Municipal Debentures Act to apply. Whereas, at a public meeting of the ratepayers of said town of Dominion, duly convened at said town on the 4th day of February, A. D. 1909, under the provisions of "The Towns' Incorporation Act," and acts in amendment thereof, a resolution was duly passed, authorizing the town council of said town of Dominion to borrow the sum of three thousand dollars ($3,000.00) on the credit of the town, and to procure legislation giving said council such authority to borrow three thousand dollars ($3,000.00), for for the purpose of installing an electric light line, plant, or system in the said town of Dominion for street, commercial and domestic lighting: And Whereas, at a public meeting of the ratepayers of said town, also duly convened as aforesaid on the 29th day of January, A. D. 1909, a resolution was duly passed, authorizing the said town council to borrow the sum of twenty thousand ($20,000.00) dollars, or any part thereof, on the credit of the town, and to procure legislation giving said council such authority for the purpose of installing a water supply system in the said town; Be it therefore enacted by the Governor, Council, and Assembly, as follows: borrow. 1. It shall be lawful for the town council or its Authority to contractors or agents, from time to time, for the pur-etc. poses of this act, to open or obstruct the roads, streets or highways within the town, and to keep any such road, street or highway open or obstructed for such reasonable time as may be necessary; and the council or its contractors or agents is hereby empowered to erect and place upon and along the streets and other necessary places in the town of Dominion, poles or Expense for supplying, how borne. The expense of conveying the electric current for supplying the light to the houses, buildings or establishments, which are to be supplied with light under this act, from the main, and the wiring thereof, shall be borne by the owner or the town, as the council may deem proper. 4. The town council may from time to time, at such times as they may deem expedient, improve, extend, or enlarge the electric light line or plant or system of the town, or make repairs, erect poles, and do all things necessary to afford a sufficient supply of light. 5. The moneys accruing from the annual income of the electric light line, plant or system, from whatever source, shall be appropriated and applied in the first place to discharge the current expenses incurred in management and working of the said electric light line, plant, or system, including the necessary material for the electric light line, plant or system, and payment of the salary of the servants necessarily employed by the town in and about the said electric light plant, line, or system, the wear and tear of the same, and every other matter and thing connected with or incidental to the maintenance of the said line, plant or system, so that the same shall always be in efficient state to furnish an ample supply of light for the purposes mentioned in this act; and in the next place, towards the payment of the half-yearly interest of the debentures issued under the authority of this act, and in case the whole income shall not be sufficient for the purposes above mentioned, the deficiency shall be made good by an annual assessment under the provisions of this act or any by-laws made under the authority of this act. 6. The town council of the town of Dominion shall have full power to supply the town and its inhabitants, as well as persons and bodies corporate residing and being within the town limits, from the system con structed under this act and acts in amendment hereof, with electric light for lighting the streets of the town, and for the various other purposes contemplated by this act, upon such terms as the town council may impose, and to make and enter into any contract or contracts with any other person, firm or corporation, for electric current or lighting or for any of the purposes required under this Act, and shall have full power to make, and from time to time repeal, alter or amend all such ordinances, by-laws, rules and regulations, as such council may deem requisite and necessary for regulating the conditions under which the inhabitants of the town and others shall make use of the light supplied by means of the said line, plant or system, the supply of light, and the price to be paid therefor to the town; for preventing injury to any poles, cross-arms, wires, insulators, lamps, engines, boilers, dynamos, alternators or other machinery, stock or material of or in any way belonging to or connected with the said line, plant or system; and also regarding any other thing which it may be necessary or expedient to regulate for the providing and carrying out of the objects of this act or any amendments hereof. to constitute & 7.
