purposes for collecting said tax: Provided, That said Ellas Howell has or shall have proceeded in other respects as the act defining the duty of the collector of the land tax and also the act defining the duty of the collector of the county tax directs; any thing in the above recited acts to the contrary notwithstanding.

An Act to legalize the judicial and ministerial acts of Charles Dex. ter a justice of the peace in the county of Darke.

Whereas, it has been represented to this General Assembly, that Charles Dexter was duly elected a justice of the peace in the township of Washington in the county of Darke, and was duly commissioned, and in every respect complied with the provisious of the statute, in such case made and provided, except that the bond given by said justice was made payable to the trustees instead of the treasurer of said township, and contained but one securi ty, and as doubts do exist whether the official acts of the said Charles Dexter as justice of the peace be legal. Therefore,

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That all and singular the acts, both judicial and ministerial of the said Charles Dexter, by him done and performed as justice of the peace of the township of Washington in the county of Darke, be and they are hereby confirmed, and declared legal, so far as they would have been if the bond given by the said justice for the faithful discharge of the duties of said office had in all respects been legal, and the trustees of the said township of Washington, be and they are hereby authorized and empowered to receive from the said Charles D xter a bond with two or more sufficient sureties, to be approved of by the trustees of his township, payable to the treasurer of the township and his successor in office as pointed out in the ninth section of the act providing for the election and resignation of justices of the peace, which when duly executed shall be as good and valid in law to all intents and purposes, as if said bond had been given within

the ten days after the qualification of said justice of the peace agreeably to law.

An Act to authorize the county Commissioners of the Counties of Athens and Clermont to perform certain, duties therein named.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the commissioners of the county of A hens for the time being are hereby authorized to sell and convey all the right, title and interest with which the county of Athens is invested in town lot number thirty seven, in the town of Athens, subject to such rent as sbali be agreed upon between the commissioners of said county of Athens and the trustees. of the Ohio University, which rent shall forever accrue for the benefit of said Ouio Uri-ersity.

Sec. 2. That after the sale of said lot shall be effected the county commissioners shall forthwith pay over the avails thereof to the county treasurer of said county of Athens.

Sec. 3. That the commissioners of the county of C1c. mont, be and they are hereby authorised and required to expose to public sale, (after having given previous notice thereof by advertisement,) to the highest bidder, a certain unfinished brick building, together with the ground hereinafter mentioned, situate on the public avenue, between the towns of New Richmond and Susan in the county aforesaid, at a reasonable credit, taking from the purchaser bond and good security for the purchase money payable to said commis sioners, and their successors in office, which said purchase money shall be paid into the county treasury for county purposes; and said commissioners shall convey by deed to such purchaser said unfinished building, together with 80 much of said avenue or street as shall be included in the following boundaries, to wit: Beginning twenty eight feet south, thirty one degrees east from the south east corner of centre street, in said town of New Richmond; thence south thirty one degrees, east seventy two feet; thence south filty nine degrees, west one hundred and ninety feet, thence at right angles including the building aforesaid; which said deed when so made, shall vest in such purchaser all the

right to the ground included in the boundaries aforesaid, which the original proprietors of said towns might or could have conveyed, prior to said towns being laid out, and the plats thereof recorded: Provided however, Toat before said commissioners shall proceed to sell and convey the said building and the ground contained in the boundaries aforesaid, they shall obtain the consent of the original proprietors of the said towns of New Richmond and Susan in writing and also the consent in writing of the owner or owners of any lot or lots in said town, that may adjoin that portion of said street or avenue included in the boundaries aforesaid. An Act authorizing the commissioners of Hamilton County to alte and amend the state road leading from Cincinnati to Columbia in said county.

