Limitation of Actions. General Iffue. Treble Cofts. Pounds fterling, it shall be sued for and recovered by Bill, Plaint, or Information before the Judges of His Majefty's Courts of King's Bench, and levied by execution as in cafes of debt, and one moiety of all fuch fines and forfeitures, (except fuch as are her in before, other wife applied,) when recovered, fhall be imme. diately paid into the hands of His Majefty's Receiver General, for the use of His Majefty, towards the fupport of the Government of this Province, and shall be accounted for to His Majefty through the Commiffioners of His Majefty's Treafury for the time being, in fuch manner and form, as His Majefty fhall di rect, and the other moiety to the person who fhall fue for the fame. XIX. And be it further enacted by the authority aforefaid, that if any action or fuit fhall be brought or commenced againft any perfon or perfons for any thing done in purfuance of this Act, fuch action or fuit fhall be commenced within fix months next after the matter or thing done, and not afterwards, and the defendant or defendants in fuch action or fuit, may pleadthe general iffue, and give this Act and the fpecial matter in evidence, at any trial to be had thereon, and if afterwards judgment fhall be given for the defen. dant or defendants, or the plaintiff or plaintiffs fhall be non-fuited or difcontinue his, her, or their action or fuit, after the defendant or defendants fhall have appeared, then fuch defendant or defendants fhall have treble colts awarded against fuch plaintiff or plaintiffs, and have the like remedy for the fame as any defendant or defendants hath or have in other cafes to recover cofts at Law.. HEREAS an Act was paffed in the forty third year of His Majefty's Reign, WHEREAS an Act wasfor establishing regulations respecting Aliens and certain "Subjects of His Majefty who have refided in France coming into this Province or refiding therein," which Act will expire at the end of this Seffion. And where as it is expedient and neceffary that the laid Act be continued. HEREAS in and by an Act made and passed in the forty firft year of the Reign of His prefent Majefty, intituled, "An Act for the better regula"ting the Common belonging to the Town of Three Rivers." it was amongst other A&t 41 Geo. II, cap. 11, recited. things enacted, that "it fhall and may be lawful for the inhabitants of the faid "Town or Borough of Three Rivers, to aflemble and meet on the first Monday in "the Month of April, in the year of our Lord, one thou fand eight hundred and "five, at fuch hour and place, as fhali by notice given ten days before in writing, "posted up at the doors of the different Churches in the faid Town or Borough, "be fixed on, for the choice and appointment of a Chairman and four Trustees "of the aforefaid Common, to fucceed the Chairmain and Truftces who fhall "have gone out of office, and that the inhabitants of the faid Town or Borough "then present and qualified as in the faid Act mentioned, fhall and may at such "time and place, choose and appoint as in and by the faid Act is directed a Chair"man and four Trustees of the aforefaid Common, who fhall continue in Office to "the firft Monday of April, which will be in the fourth next fucceeding year, "and that a perfon appointed by His Excellency the Governor, Lieutenant Go "vernor or perfon adminiftering the Government of this Province for the time "being, fhall prefide at fuch Affembly or meeting, and declare by writing un "der his hand and feal, who are the perfons chofen and appointed to the of "fice of Chairman and Trustees of the faid Common for the four next fucceeding years."
