Preamble. CA P. VII. AN ACT for building a new Market House in the City of Montreal, for removing part of the Stalls on the old Market place, and regulating the fame, and to authorise the borrowing a certain fum of money for those pnrposes. (16th April, 1807.) WHEREAS the fquare in the City of Montreal now in use as the public Market Place, is two small in extent and otherwise inconvenient for the numerous and increasing population of the faid City, and a new fquare or space of ground has been ceded to the Magiftrates of the faid City of much greater extent and con veniency, on the condition and for the special purpose that the faid new fquare fhall be conftituted and declared a Public Market Place, in and for the faid City of Montreal; and the Magiftrates aforefaid having declared that the faid new square shall become a Public Market Place, in conformity to an Act of the thirty fixth year of His Present Majefty's reign, intituled, " An Act for making, repairing and alter ing the Highways and Bridges within this Province, and for other purpofes;" And whereas the faid Magiftrates for the conveniency of the inhabitants of the faid City, and of all other perfons reforting thereto, are defirous of erecting in the faid new fquare, a fuitable and convenient Market houfe, with Stalls for felling and expofing to fale, all kinds of butcher's, meat, for which purpose, the faid Magiftrates have by Petition to the Legislature of the Province prayed for leave to borrow a certain fum of money, to be laid out in the building of fuch Market-house, with Stal's; and further to authorise them to mortgage the rents or profits that may arife from letting out the faid Stalls, as fecurity for the principal and intereft of the money fo borrowed. May it therefore pleafe Your Majefty that it may be enacted, and be it enacted by the King's moft excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of An A&t paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of An At "paffed in the fourteenth year of His Majefty's reign, intituled, "An A&t for making "more effectual provifion for the Government of the Province of Quebec in North Ame "rica" and to make further provifion for the Government of the fand Province" City and Diftr & and it is hereby enacted by the authority of the fame, that the Magiftrates for the City and District of Montreal, or any five of them being relident within the faid City of Montreal, or the Suburbs thereof, are hereby conftituted and appointed Truflees, for the purpofe of carrying this Act into effect. And be it further enacted by the authority aforefaid, that the faid Trustees fhail meet at the Court Hoafe of Montreal aforefaid, on the first day of July next enfuing CA P. VII. Trustees empowered to borrow £2500 for erect. ing a Market. of Montreal. enfuing the paffing of this Act, then to enter upon the discharge of their duty: and it fhall and may be lawful for the faid Trustees, to caufe to be prepared and laid before them, a plan of a new Market-house with Stalls, to be erected within the faid City of Montreal, upon the new fquare or space ceded as above faid to the Magiftrates of the faid City, and the fame being approved of by the faid Trustees, they are hereby authorised to treat and contract for the building of the faid Market-House and Stalls, with fuch perfon or perfons as may be willing to undertake for the fame. Provided always, that no contract fhall be entered into by the faid Trustees, until they fhall, by advertisement, for three weeks in the Quebec Gazette, and fuch other News paper as they fhall judge expedient, have given notice, that they are ready to receive proposals in writing for the work to be performed. III. And be it further enacted by the authority aforefaid, that for defraying the expences of erecting a new, Market-Houfe with Stalls as aforefaid, it fhall and may be lawful for the faid Trustees to borrow on legal intereft, a fum of money, not house in the City exceeding two thousand five hundred Pounds currency, to be laid out in part or in whole, in the erecting a fuitable and convenient Market-Houfe with Stalls in the City of Montreal, on the new fquare aforefaid, as to them may appear neceffary. Provided always, that it fhall be lawful for the faid Truftees to lay out fo much of the faid new Market-Houfe, as to them fhall appear neceffary, for the receiving and fafe keeping of one of the Fire Engines belonging to the City of Montreal, with buckets and other implements thereunto appertaining. Provifo, intereft ofmoney borrowed, how fecured, IV. And be it further enacted by the authority aforefaid, that for furety of Principal and principal and intereft of the money fo to be borrowed, it fhall and may be lawful for the faid Traftees, and they are hereby authorifed, to pafs a deed of mortgage to the lenders of the money aforefaid, binding and hypothecating the rents or profits. to be derived from the faid new Market-House and Stalls, in manner as is herein after provided; but on no other funds rents or profits whatever fhall the lenders of the money, their Heirs, Executors, Curators or Affigns, have any lien or claim whatsoever, for or by reafon of the money they fhall have fo lent; and the holders of fuch Mortgages refpectively, may transfer the fame to fuch perfon or perfons as they may think proper, and the transferees fhall have the fame right to payment of intereft and capital, as if he or they had been the original lender or lenders of the money for which the mortgage or mortgages were granted. Provided, that such transferees