WHEREAS an A&t was paffed in the forty third year of his Majefty's reign, intituled, "An Act for establishing regulations refpecting Aliens and certain "Subjects of his Majefty, who have refided in France, coming into this Province or "refiding therein" which Act will expire at the end of this Seffion; And Whereas it is expedient and neceffary that the faid A&t be further continued with certain additional Clauses: Be it therefore enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the au thority of an Act paffed in the Parliament of Great Britain, intituled, "An Act to "repeal certain parts of an Act paffed in the fourteenth year of his Majefty's reign "intituled, "An Act for making more effectual provifion for the Government of the "Province of Quebec in North America:" And to make further provifion for the Go"vernment of the faid Province;" And it is hereby enacted by the authority of the fame, that the faid Act, intituled, "An Act for establishing Regulations refpecting Aliens and certain Subjects of his Majefly, who have refided in France, coming into "this Province, or refiding therein," and all matters and things in the laid Act and in des navires ou va ffeaux appartenants à Sa Majefté, continuera à être payée et fera payable au Greffier de la fufdite corporation en la manière et forme prefcrites par l'acte ci-deffus récité. Governor, &c tain Aliens,&c. perfon before whom the declaration above required fhall be made, and fuch pafs port, when given, shall specify the place to which it is meant to extend, and allow a reasonable time for fuch Alien or other perfon as aforesaid to proceed thither, who, upon his arrival there or within three hours thereafter, shall produce fuch paffport to a Justice of the Peace or to fuch other perfon as fhall be appointed for that purpose by the Governor, Lieutenant Governor or perfon adminiftering the Govern ment of this Province for the time being, and every Alien or other perfon of any fuch description as abovefaid, who fhall wilfully neglect or refufe to make declaration of the aforefaid particulars, or either of them, or who fhall knowingly make any falfe declaration ther, of, or shall other wife act contrary to any of the require. ments or obligations hereby impofed, fhall for every fuch offence, be apprehended by the warrant of any one of his Majefty's Juftices of the Peace of the District in which fuch Alien or other perfon as aforefaid fhall be found, and committed to the Gaol of fuch Diftrict, and on conviction before any two or more of his Majesty's Juftices of the Peace for any District of this Province, fhall be imprisoned for any time not exceeding one month. VI. And be it further enacted by the authority aforefaid, that it fhall and may be empowered tode lawful to and for the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, by warrant under his hand and feal issued by and with the advice of his Majefty's Executive Council, to order any Alien to be detained in custody in this Province in fuch place and in fuch manner as the Governor, Lieutenant Governor or perfon administering the Government of this Province for the time being, fhall fee fit during the continuance of this A, or until fuch Governor, Lieutenant Governor or perfon adminiftering the Govern. ment of this Province for the time being, fhall give other order to the contrary: Provided always, that no Alien fhall be fo imprisoned, unless it fhall, by the advice of the faid Executive Council, be declared in fuch warrant that it is dangerous to the fecurity of this Province to send and transport fuch Alien out of the limits thereof, Provifo.