Whereas, it has been represented to this General Assembly, that the state road, leading from Cincinnati to Columbia in the county of Hamilton, is frequently inundated and rendered impassible by the high waters of the Ohio river. Therefore,

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the commissioners of Hamilton county are authorized, and it is hereby made their duty to cause the state road, leading from Cincinnati to Columbia, in said county, to be located, altered and changed as follows, to wit: Begin ning at the new stone bridge near the eastern boundary line. of Cincinnati, thence on the nearest and best route, so that the same shall be above high water mark of the Ohio river as near as may be to Columbia, intersecting the old road near James C. Morris' dwelling house, and for this purpose the commissioners aforesaid shall appoint three judicious disinterested land holders, together with the county surveyor, who shall view, survey, locate, change and alter said road to run as aforesaid, and proceed in all other respects according to the provisions of the act entitled "An act defining the mode of laying out and establishing state roads," and that said road

when so located and altered shall be recorded a public high

way.

An Act to authorize the commissioners of the County of Delaware to sell certain public ground therein specified.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the county commissioners of the county of Delaware, be, and they are hereby authorized to grant, bargain and sell, to such person or persons and in such lot or lote, parcel or parcels as to them shall seem meet, for such price or prices, either for cash in hand or on such credit as they, or a majority of them, shall deem most for the interest of said county, the following described lot or parcel of land, situate in said town of Delaware, the same being part of the public ground heretofore conveyed by Henry Baldwin and Moses Byxbee to the said commissioners, and bounded as follows, to wit: beginning at the north east corner of the court house yard, in said town of Delaware; thence west twenty five rods, thence north seventeen rods, thence east twenty live rode to Sandusky street, thence with said street to the place of beginning.

Sec. 2. That the commissioners aforesaid having made the sale authorized by the first section of this act, shall, and they are hereby authorized to convey by deed, in fee simple the whole or any separate parcel or parcels of said lot to the purchaser or purchasers, and their deed or deeds thus made and executed shall vest in the said purchaser or purchasers, all the right, title and interest now held by said commissioners in the lot or parcel of land aforesaid.

Sec. 3 That the commissioners aforesaid are hereby authorized to appropriate the proceeds of said sale to the discharge of the debt of said county, to the erection of a county jail in said county, or such other public work as the said commissioners shall deem most beneficial for the interest of said county.

An Act to provide for laying aut and improving a road from Can ton in a direction towards Cleaveland.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That John Kryder, of Stark count, and Gideon Mills of Portage county, be, and they are hereby appointed commissioners to lay out and construct a road from Canton, in said county of Stark, to intersect the road.from Cleaveland to the Ohio river, in the township of Twinsburg in the county of Portage, pursuant to the provisions herein contained, and the act entitled "An act defining the mode of establishing state roads."

Sec. 2. That each of said commissioners and their successors in office, shall be invested with the same power and privileges in entering on the land near said road, procuring the necessary materials therefor, and draining water there. from, with which supervisors are invested by the act for opening and regulating roads, and highways; and any person ag grieved may obtain redress in the manner pointed out in said act..

Sec. 3. That each of said commissioners may take, any subscription or donation whatever for the use of said road receive, collect and apply the same to construct said road as he shall think best, and may contract for making said road or any part thereof, and maintain sui's. for the non performance of the same, or for any injury done to or concerning said road; and when both of said commissioners think it necessary, they may, cause any part not exceeding one half the land tax for road purposes which may be assessed in any township through which said road may be established, to be expended on said road, by making out their order to the trustees and supervisors of such township for that purpose; which order such trustees and supervisors are hereby required to obey: Provided, That any appropriation heretofore made or authorized on said road from Cleaveland to the Ohio? river shall not be affected by the provisions of this act

Sec. 4. That in case either of said commissioners should die, refuse to perform the duties of his appointment, or re- ` move out of the county in which he now resides, the county commissioners thereof shall, as soon as convenience will permit, proceed to appoint some suitable person to fill such va cancy occasioned by such refusal, death or removal, and so continue to fill such vacancy as often as the same shall hap pen, and from time to time allow such road commissioners such compensation for their services in improving said road, as they shall consider reasonable, to be paid out of the trea
