Whereas, by chapter 80 of the acts of 1908, ed, to be depos- it was enacted that the Board of School Commissioners for the district of West Halifax should immediately divide the districts mentioned in section 188 of chapter 56 of the acts of 1902, into new school sections, or annex the same, or any part thereof, to existing school sections in the municipality of the county of Halifax, as the said board in its discretion should deem advisable; Industries, how And whereas, said division was duly made as provided, and arbitrators were appointed under said act, who awarded to the said town of Dartmouth the sum of $7,435.00 as compensation for the lands and buildings used for school purposes in said districts mentioned and described in section 188 of chapter 56 of the acts of 1902; And whereas, the said sum of $7,435.00 has been paid by said municipality to the town, but no provision has been made as to how the same shall be expended; And whereas, the said town is desirous that the said moneys shall be applied to the purchase or redemption of its school bonds; Be it therefore enacted that the said sum of $7,435.00 shall be deposited in a chartered bank, and be drawn from time to time as directed by resolution of the council, on the cheque of the treasurer, countersigned by the mayor, and be used for the purpose of purchasing said bonds in the market or of paying off said bonds as the same shall mature, and for no other purpose whatsoever. Commission of 4. A body to be known as "The Commission of composed. Industries" is hereby created in the town of Dartmouth, which body shall be composed of the mayor, two councillors, who shall annually be appointed at the first meeting of the council in every civic year, and two citizens to be appointed by the Dartmouth Board of Trade. It shall be the duty of the said commission to take such steps as they shall deem expedient to inaugurate a forward movement to encourage new industries to locate in the town, and the extension of those industries already existing. For the use of the commission the town council may annually place in the estimates a sum not to exceed three hundred dollars, which sum may be assessed and collected in the usual way, and the amount when so collected shall be paid into the hands of the treasurer of the said town, and as much thereof as shall be found necessary to defray the expenses incurred by the said commission shall be by him, from time to time, paid out upon the same being approved by the town council by resolution to that effect. 5. Section 159 of chapter 56 of the acts of 1902, Section 159, is hereby repealed and the following section substi- Acts 1902, retuted therefor: (1) 159. Upon being requested thereto by resolution of the town council of Dartmouth, the mayor shall issue under the seal of the town, and in the form A in the schedule to this act, debentures to the amount of eight thousand dollars, each debenture being for one hundred dollars, or some multiple thereof, redeemable in twenty years, bearing interest at such rate as the town council shall determine, but not exceeding five per centum per annum, which debentures when issued shall constitute and be a lien on all the property of the town and of the inhabitants thereof. (2) Section 160 of said chapter 56 of said acts of 1902 is amended by adding after the word debentures m the first line thereof, the following words "except as herein otherwise provided." (3) Section 161 of said chapter 56 of the acts of 1902 is amended by adding thereto the following: "Provided, however, that any portion or portions of said land not required for the purposes of a cemetery (which shall be determined by a resolution of the town council), may from time to time be sold by resolu pealed, another substituted. Debentures, how issued. tion of the town council to any person or persons applying therefor, and proper deeds or conveyances of the same may be given, which deeds or conveyances shall be executed under the seal of the town of Dartmouth by the mayor and town clerk, and shall be held to convey to the purchaser or purchasers all the right, title and interest of the said town of Dartmouth in and to the lands so purporting to be conveyed." (4) Section 162 of said chapter 56 of the acts of 1902 is hereby repealed, and the following section substituted therefor: 162. Twenty-five per cent of all sums derived from the sale of burial lots, and seventy-five per cent. of all sums derived from the sale of such portions of said lands as are not required for the purposes of a cemetery, shall be invested as a sinking fund, and shall be used only for the purchase or redemption of debentures issued under section 159 of this act. 6. (1) The mayor shall, wherever thereto directed by resolution of the town council, issue such and so many debentures as the council shall direct, not to exceed in the aggregate the sum of five thousand dollars, in such amounts and for such periods not exceeding twenty years, and at such rate of interest not exceeding five per centum per annum, and payable at such places and times as the council shall direct, which debentures, when so issued, shall be a charge upon all the property, real and personal of the town, and of the inhabitants thereof. Such debentures shall be sold by the town council for the largest amount that can be obtained therefor, and the proceeds shall be used for the purpose of paying the money borrowed from the Union Bank of Halifax for short extensions of the water and sewer system, during the years 1904, 1905, 1906 and 1907. (2) All sums paid in on account of sewer rates for any sewer constructed with the funds provided by the sale of debentures as in this act provided for, shall be added to and become part of the sinking fund provided for by section 67, chapter 56, acts of 1902. quire certain 201 7. MacLean, certain lands at Dartmouth aforesaid, for the purpose of extending Edward Street southerly from Quarrell Street to Portland Street. The town of Dartmouth may borrow a sum not exceeding six thousand two hundred dollars, and issue debentures therefor under the seal of the town, in such amounts and redeemable at such periods, not exceeding twenty years, and at a rate of interest not exceeding five per centum per annum, and payable at such places as the council shall determine, and the proceeds of said debentures shall be used for the purchase of the said lands, and for no other purpose whatsoever, and such debentures when issued shall be a charge upon the real and personal property of the town and of the inhabitants thereof. Any portion or portions of said lands which may not be required for the extension of said street as aforesaid (which shall be determined by resolution of the town council), may be let or sold on resolution of the town council, and the moneys arising from such leasing or sales shall form part of a sinking fund which shall be used for the purpose of paying off said debentures as they shall fall due. 8. In order to provide a sinking fund for the pay- Sinking fund ment at maturity of the debentures issued under the authority of section 7 of this act, the town council shall annually add to the amount to be rated upon the town, such sum as the council determines, not however to be less than two per centum of the amount so borrowed, and such sum shall be rated and collected in the same manner and with the same remedies as ordinary rates and taxes. 9. Sub-section (c), section 16, chapter 56, acts of 1902, is hereby repealed and the following sub-section substituted: "(c) $200 to be paid to the directors of the Dartmouth Reading Room. " CHAPTER 76. An Act to enable the Municipality of the District of (Passed the 23rd day of April, A. D. 1909.) Preamble. authorized to certain pur pose. Whereas, the sum of twenty thousand dollars, authorized by chapter 120 of the acts of 1906, is insufficient to finish the construction and furnishing of the new court house and jail at Digby; And whereas, the municipal council of the municipality of the district of Digby desire authority to borrow an additional sum of twenty thousand dollars to complete the work of constructing and furnishing said court house and jail; Be it therefore enacted by the Governor, Council, and Assembly, as follows: Municipality 1.
