the faid Common Gaol is infufficient. And whereas it appears expedient to apply a further fum, for the demolition and removal of the Old Gaol, and towards the building and compleating of the faid Common Gaol, and the appendages thereof, on fuch a plan as fhall combine therein, the advantages of fecurity, cleanliness and falubrity. May it there fore please Your Majefty that it may be enacted, and be it enacted by the King's Molt Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and aflembled by virtue of, and under the authority of an Act passed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an “Act, passed in the fourteenth year of His Majefty's reign," intituled, "An A&t for