fhall caufe to be notified to the Treasurer of the Trustees by leaving a copy of fuch transfer, with him, that he or they have become proprietor or proprietors of fuch mortgage or mortgages, and the faid Treasurer fhall enregifler the fame in a book to be by him kept for the purpose. Et qu'il foit de plus ftatué par l'autorité fufdite, que pour fubvenir aux dépenses d'ériger une nouvelle Halle de Marché avec des étaux comme fufdit, il fera loifible aux dits Sindics d'emprunter à un intérêt légal, une fomme d'argent n'excédant pas deux mille cinq cents livres courant, pour être employée le tout ou en partie à ériger une Halle de Marché commode et convenable avec des étaux, dans la dite Ville de Montréal fur la nouvelle place fufdite, ainfi qu'il leur paroitra nécessaire, Pourvu toujours, qu'il fera loifible aux dits Sindics d'approprier telle partie de la nouvelle Halle de Marché qu'il leur paroitra neceffaire, pour la réception et fauve garde d'une des poinpes à feu appartenantes à la Ville de Montréal, avec les fceaux et autres uftenfiles qui en dépendent. IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que pour la fûreté du capital et de l'intérêt de l'argent qui fera ainfi emprunté, il fera loifible aux dits Sindics, et ils font par le préfent autorifés de paffer contrat portant hypothêque aux prèteurs du fufdit argent, engageant et hypothêquant les rentes ou profits à être perçus de la dite nouvelle Halle de Marché et étaux, de la manière qu'il eft ci-après pourvu; mais fur aucuns autres fonds, rentes ou profits quelconques, ne pourront les prêteurs de l'argent, leurs Hoirs, Exécuteurs, Curateurs ou ayant caufe avoit aucune piétention ou droit quelconque, pour ou en considération de l'argent qu'ils auront ainfi prêté, et les propriétaires refpectifs de telles hypothèques pourront les tranfporter à telle perfonne ou perfonnes qu'ils jugeront à propos, et les perfonnes en faveur desquelles tels tranfports feront faits, auront les mêmes droits de recevoir l'intérêt et le capital, de même que s'ils étoint les prêteurs originels de l'argent pour lequel telles hypothêques auront été données, pourvu que les perfonnes ainfi propriétaires en donnent notice au Tréforier des Sindics, en lui remettant une expédition du tranfport qui les conftitue propriétaires de telles hypothêques, et le dit Trélorier eft requis d'enregistrer le dit tranfport dans un livre par lui tenu à cet effet. Truftces empow ered to let outthe Stalls. the faid Trustees fo foon as there fhall be funds in their hands for that purpose, and that the intereft of the capital fhall have been paid, to pay off the principal, which, in virtue of and for the purpose of this Act, they fhall have borrowed, and the lenders of the money aforefaid, fhall be bound to receive back the fame in fuch payments and fums of money at a time, as the faid funds may be adequate to and the Trustees fee fit. Provided always, that not lefs of the capital than ten per cent fhall be paid off in one payment, and to all of the lenders, their heirs, executors, curators and affigns, in equal proportions, but it fhall not prevent the faid Trustees from paying a greater proportion to any one or more of the lenders, provided, three fourths in value of the other lenders, their heirs, executors, curators or affigns, shall thereunto agree. VI. And be it further enacted by the authority aforefaid, that in order to provide for the repayment of capital fo to be borrowed, and of intereft thereupon arifing, it fhall and may be lawful for the Truftees aforefaid, fo foon as the faid new Market Houfe, with the Stalls or fuch part thereof as the Trustees fhall think fufficient for the purpose of felling butcher's meat, fhall be completed, to let out by the year or otherwife, the faid Stalls to fuch perfons as may be willing to hire the fame, at fuch rent, as by the Truftees and perfons hiring the fame fhall be agreed upon; or the fame may be let out by Public Auction, and the rent fo agreed upon, either by private bargain or public auction, shall be paid half yearly or otherwise as to the faid Trustees fhall feem expedient, into the hands of the Treasurer to be named and Treasurer to be appointed by the Trustees aforefaid, and they are hereby empowered to remove the faid Treasurer, and to appoint another, and from time to time, to make fuch appointment as thereafter may become neceffary by removal or by death of any Treafurer fo appointed. appointed. Trustees may let out the Stalls for other than meat. butcher's VII. And whereas it may for fome time to come be unneceffary to fill up the purpofes whole of the faid new Market houfe with Stalls for the fale of butcher's meat, and part of the Stalls which are to be erected may at times remain unlet for that purpose. Be it therefore further enacted by the authority aforefaid, that the fpace unoccupied by Stalls, as alfo any Stalls unlet for the fale of butcher's meat, may, by the Trustees aforesaid, be let out to hire for the purpose of selling and expofing to fale Grain or any other Provifions, for fuch rent, as they may deem juft and reasonable, and can agree for; and in like manner, the faid Trustees may let to hire the space under cover along the fides of the faid new Market-house, for the fale of all forts of fruit and vegetables. And be it further enacted by the authority aforefaid, that over and above Peace may allow the rent which any perfon or perfons, hiring a Stall or Stalls or other places under cover, in either of the faid Market places, are bound to pay for the fame, it fhall and |
