Corporation.

Be it enacted by the Governor, Council, and Assembly, as follows:

In this act unless the context otherwise requires,

(a)

"City" means the city of Glace Bay;

(b) "Council" means the city council of the city of Glace Bay;

(c) "Clerk" means the city clerk of the city of Glace Bay;

(d)

"Treasurer" means the city treasurer of the city of Glace Bay.

CORPORATION.

1. The inhabitants of the town of Glace Bay shall continue to be a body corporate and politic under the name of "The City of Glace Bay."

2. The said corporation shall have power to sue and seal. and be sued, contract and be contracted with, by their corporate name, to have a corporate seal, and to alter or change the same at pleasure, and to have a perpetual succession to acquire and hold real and personal property for the purposes for which the corporation is established, and to alienate the same at pleasure.

3. The city of Glace Bay shall be bounded as Bay. follows:-Beginning at a point where Cadegan's Brook at Bridgeport flows into the Atlantic Ocean; thence in a southerly direction and following along the windings of the said Cadegan's Brook to the centre line of Reserve Road; thence on a course of south 81° east and following along the centre line of Reserve Road a distance of 450 feet; thence on a course of south 2° east a distance of 5034 feet, more or less, to an iron post set on the centre line of old Schooner Pond Ry., said post being also on the division line between lands of Ronald McLeod and heirs of Reverend Hugh McLeod; thence in a south-easterly direction and following along said centre line of old Schooner Pond Ry. a distance of 4400 feet, more or less, to a stake; thence on a course of south 14° 30 east a distance of 7920 feet, more or less, to the northern shore of MacAskell's Brook; thence in an easterly direction and following along the northern shore line of MacAskell's Brook and Big Glace Bay Lake to the shore line of the Atlantic Ocean; thence in a northerly direction and following along the said shore line of Atlantic Ocean to the place of beginning.

4. The wards of the city of Glace Bay shall remain as at present established, and the council may, from time to time, alter the limits of any ward, increase or decrease the number of wards, but an interval of three years shall elapse between any such changes. And may make such arrangements about the representation of and elections for the said wards in the council as may be necessary. But such changes shall not interfere with the tenure of office of any alderman; and such elections shall take place at the time of the annual elections for mayor and aldermen.

5. The mayor and members of the town council of the town of Glace Bay, and the officers, by-laws, contracts, property, assets, and liabilities of the said town, shall be deemed the mayor and members of the city council, and the officers, by-laws, contracts, property, assets and liabilities of the city of Glace Bay.

6. The administration of all fiscal, prudential and in mayor and municipal affairs of the said city, with the government thereof, shall be vested in one officer, to be called the mayor, and two aldermen from each ward, to be elected as hereinafter directed, who shall in their joint capacity be denominated the city council, and the mayor and aldermen shall, upon being declared elected, be ex-officio justices of the peace for the city of Glace Bay, and have and exercise within the city of Glace Bay all the powers and duties, and enjoy all the exemptions and immunities of justices of the peace.

7. The mayor and councillors in office at the time of the passing of this act, shall be the mayor and aldermen of the city of Glace Bay, and shall hold office until their successors are elected in the manner provided by this act.

QUALIFICATIONS OF MAYOR AND Aldermen.

8. No person shall be qualified to be mayor of Glace Bay, unless,

(a) He is a British subject of twenty-one years of age or upwards; and

(b) He has been a resident and ratepayer of Glace Bay for at least three years prior to his nomination for such office; and

(c)

He is the owner of and rated in his own name upon real property worth above incumbrances and assessed at not less than fifteen hundred dollars, or the owner of and rated in his own name upon personal property worth above incumbrances and assessed at not less than two thousand dollars. or the owner of and rated in his own name upon real and personal property worth above incumbrances and assessed at not less than two thousand dollars.

9. (1) (1) No person shall be qualified to be an alder- Qualification man of Glace Bay, unless

(a) He is a British subject of twenty-one years
of age or upwards; and

(b) He has been a resident and ratepayer of
Glace Bay for at least two years prior to his
nomination for such office; and

(c) He is the owner of and rated in his own name
upon real property, worth above incumbrances
and assessed at not less than five hundred
dollars, or the owner of and rated in his own
name upon personal property worth above in-
cumbrances and assessed at not less than six
hundred dollars, or the owner of and rated in
his own name upon real and personal property
worth above incumbrances and assessed at not
less than seven hundred and fifty dollars.

(2) Every candidate for mayor or aldermen shall, at the time of filing his nomination paper with the city clerk, produce and file therewith

(a) If he qualifies in respect to his assessed
property, a certificate from the city assessor
or acting city assessor certifying the amount
he was assessed for on the 31st day of December
of the previous year;

(b) A certificate from the city collector to the
effect that he has fully paid his taxes of all kinds
of the previous year's assessment on or before
the thirty-first day of December, prior to his
said nomination;

(c) An affidavit that he is duly qualified by law
for the office of alderman or mayor, as the case
may be, as required under the provisions of
the city charter.

(3) Such affidavit shall be made and subscribed by him before a stipendiary magistrate of the city of Glace Bay, or a commissioner or barrister of the Supreme Court.

AFFIDAVIT OF QUALIFICATION.

(1) I, A. B., do swear that I am duly qualified, as required by the city charter, for the office of that I am a natural-born (or naturalized) subject of His Majesty, of the full age of twenty-one years, and have resided in and been a ratepayer of Glace Bay for at least three years before my nomination.

(2) That I am not indebted to the city of Glace Bay in any sum for taxes, either individually, or as a member of any firm or co-partnership.

(3) That I was, on the 31st day of December last past, and still am, the owner of real property within the city of Glace Bay of the assessed value of

dollars; or of real and personal property within the
city of Glace Bay of the assessed value of
dollars; or of real and personal property to the value

dollars over and above all incumbrances.

and my name appears on the assessment roll returned by the assessors on said 31st day of December, last past, as assessed for said amount.

10. (1) The mayor and aldermen before entering upon the duties of their office respectively, shall be sworn by taking and subscribing the oath of allegiance, and oath of office. These oaths shall be administered to the mayor elect by a judge of the Supreme Court or County Court, the stipendiary magistrate of the city, or any two justices of the peace. Such oaths shall
