An Act to provide for a valuation of certain school lands.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That upon application to the commissioners of Shelby county, within six months from the passage of this act, by the lessee or lessees of section numbered sixteen, in township numbered one, of range numbered seven, east of the first meridian, situate in said county of Shelby, the said commissioners shall appoint three disinterested freeholders of said county, who are not inhabitants of said township, who having severally taken an oath or affirmation faithfully to discharge the duties required of them by the provisions of this act, shall proceed to view and appraise the lot or lots of land in said section, pursuant to said application, as though the same was in a wild and uncultivated state, not taking into consideration any improvements made thereon, and shall certify the same in writing under their hands and seals, to the clerk of said original surveyed township, who shall record the same; on which appraisement the said lessee or lessees shall pay six per cent. yearly to the treasurer of said township, in lieu of the rent heretofore charged: Provided, That nothing in this act shall be so construed as to prevent a revaluation of said lot or lots of land, at the expiration of thirty three years from the date of the existing leases, pursuant to the law under which the same were granted. And provided also, That the lessee or lessees applying for the benefit of this act, shall pay to each of said appraisers the sum of seventy five cents for each day necessarily employed in said services; and shall also pay to the clerk of said township the sum of twenty five cents for recording each certificate of appraisment.

An Act for the relief of William Wilson, Auditor of Clark county.

Sec. 1 Be it enacted by the General Assembly of the state of Ohio, That William Wilson, Auditor of Clark county have until the second Tuesday of April next, to sell the lands returned to him delinquent by the Auditor of state for the taxes of the years eighteen hundred and twenty two, and eigh teen hundred and twenty three together with the taxes of the current year, under the provisions of the act "defining the duties of county auditor," passed, February twenty third, one thousand eight hundred and twenty four.

An Act for the relief of Alexander Montgomery.

Whereas, it has been represented to this General Assembly, that Alexander Montgomery o: Fairfield county, a blind man, who has a small and in some measure a helpless family, did some time previous to the loss of his sight, purchase a small tract of land from the United States, on which he still owes two hundred and forty dollars, and that the said Montgomery in consequence of great bodily affliction in addition to the loss of sight, has been compelled to expend the greater part of his personal property, which renders him unable to pay said balance on his land, and that notwithstanding his misfortunes he is still unwilling to become a pauper. Therefore.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the commissioners of Fairfield county, be, and are hereby authorized and empowered to pay to the said Alexander Montgomery or his legal representative, out of the treasury of said county, any sum or sums not exceeding two hundred and forty dollars, as to them shall seem correct and proper.

An Act to provide for laying out and constructing a road from Beth lehem, in Stark county, to Millersburg, in Holmes county.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That Herman Vandorstan, of Stark county, Jacob Beam of Wayne county, and Peter Casey of Holmes county be, and they are hereby appointed commissioners to lay out and construct a road from the town Bethlehem in said county of Stark, by Paint ille to the town of Millersburg in said County of Holmes, pursuant to the provisions herein contained, and the act entitled an act, defining the mode of laying out and establishing state roads."

Sec. 2. That each of said commissioners and their successors in office, shall be invested with the same powers and privileges in entering on the land near said road, procuring the necessary materials therefor, and draining water therefrom, with which supervisors are invested by the "act for opening and regulating roads and highways;" and any person aggrieved, may obtain redress in the manner pointed out in said act.

Sec. 3. That each of said commissioners may take any subscription or donation whatever for the use of said road, receive, collect and apply the same to construct said road as he shall think best, and may contract for making said road, or any part thereof, and maintain suits for the non perfor mance of the same, or for any injury done to, or concerning said road; and when all of said commissioners think it necessary, they may cause any part, not exceeding one half of the land tax, for road purposes, which may be assessed in any township through which said road may be laid out, to be expended on said road, by making out their order on the trustees and supervisors of such township for that purpose; which order such trustees and supervisors are hereby requir ed to obey.

Sec. 4. That in case either of said commissioners shall die, refuse to perform the duties of his appointment, or remove out of the county in which he now resides, the county commissioners thereof shall, as soon as convenience will permit, proceed to appoint some suitable person to fill such va cancy occasioned by such death, refusal or removal, and so continue to fill such vacancy as often as the same shall happen, and low said road commissioners such compensation for their services in improving said road, as they shall think reasonable, to be paid out of the county treasury of the coun ty in which said commissioner may reside.

An Act to confirm and legalize the sale of a certain tract of land made by the administrator of William Byers, late of Scioto county, deceased, to David Mitchel, of said county.

Whereas it appears to this General Assembly, that at July term of the court of common pleas for the county of Scioto, held in Portsmouth on the first day of July, eighteen hundred and twenty-four, William Byers, administrator of William Byers, late of Scioto county, deceased, presen ted his petition to said court, praying an order to sell so much of the real property, whereof the said William deceased, died seized, as would be sufficient to pay the balance of said decedent's debts; that in pursuance of the prayer contained in said petition, the court did order and direct that he proceed to sell in pursuance of the statute passed January twenty fifth, eighteen hundred and sixteen, a certain piece or parcel of land, situate, lying and being in the county of Scioto, on Lower-twin creek; that in pursuance of said order, the administrator aforesaid, did proceed to sell said land, and executed his deed of conveyance to David Mitchell the purchaser, who entered upon the same and has since expended large sums of mopey in improvements hereon; and

Whereas it appears that the law under which the aforesaid order of court, and subsequent sale in pursuance thereof, were made, was declared to be repealed the first day of June, eighteen hundred and twenty four, by the provisions of the twenty-eighth section of the act entitled "an act defining the duties of executors and administrators," passed February eleventh, eighteen hundred and twenty four, which last mentioned act was not published in said county, or known by the court till the first of September, eighteen hundred and twenty-four, three months after the repeal of the former; and as doubts have arisen whether the proceedings of the administrator and purchase of the

premises, by David Mitchell, under the order of court, and sale aforesaid, are good and valid in law--Therefore,

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the order of the court of common pleas of Scioto county, at July term, eighteen hundred and twenty-four, or dering and directing William Byers, administrator of William Byers, late of Scioto county, deceased, to sell a certain tract or parcel of land, situate on Lower-twin creek, in said courty, in pursuance of the act of the twenty-fifth day of January, eighteen hundred and sixteen, together with the sale and conveyance made by said administrator to David Mitchell, in pursuance of such order, is hereby declared as good and valid in law as if the same had been done under the provisions of the act, entitled "an act, defining the duties of executors and administrator" passed February eleventh, eighteen hundred and twenty-four.

An Act for the relief of certain road commissioners.

Sec. 1. Be enacted by the General Assembly of the state of Ohio, That Josiah Gallop of the county of Richland, Herman Ely of the county of Lorain, and Frederick Hamlin of the county of Medina, commissioners on a certain state road from Uniontown in Richland county, to the mouth of Black river, by way of Elyria, established by an act establishing state roads, passed the twenty seventh day of January, eigh teen hundred and twenty-three, be allowed the sum of sixtythree dollars for laying out such part of said road, as passes through the county of Lorain, to be paid out of the three per cent. fund, and charged to the county of Lorain.

Sec. 2. That Robert Huston of Shelby county, and John McCorkle, of Miami county, commissioners on a certain state road from Fort Loramies in Shelby county, to Fort St. Mary's in Mercer county, established by an act passed the twentysecond of January, eighteen hundred and twenty-one, be allowed the sum of thirty-four dollars and fifty cents for laying out said road, to be paid out of the three per cent.
