AN ACT to amend an act entitled" an act appointing Commissioners to lay out the Roads therein mentioned," approved February 10, 1823.

Sec. 2. Be it further enacted, That the road commencing at the aforesaid line of Fayette county, as laid out by the order of the county commissioners' court of Crawford county, until it reaches the west line of range number twelve, west of the second principal meridian, be, and the same is hereby made a state road; and the county commissioners' court of Crawford county, are hereby authorized and required to appoint three discreet, disinterested freeholders, who, after taking an oath to do impartial justice, shall proceed to view and mark out from where the aforesaid road terminates at the

west line of range twelve, the nearest and best way to Palestine, so as not to pass through any farms in said route at the expense of the county; and to make return of the same to the county commissioners' court aforesaid. All of which road from Vandalia to Palestine shall be a public highway.

AN ACT providing for the examination of the
Shawneetown Branch Bank, and for other pur.

poses.

APPROVED, December 16, 1824.

Sec. 1. Be it enacted by the people of the state of Illinois represented in the General Assembly, That Commissioners ap. Henry L. Webb, Roswell H. Grant, and John pointed. Caldwell, or either of them, be, and they are hereby authorized and empowered to proceed forthwith to the town of Shawneetown, to examine the condition of the Branch of the State Bank of Illinois, located at that place; and the president and directors of the said Branch Bank, and the cashier thereof, are hereby required to expose all the books, papers, notes, mortgages, money, and state paper, appertaining to said Branch Bank, to the view, inspection, and examination of the above named persons, or either of them, as aforesaid.

Cashier to deliver all monies in his possession.

Sec. 2. Be it further enacted, That it shall be the duty of the cashier of the said Branch Bank, to deliver over to the order of the cashier of the principal Bank of said state, the whole amount of the ten per cent. fund which may have been received at the said Branch Bank; and which is required to be withdrawn from circulation by the act

entitled "an act establishing the State Bank of Illinois," as well as all other monies or state paper now on hand, being the property of the said Branch Bank; and the cashier of the principal Bank as aforesaid, is hereby authorized and required to draw his order in favor of the said Henry L. Webb for the same.

Sec. 3. Be it further enacted, That it shall be the duty of the said Henry L. Webb, when he shall have received the ten per cent. fund and voluntary payments, by virtue of the order aforesaid, to pay over the same to the principal cashier, as soon thereafter as may be convenient; and shall also report to the present General Assembly the amount of money and notes which may be received by him and paid over as aforesaid, together with the situation of the said Branch Bank.

Sec. 4. Be it further enacted, That the said Henry L. Webb shall be, and he is hereby authorized to employ one or more persons in behalf of the said state to assist in accomplishing the objects of

this act,

Sec. 5. Be it further enacted, That if the said president and directors of the said Branch Bank, or the cashier thereof, shall, upon the application of the above named persons, or either of them, neglect or refuse to permit an examination of the said Branch Bank to be made, or shall neglect or refuse to pay over said money and notes upon the order of the principal cashier as aforesaid, according to the true intent and meaning of this act, they shall respectively be fined in the sum of one thousand dollars, to be recovered by action of debt, in the name of the president and directors of the state bank of Illinois, for the use of the people of the said state, in any court of competent jurisdiction: and it shall be the duty of the attorney general, in case of default as aforesaid, to commence suits against the said president and directors of the said Branch Bank, or the cashier thereof," or either of them, defaulting as aforesaid, in their individual capacities, without delay; which said fines, when collected, shall be paid into the state treasury.

Sec. 6. Be it further enacted, That all laws and parts of laws coming within the purview of this
