CHAPTER 20. An Act to amend Chapter 53, Revised Statutes, 1900, entitled, "Of the Education of Deaf or Deaf Mute Persons," and Amendments thereof. Be it enacted by the Governor, Council, and Assembly, as follows: tuted. 1. For every deaf or deaf mute person received into the Institution of the Deaf and Dumb at Halifax, under an order from the warden of a municipality. or under an order from the mayor of an incorporated town which contributes to the municipal school fund, and educated and boarded therein, the board of directors of the Institution shall be entitled to receive from the provincial treasury the sum of one hundred dollars per annum, payable half-yearly, and also to receive annually the sum of one hundred dollars, payable half-yearly, from the municipal school fund of such municipality. pealed, ar 2. Section 5 of said chapter 53, as amended by Section 5 rechapter 13 of the acts of 1903 and chapter 10 of the other substi acts of 1906, is repealed, and the following substituted therefor : 5. For every deaf or deaf mute person who is admitted into the Institution for the Deaf and Dumb at Halifax, under an order from the mayor of a city or town, an allowance to the board of directors of the institution of one hundred dollars per annum shall be rated upon the inhabitants of such city or town; in case such city or town does not contribute to or draw from the municipal school fund, and in such tuted. When Act comes into force. case such sum shall be paid to the directors for each such deaf or deaf mute person sent to the institution. And there shall be paid to the directors from the provincial treasury for each such deaf or deaf mute person for which such city or town contributes such allowance, the sum of one hundred dollars, in the manner provided in the next preceding section. 3. This Act shall not come into force until the first day of October, 1909. CHAPTER 21. An Act to amend Chapter 54, Revised Statutes, 1900, entitled, "Of the Education of the Blind," and Be it enacted by the Governor, Council, and Assem bly, as follows: Section 3 re- 1. For every blind person received into the Halifax School for the Blind under an order from the warden of a municipality, or under an order from the mayor of an incorporated town which contributes to the municipal school fund, and educated and boarded therein, the board of managers of such school shall be entitled to receive from the provincial treasury the sum of one hundred dollars per annum, payable halfyearly, and also to receive annually the sum of one hundred dollars payable half-yearly, from the municipal school fund of such municipality. 2. Section 4 of the said chapter 54 is amended by chapter 20 of the acts of 1905, and chapter 9 of the acts of 1906, is repealed, and the following substituted therefor: 2 4. For every blind person who is admitted into the Halifax School for the Blind, under an order from the mayor of a city or town, an allowance to the board of managers of the school of one hundred dollars per annum shall be rated upon the inhabitants of the said city or town in case such city or town does not contribute to or draw from the municipal school fund, and in such case such sum shall be paid to the managers for each such blind person sent to the school, and there shall be paid to the managers from the provincial treasury for each such blind person for which such city or town contributes such allowance, the sum of one hundred dollars, in the manner provided in the next preceding section 3. This act shall not come into force until the first day of October, 1909. When act comes into force. CHAPTER 22. An Act to amend Chapter 66, Revised Statutes, 1900, entitled "Of the Improvement of Dyked and Marsh Lands. (Passed the 23rd day of April, A. D., 1909.) SECTION 1. Section 16 added to. Be it enacted by the Governor, Council, and Assembly, as follows: 1. Chapter 66 of the Revised Statutes, 1900, en-Section 16 titled "Of the Improvement of Dyked and Marsh added to. Lands" is hereby amended by inserting immediately after the sixteenth section of the same the following: 16 A (1) In any case where there is no access by road or right of way to a public highway from lands of any proprietor subject to be assessed or rated for any purpose under the said act, the commissioner shall locate a road or right of way across lands of such other proprietor or proprietors as he shall deem I most proper to a highway, and the same, when so located, may be used by any proprietor or proprietors whose lands are specified for such purpose in the record of such location and for such purposes as shall be therein specified. (2) Any compensation to which any proprietor shall be entitled by reason of such road or right of way, shall be ascertained as provided by sections 26 and 67 of the said act, and such compensation shall be apportioned among and assessed upon the lands of proprietors benefitted by the said road or right of way in proportion to the benefit accruing therefrom, and collected from such proprietors as other dyke rates, and paid to the persons entitled. CHAPTER 23. An Act to amend Chapter 70, Revised Statutes, 1900, "The Municipal Act" and acts in amendment thereof, in so far as the same applies to the Municipality of the County of Halifax. (Passed the 23rd day of April, A. D. 1909.) of section 134 of Acts 1903-4, SECTION. 1. Sub-section 10 of section 134 SECTION. 2. By-laws passed by virtue of above acts declared invalid. Be it enacted by the Governor, Council, and Assembly, as follows: Sub-section 10 1. CHAPTER 24. An Act to amend Chapter 70, Revised Statutes, 1900, "The Municipal Act." (Passed the 23rd day of April, A. D. 1909.) SECTION 1. Section 104 added to. Be it enacted by the Governor, Council, and Assembly, as follows: 1. Section one hundred and four of chapter 70, Revised Statutes, 1900, "The Municipal Act," is amended by adding thereto the following sub-section; added to. (2) In case of the temporary absence, illness or Section 104 other incapacity of the treasurer, he may appoint a deputy treasurer, who shall perform all the duties of the treasurer, and the treasurer shall be responsible for all acts and omissions of such deputy treasurer. |
