and effectual as if the same and each of them were incorporated in and formed a part of this act. The production of a copy of said by-law, so approved, purporting to be certified under the hands of the mayor and town clerk, and the seal of the town of Dominion, shall be sufficient proof thereof in any court of justice.

37. It shall be lawful for the town council to appoint three persons, one of whom may be a member of the town council, to be called water commissioners, who shall hold office at the pleasure of the town council, and who shall have such powers and perform such duties relating to the construction of the work contemplated by this act or otherwise, as the town council may direct, and who may be remunerated for their service at the discretion of the council.

38. The provisions of The Municipal Debentures Act to apply. Act, 1902, shall apply to this act in so far as the same are not inconsistent herewith.

CHAPTER 78.

An Act to Enable the Town of Glace Bay to Supply the Town of Dominion with Electricity.

Preamble.

Whereas, in and by chapter 88 of the acts passed by the Legislature of Nova Scotia in the year 1901, entitled, “An Act to provide for supplying the Town of Glace Bay with Electric Light," the town of Glace Bay was authorized to supply the said town and its inhabitants, as well as persons and bodies corporate residing and being within the town limits, with electric light for lighting the streets of the said town, and for various other purposes;

And whereas, the town of Dominion and certain other outlying districts are desirous of securing electric light from the said town of Glace Bay for street lighting and various other purposes;

And whereas, the town of Glace Bay is ready and willing to supply the town of Dominion and other outlaying districts with electric lights for lighting purposes;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

1. An Act to Enable the town of Glace Bay to Supply
Water to the Town of Dominion and

Out-lying Districts.

SECTION 1. Town authorized to sell and supply water

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The town council of the town of Glace Bay supply water. is hereby authorized and empowered to sell or supply water from its water system, constructed under and by virtue of chapter 80 of the acts of 1902, and acts in amendment thereof, to the town of Dominion and out-lying districts of Glace Bay, in the county of Cape Breton, for domestic, fire and other purposes, upon such terms and conditions, and in such a manner, as may be agreed upon by the town of Glace Bay and the party receiving or purchasing said water, and may do all such other acts as are necessary for supplying water as aforesaid, which are authorized by chapter 80 of the acts of 1902, and acts in amend-ment thereof.

CHAPTER 80.

An Act to Enable the Town of Glace Bay to Borrow
Money for School and Fire Alarm, and

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The town of Glace Bay is authorized and Power to empowered to borrow on the credit of the said town, the sum of thirty-five thousand two hundred dollars for the following purposes, that is to say:

(a) The sum of six thousand five hundred
dollars, for the purpose of building and equip-
ping an addition to the school building at
New Aberdeen, in the said town, and for the
purpose of purchasing, leasing or otherwise
securing a site at or near the Sterling, in the
town of Glace Bay; and for the erecting and
equipping of a school building thereon, and
for no other purpose;

(b) The sum of four thousand five hundred
dollars for the' purpose of installing an efficient
and up to date fire alarm system in said town,
and for no other purpose;

(c) The sum of seven thousand dollars for
improvements and extensions of the reservoir
on Chapel Hill, and for no other purpose;

(d) The sum of thirteen thousand dollars for
the purpose of extension of the water system,
including water connection and the installation
of fire hydrants in the town, building road
and protection and constructing a filter system
at Sand Lake;

(e) The sum of four thousand two hundred dollars for the purpose of building, constructing and repairing certain culverts and bridges within the town of Glace Bay, and for no other purpose;

2. The said money shall be borrowed on debentures, and the town council is hereby authorized to make and issue, from time to time, or at one time, as they may deem expedient, debentures and coupons in the form specified in the Municipal Debentures Act, 1902, and amendments thereto, bearing interest at a rate not exceeding five per centum per annum, payable semi-annually, and to be redeemable at periods not exceeding thirty years from the date of issue thereof.

Such debentures when issued shall form a lien and be a charge against the property liable to taxation within the town of Glace Bay, and all the revenues of the town.

4. The money borrowed under the provisions of this act shall be paid into the hands of the treasurer of the town of Glace Bay, and shall by him be paid out as the town council of the said town may determine for the purposes mentioned in this act, and for no other purposes.

The town council shall, in each year, while said debentures are outstanding, add to the amount to be rated and levied for general purposes for the year, a sum of money sufficient to pay the interest on such debentures for the current year; such sum shall be rated and collected as part of the annual or general assessment.

Sinking fund. 6. In order, to provide a sinking fund for the payment of the debentures, authorized to be issued under this act, the town council shall, in each year while said debentures are outstanding, add to the amount to be rated and levied for general purposes for the year, such sum as the council, by resolution, may determine, but not in any case less than two per centum of the amount borrowed under this act,
