towns of Marshfield, Cabot, Walden, Hardwich, Greensborough and Glover, to the town of Barton in said state.

Ordered, That the message received yesterday, communicating a report of the surveyor of the public buildings, be referred to Mr. Lewis, Mr. Stanford, Mr. Livermore, Mr. Root, and Mr. J. Brown, to consider and report thereon to the House.

The bill sent from the Senate, intitled "An act to prevent the abuse of the privileges and immunities enjoyed by foreign ministers within the United States," was read the first time.

On motion,

The said bill was read the second time, and com. mitted to a committee of the whole House, on Tuesday next.

The House proceeded to consider the resolution from the Senate, for the appointment of a joint committee to have the application of the money appropriated by the "act making a further appropriation for the support of a library," and the same being twice read at the Clerk's table, was, on the question put thereon, agreed to by the House.

Ordered, That Mr. Dana, Mr. Newton, and Mr. Seybert, be appointed of the said committee on the part of this House.

Mr. Findley, from the Committee of Elections, to whom was referred, on the fourth instant, the petition of Thomas Randolph, contesting the election of Jonathan Jennings, the delegate from the Indiana territory, made a report thereon, which was read and referred to a committee of the whole House, on Friday next.

Mr. P. B. Porter presented a petition from sundry inhabitants of Niagara, in the state of New York, whose names are thereunto subscribed, praying for the removal of the collector's office from Fort Niagara to Lewistown.

Ordered, That the said petition be referred to the Committee of Commerce and Manufactures.

A message from the Senate, by Mr. Otis, their Secretary.

Mr. Speaker: The Senate have passed the bill, entitled "An act for the relief of William and Elias Rector :" And then he withdrew.

The House, according to the order of the day, again resolved itself into a committee of the whole House, on the joint resolution from the Senate, res. pecting our foreign relations; and after some time spent therein, Mr. Speaker resumed the chair, and Mr. Bassett reported, that the committee had, according to order, again had the said resolution under consideration, and made a farther progress therein.

Resolved, That this House will, on Tuesday next, again resolve itself into a committee of the whole House, on the said resolution.

A motion was made by Mr. Smilie, and seconded, that the House do re-consider their vote for an adjournment until Tuesday next.

And the question being taken thereon,

It was determined in the negative.

The several orders of the day were farther post. poned until Tuesday next.

And then the House adjourned untill Tuesday morning, eleven o'clock.

TUESDAY, December 26, 1809.

Two other members, to wit: from Massachusetts, Benjamin Pickman, junior, and from Virginia, William A. Burwell, appeared, and took their seats in the House.

The Speaker laid before the House a letter and report of the Secretary of War, on the petition of William Law, referred to him on the eighteenth instant, which was read, and ordered to lie on the table.

Mr. Macon presented a petition of Peregrine Fitzhugh, of the Genesee country, in the state of New York, praying to be placed on the pension list of the United States, in consequence of wounds received whilst an officer of cavalry in the revolutionary army. Ordered, That the said petition be referred to the Committee of Claims.

On a motion made and leave given by the House, Mr. Johnson, from the Committee of Claims, to whom was referred the petition of sundry inhabitants of Knox county, state of Kentucky, presented, according to order, a bill for the relief of William White and others, which was received and read the first time.

On motion,

The said bill was read the second time, and committed to a committee of the whole House, on Friday

next.

Mr. Johnson, from the same committee, made a report on the petition of Ezra Thurber, which was read and referred to a committee of the whole House, on Monday next.

On a motion made and leave given by the House, Mr. Smilie, from the committee appointed on the fourteenth instant, on the petition of William Linnard, presented a bill to increase the compensation of the military agent for the middle department, which was received and read the first time.

On motion,

The said bill was read the second time, and committed to a committec of the whole House on Monday next.

Mr. Van Rensselaer presented a petition of Samuel Gordon, of the state of New York, praying that provision may be made for his maintenance in consequence of bodily injuries sustained whilst in the act of conveying the public mail between the cities of Albany and Schenectady, in the said state.

Ordered, That the said petition be referred to the post-master general, with instruction to examine the matter thereof, and report the same with his opinion thereon, to the House.

Mr. Poindexter presented a memorial of the convention of the representatives of the people residing east of Pearl river, on the waters of the Tombigbee, Alabama, Chickasawbay and Mobille rivers, in the Mississippi territory, praying that the act of Congress, appointing an additional judge in the said territory, for the Washington district, may be repealed, and that a division of the said territory may be made, under such regulations as may appear expedient and proper.

Ordered, That the said memorial be referred to the committee appointed on the sixth instant, on the petition of sundry inhabitants east of Pearl river, in the territory aforesaid.

Mr. Morrow, from the Committee on the Public Lands, presented, according to order, a bill to extend the time for locating Virginia military land warrants, and for returning the surveys thereon to the Secretary of the department of War, which was received and read the first time.

On motion,

The said bill was read the second time, and committed to a committee of the whole House, on Monday next.

Mr. P. B. Porter presented a petition of Peter Audrain, praying compensation for services rendered as clerk to the board of land commissioners in the territory of Michigan.

Ordered, That the said petition be referred to the Committee of Claims.

The House then, according to the order of the day, again resolved itself into a committee of the whole House, on the joint resolution from the Senate, respecting our foreign relations; and after some time spent therein, Mr. Speaker resumed the chair, and

WEDNESDAY, December 27, 1809.

The Speaker presented to the House a petition of Peter Landais, praying to be allowed and paid his share of prize money in three vessels captured by him, in the revolutionary war, while commander of the United States' frigate Alliance.

Ordered, That the said petition be referred to the Committee of Claims, and that the petitioner have leave to lay copies of his said petition on the tables of the members.

Mr. Burwell presented a petition of the delegates of the people of several settlements east of Pearl river, in the Mississippi territory, praying for a diviIsion of the said territory.

Ordered, That the said petition be referred to the committee appointed on the sixth instant, on the petition of sundry inhabitants of the district east of Pearl river, in the territory aforesaid.

On motion of Mr. Seybert,

Ordered, That the petition of the sugar refiners in the city of Philadelphia, presented on the thirtieth of May last, be referred to the Committee of Commerce and Manufactures.

Mr. Fisk presented a petition of Henry B. Livingston, of the state of New York, praying compensation for monies advanced, losses sustained and
