An Act to change the name of John Bishop.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That the name of John Bishop, an infant son of Ira Bishop of Bath, in the county of Medina, be and the same is hereby changed, and that the said John shall be hereafter known by the name of John Bishop Wheadon.

An Act to lay out a state road from the east line of this state, in the township of Kinsman, in Trumbull county, to the village of Cleaveland in Cuyahoga county.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That Thomas Howe of Trumbull county, Eleazer Hickox of Geauga county, and Samuel Williamson of Cuyaho•, ga county, be, and they are hereby appointed commissioners to lay out, establish,construct, and keep in repair, a state road from a point on the east line of this state in the township of Kinsman, in Trumbull county, through the townships of Mesopotamia in said county of T umbull, and Burton in Geauga county, to the village of Cleaveland in Cuyahoga county, under the provisions of the act, entitled "an act defining the mode of laying out and establishing state roads," so far as said provisions shall not be contrary to, or inconsistent with the provisions of this act.

Sec. 2. That each of said commissioners, his successor or successors, shall be invested with the same power and privileges in entering on the land near said road, procuring the necessary materials therefor, and draining the waters

therefrom, with which supervisors of highways are invested by an act, entitled "An act for opening and regulating highways;" and any person aggrieved under the provisions of this section, may obtain redress in the same way aud manner as pointed out in the last mentioned act.

Sec. 3. That each of said commissioners, his successor or successors within the county where he resides and wh re said road is located, may receive subscriptions or donations of land, or any other property for the purpose of making and constructing said road, or any part thereof; may take bonds, notes, or other security for the payment of such subscriptions or donations, or for the performa ce of such propositions as may be made; may take deeds or other conveyances of land, or other property given for the purpose of constructing said road, and each and every part thereof; may enter into contracts to sell and convey, and may sell and convey any land or other property, for the sole purpose of making, constructing, or keeping in repair said road or any part thereof; may sue for the non-performance of any promise or contract, or for any wrong or injury done to or concerning said road; may cause any part of the land tax for road purposes, or any other road tax lawfully assessed, not to exceed one half of such tax or taxes on any township in his proper county, through which said road is laid out and established, to be laid out, worked and expended in making, constructing, or keeping in repair said road, by making out his order to the trustees and to the supervisors of highways of such township; which order said trustees and supervisors are hereby required to obey; and whenever such trustees may deem it necessary or proper, that the residue of such taxes or any part thereof, should be worked, laid out or expended on said road, they may so order such supervisors; and in all cases such supervisors shall act under the direction of said road commissioners as to the manner of constructing said road.

Sec. 4. That in case a vacancy should happen by the death, removal from the county where he now resides, or a refusal or neglect to perform the duties of his appointment of any commissioner appointed by this act, or the successor or successors of such commissioner, the county commissioners of the county where such vacancy may happen, shall, as soon as convenience will permit, appoint some suitable person in such county, to fill such vacancy; and who shall take such oath or affirmation, and shall receive such compensation for his services as is provided by law, for said road commissioners and in the same way and manner.

Sec. 5. That the secretary of state is hereby required to transmit as soon as conv. nient, a copy of this act to each of vaid road commissioners.

An act for the relief of Elijah Huntington Collector of Delaware County.

Whereas it appears to this General Assembly, that Elijah Huntington, Collector of the state taxes for Delaware County has been prévented by sickness from performing all the duties required of him by law. Therefore,

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, Tha Elijah Huntington, Collector of state tax for the County of Delaware, for the year one thousand eight hundred and twenty four, be allowed until the first day of Feb ruary nex', to complete the collection, and pay over said texas the law directs: Provided however, That before the said Elijah Huntington shall have the benefit of this act he shall renew his bond with recurities in double the amount of the whole of the said tax charged on his duplicate, and procure the assent of his former securities to be endorsed on said bond, whose names shall be subscribed thereto.

An Act for the relief of John Brown Auditor of Athens County:

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That John Brown Auditor of Athens County have until the first Tuesday of April next to sell the lauds returned to him by the Auditor of state as delinquent, for the taxes of the years eighteen hundred and twenty, two, and eighteen bundred and twenty three, together with the taxes of the

current year, under the provisions of the "Act defining the duties of County Auditors," passed February twenty third, eighteen hundred and twenty four.

An Act to change the name of the town of Austintown in the County of Trumbull.

Sec. 1. Be it enacted by the General Assembly of the state of Ohio. That the town of Austintown in the county of Trumbull, shall henceforth be known and distinguished by the name of Meander.

An Act, to divorce Mary G. Mackey from her husband John

Mackey.

Whereas, it has been represented to this General Assembly, that Mary G. Mackey of the county of Hamilton in the state of Ohio, was on the tenth day of December, in the year of our Lord eighteen hundred and sixteen, lawfully married to John Mackey, that a short time after their said marriage, the said John Mackey, wilfully and without cause, abandoned the said Mary, and continued wilfully absent for the space of more than seven years, in foreign parts unknown to the said Mary, who from information be. lieved him to be dead.

And whereas, it has been shewn that after an absence of more than six years, the said Mary believing the said John Mackey to be dead was married to one John Clark of the said county ot Hamilton by whom she had one child. And whereas, it also appears, that after the marriage of the said Mary to the said John Clark. the said John Ma key returned from foreign parts to the said county of Hamil

ton, and claimed to live with the said Mary, who consented thereto.

And whereas, it also appears that the said John Mackey, shortly after his return, persuaded the said Mary to accompany him to the city of New York, where he abandoned her a second time, without cause and without the knowledge of the said Mary, and sailed to parts unknown leaving the said Mary wholly destitute. Therefore.

Sec. 1 Be it enacted by the General Assembly of the state of Ohio, That the marriage contract heretofore solemnized between Mary G. Ma key of the county of Hamilton and ber husband John Ma key be and the same is hereby dissolved, and that they, and each of them be and hereby are released from all obligation arising from the same, and that the said Mary G. Mackey have the sole care, guardianship and control of her daughter, the issue of the said John and Mary G. Mickey, and also of her child the issue of the said John Clark and the said Mary G. Mackey.

An Act for the relief of Elias Howell, Collector of Licking County.

Whereas it is represented to this General Assembly that Elias Howell Collector of the state and county tax of Licking county, has been prevented from commencing the collections of the state and county tax in said county of Licking, in consequence of not having been able to obtain the duplicate of the tax of said county until the fourth day of October last, and the said Elias Howell having prayed this General Assembly to grant him to the end of the present year to demand said tax as required by law. Therefore,

Sec. 1. Be it enacted by the General Assembly of the state of Ohio, That Elis Howell collector of the state and county tax of Lick g county for the year one thousand eight bundred and twenty four, be allowed until the first day of January pe x, to demand the state and county tax within the count. of Licking, and the demand so made at any time previous to the first day of January one thousand eight hundred and twenty five, is hereby declared lawful to all intents and
