CHAPTER 25.

An Act to amend Chapter 70, Revised Statutes, 1900, "The Municipal Act."

Be it enacted by the Governor, Council, and Assembly, as follows:

Clause (f) of 1.

section 97 amended.

Clause (f),

of section 103,

Clause (f) of section 97 of chapter 70 of the Revised Statutes, 1900, "The Municipal Act," is amended by inserting the words:-"together with such other information as may from time to time be prescribed by the Governor-in-Council" between the words "Municipality" and "and" in the last line of said clause.

2. Clause (f) of section 103 of said chapter is rerepealed an- pealed and the following substituted therefor:

(f) To transmit to the Provincial Secretary each year, at least ten days before the commencement of the session of the legislature, an abstract of the receipts and expenditure of the municipality during the preceding year, and also a statement showing fully and accurately such information as may from time to time be prescribed by the Governor-in-Council; and such abstract and statement shall be laid before the legislature at such session.

CHAPTER 26.

An Act to amend chapter 71, Revised Statutes, 1900, "The Towns' Incorporation Act."

..Be it enacted by the Governor, Council, and Assembly, as follows:

Section 135,

1. Section 135 of chapter 71 of the Revised Statutes, amended. 1900, "The Towns' Incorporation Act," is amended by inserting the words, "and such other particulars as may from time to time be prescribed by the Governor-in-Council," after the word "Chapter," in the fourth line thereof.

CHAPTER 27.

An Act to amend Chapter 73, Revised Statutes, 1900, "The Assessment Act."

Be it enacted by the Governor, Council, and Assembly, as follows:

SECTION 1. Section 5, Chapter 73, R. S., N. S., as amended by Chapter 81, Acts 1908, further amended.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 5 of chapter 73 of the Revised Statutes R. S., N. S., of Nova Scotia, as amended by chapter 81 of the Chapter 81, acts of 1908, is amended by striking out all the words further amend- by said chapter 81 added to said section 5, beginning with the words "but in the municipality," and ending with the words "as herein provided.

An Act to amend Chapter 75, Revised Statutes, 1900, "Of Court Houses, Jails, and Lock-up Houses. "

1. 2. 3. All acts inconsistent with this act are hereby repealed.

An Act to amend Chapter 76, Revised Statutes, 1900, "Of Public Highways."

SECTION 1. Sub-section added to Section 27.

Be it enacted by the Governor, Council, and Assem bly, as follows:

Sub-section 1. Chapter 76 of the Revised Statutes, 1900, “Of Public Highways," is amended by inserting after section 27, sub-section 9, the following section:

(10) Where any road has been laid or marked out under the provisions of this act, or any statute or statutes of the Province applicable thereto, heretofore enacted, and said road has never been used by the public as a general thoroughfare, or has been abandoned by the public as a general thoroughfare, for a period of at least twenty years, the council of the municipality may, on the application of the person, firm or corporation owning the land the said road was laid or marked out of, make an order shutting up said road, and may convey the land taken for said road to said person, firm or corporation on payment to said municipality of such amount, not less than the amount originally paid as compensation for said road, with interest calculated at such a rate not exceeding five per centum per annum as the council may determine, and said conveyance shall vest the absolute ownership of said land in said person, firm or corporation.
